  1. Hi all,

    Please help my parents with few questions. My mom sponsor my bother and sister. She's already got the NOA2 and now she just got NVC Welcome Letter (PAOSF) which had case number and Invoice ID number.

    Last night we paid AOS $120 per person and completed DS-261. Now it's still in processing.

    Here is some info:

    Case Type: I-130 Petition for Alien Relative

    Child of LPR (IR5), PD 6/3/2015 Approved (NOA2)

    Priority Date: June 3, 2015

    F2A

    Questions:

    Is this the form to fill out for her, I-864?

    For co-sponsor which is her spouse, is this the form I-864A? Her spouse is also a LPR (IR5).

    My parents does not know how to read or write English. I will be the the Agent and preparing all forms for them.

    Part 8: Sponsor's contract Question #2: I have requested the services of and consented to ------ who "is" or "is not" an attorney or accredited representative, preparing this affidavit for me.

    * Do I put my name in that "dash line" and check as "is" or "is not"?

    Part 9: Interpreter's Contact Information --> is this my information since I prepare and interpreter for her to understand?

    Part 10. Preparer's Contact Information --> I guess my information in here too since prepared?

  2. Receive NOA2 yesterday for all three kids. The letter said it mail to NVC at Portsmouth, NH. Wait after 30 days to call for update.

    NOA2 Letter:

    Case Type: I-130 Petition for Alien Relative

    Receipt#: WAC-xx-xxx-xxxxx

    Receipt Date: June 4, 2015

    Priority Date: June 3, 2015

    Notice Date: July 23, 2015

    Notice Type: Approval Notice. Section: Unmarried child under 21 of permament resident, 203(a)(2)(A) INA

    Just looked at the dates in your first post.

    PD: June 03, 2015.

    Approval of the I-130: June 23, 2015.

    This means that CSPA will protect her for 20 days.

    Her PD would have to be current by the October 2015 or November 2015 Visa Bulletin for her to benefit from CSPA and retain the F2a category.

    The August 2015 Visa Bulletin shows the current PD for the F2a category is December 15, 2013.

    It's extremely improbable for her PD to be current by October or November 2015. She will age out into the F2b category and CSPA will not help her.

    There is nothing that mom can do.

  4. According to the current visa bulletin http://travel.state.gov/content/visas/english/law-and-policy/bulletin.html category F2A with a priority date of 15 Dec 2013 are being processed. When the children's priority date comes current in about another year or so then processing on the cases will continue.

    So this Approved cases does not mean anything? I'm concerning about the 20yrs old turning 21 in about 2 months. Will her case be fall under F2B after/over 21yrs old evem thought her case approved by USCIS (NOA2)?

    Got a text on June 23, 2015 that all 3 cases Approved for all of my mom-inlaw 3 children ages 20, 18, & 13. The Child with age 20, she will be 21 in Sept, is she going to be in F2B category or since Cases already Approved, she will still be F2a category even if her age passes the 21?

    Now, what is my mom inlaw next step? When can she call to NVC for Case # and IIN#?

    Which one is the best option. My parents are a GC permanent residents of US (IR5). They've been lving here for 3 months now. Their combine income meet with I-864P poverty guidelines for son/daughter sponsorship.

    In term of income, my dad made more but they will use both income (one as a co-signer) or else it will not meet with I-864P.

    1) Between my dad and mom, which one should file Partition for their son and daughter? Or who had more benefit between dad or mom?

    2) If dad or mom do the partition, do they need to attach their marriage certificate?

    3) Beside question #2, is this all they need:

    Mom or Dad Copy of birth certifcate (also translated)

    Chilren Copy of birth certifcate (also translated)

  9. Hi,

    Age is determined when the PD is current. Age at time of filing does not matter.

    The 22 years old will be in the F2b category (LPR petitioning unmarried child over 21). This will take 7-8 years for a visa.

    The 15 years old will be in the F2a category (LPR petitioning unmarried child under 21. This takes 2-3 years for a visa.

    The 19 years old will initially be in the F2a category. When he/she turns 21, he/she will age out into the F2b category. CSPA may be able to help. There is no way to know until the PD becomes current. It could be 2-3 years or 7-8 years depending on which category the petitioned will be processed as an F2a or as an F2b.

    I have a quesion about PD. I'm assuming PD mean Priority Date? What do you mean when PD become current? I saw some VJ member signature as Dec 01, 2013 I-130 sent. PD Dec 4, 2013. Is this the PD you are referring to?
