Doesn't sound like husband was evading taxes but simply didn't have the money to pay his tax and will pay his taxes plus penalty  as soon as the money is available.  To commit fraud you must have intent. If this lady was trying to pay her taxes and didn't understand the complicated tax code ,   no fraud.  Don’t have the time to read threats from the IRS.

  2. shouldn't be fraud since she will pay a higher tax as a single person than being married or married filling separately.   Sounds like she misunderstood the tax code and just wants to pay her taxes.   Don't know about paying the back taxes but maybe someone else can answer that for you.  

  3. I lived with my wife in Ho Chi Minh City when I filled the I-130 In September 2013. The process took us 353 days with no request for additional information, all documents were sent either overnight UPS or paid online using the internet. VisaJourney enabled us to complete the process without the aid of an attorney. We did asked an attorney in HO Chi Minh City one question and she gave us the wrong answer. We asked if USCIS needed a consent letter from my step daughter's father and were advised yes. As it turned out we did not need the consent letter until we were interview at the consulate after the USCIS process. The interview was courteous, professional and our pictures (some 200) were asked for. After the interview it took three days to receive the passports with the visa delivered to our home. Entering the US through Chicago took about one hour in the immigration office where the passports were stamped. Green cards arrived two and one half weeks after that. The one thing I want to emphases is no matter how well you think you are prepared and patient you think you are you will have times when you will be tried. Just take a breath, regain, and move one..   4. I sent an inquiry to the consulate in HCMC about getting necessary vaccinations for entry into the United States. The following is their reply"

    "Dear Sir/Madam, Thank you for your inquiry. After having completed the medical examination, applicants are required to receive vaccinations. Fees for vaccinations depend on your age and the required vaccinations. Bring all of your vaccination records with you to the Quarantine Service of HCMC at 40 Nguyen Van Troi Street, Phu Nhuan District, HCMC, Tel: (84-8) 3844-5306 to receive your vaccinations'

    Please contact our designated Panel Physicians for your issue.

    The Following is my understand of this email.. any comments?

    Thank you for your reply. So the way I understand this is we can get all the required vaccinations from FV hospital, then go to Quarantine Service with this record and they will not need to perform any further vaccinations. A simple yes or no would be appreciated. Sincerely

We turned in passport size photos of wife and daughter, original copy of the police report for my wife, sealed medical records from IOM, and the original consent letter for my step daughters from her father. I also had to provide a copy of my paid receipt for the processing fee for the NVC, It was missing in their file. I took a copy of my records just in case there was something missing and it paid off. Instructions on the documents needed for the interview was in the interview letter.

    If you are petitioning for a step child from Vietnam you must have a consent letter for the child to immigrate from the other parent, through the process we were never asked for this letter and the instructions never mentioned the letter until we went to the interview.

  6. Our interview day at the consulate began at 7:15 am. The line was not as long as I had expected and once we made it though security I estimated around 100-120 people were there for an immigrate visa. Once we received our number which took the better part of an hour we waited for around 40 minutes for our number to be called to submit our documents. The lady at the window was very pleasant with a nice smile which made us feel comfortable. After this we waited again but this time we waited for more than an hour for our number to be called for the interview. I walked up to the window with my wife and daughter where the gentleman doing the interview asked me if I was the petitioner. I said yes and he asked me to take a seat and if he needed me he would call me. My wife said she was asked about ten questions, were we met, what month we met, where did we go on our first date, did she know that I had been divorced, my son's name, where does he live, how old is he, does she speak English, what was I doing in Vietnam when we met and how many children does she have. The interview lasted for about 8 minutes. He also asked to see her pictures. Through the interview my wife said he spoke Vietnamese to her but that he was smiling and friendly. The only question asked of my daughter was her age. All and all it was a very pleasant experience. We were told our visas should arrive within two weeks. We left around 11:20 am.

My take on it: " please note that the interview is scheduled specifically to evaluate the beneficiary’s eligibility" this is a quote from the form email sent by the consulate in HCMC to answer this question. The beneficiary can be interviewed in English or Vietnamese. If you are confident your petition is solid, no red flags, in my opinion you do not need to be at the interview. I say this because you state that time off from the job and finances are difficult. Most K1 visa are approved in HCMC without the fiancé being present. Save your time and money for a trip to HCMC to get married and file an I-130 in case your petition is denied.

  8. I applied for my wife and step daughter together, they went through the California service center and both were approved on the same day and sent to the NVC on the same day. NVC approved my daughter one day before they approved my wife. Come time for the interview appointment NVC forgot to make an appointment for my wife so I had to request for an expedited appointment for my wife from the consulate. Fortunately they accepted the request. I would not sit on it and wait until they do something, I would start calling USCIS. From all the information I received the two cases were linked and should have been processed at the same time.

  9. I would not recommend waiting for the interview to prove your case. If you can't prove strong reasons for her to return to her home country when submitting the petition you will most likely get denied. In almost all cases the decision is made long before you get to the interview stage. Most non immigrant visa interviews last 2 minutes or less.

  10. My wife also speaks English fairly well but for her interview we are going to ask it be in Vietnamese. Working with her on the interview questions I found that although she knew the answer to the question she would give me the wrong answer because she misunderstood one word in the question. For us it is more important to give the right answer than impressing them with her ability to speak English. She and I communicate easily with each other and one of the reasons is I am from Kentucky where speaking slow is common. Good Luck...

  11. we were emailed the following letter...the letter was dated June 19th but I called the NVC on June 13 and they said our case had been completed on June 12, I believe interviews for the Philippines are scheduled much faster than for Vietnam. If everything goes as it should then the worst of the waiting is behind us.. stay positive.
