If you don't mind me asking, what proof did you provide in your packet to show you have seen each other in the last 2 years?

As for RFE , they asked about prove that we met each other during past 2 years.
When filing, I sent them copy of my work contract in her home country , train tickets from her home country for both of us, photos of us together and that's all.
In RFE they asked about passport stamps, boarding passes, itineraries to prove that I actually been there.
The problem is - when I entered her country I never kept any boarding passes, simply because I didn't know I would fall in love with someone and file for K1:)
So I sent them some itineraries that I had.
As for passport stamp- there was another problem.
I was born in her home country and still have their passport along with American one.
So when entering her home country, I used not an American passport.
So there was no passport and visa stamps.
Of course I sent copy of both passports, explaining the stamps in both, but I guess they just didn't get it.
Also we sent more pictures, letter from my father and boarding passes from our trip to Europe (but unfortunately it happened after we filed the petition).
So now I am choosing between marrying her right now and here and aos , and marrying her and file for cr1......

You can AOS. However, 2 very important questions:
1) Did she receive B2 BEFORE you applied for I129F
2) If she received B2 after, what did she answer for question "if she has anyone in US"
If she received B2 After I129 filing AND she lied on B2 application by saying she does not have anyone in US YOU will have a big problem. If not, you are fine.

She received her B2 long before we filed the petition, and even before we met:)

I see okay.In my point of view and also from all the data I found about your case.It is possible to have more trouble if you marry her in the USA before applying another visa application because she entered in the USA using the tourist visa while you are waiting for the result.So I think just to be safe and avoid more time delays it's best to Marry her in her country and then apply for a Cr-1..I hope everything goes well with your next attempt.

By the way, do you know- if I marry her now and file for aos , but lets say they deny it.
Can she still go back to her home country and can we file for cr1 visa after that ?

Can you also write why you got denied?The USCIS letter description of denial?So that everybody would see and know how to advice you in your situation.Thanks.
We haven't received the hard copy yet, yesterday got the email and site message.

LOL My bad I am relax. But well you got to think how it looks. She is here when you are denied and you get married and she stays. Sure you will probably be okay but well its not right. Just saying.

That's why I'm here - to consider all possible options and listen to some wise advise.
Right now I'm fed up with waiting and can't even think of another 8+ months of being apart( while waiting for cr1 visa if married in her country).

So your fiance' is willing and able and ready to forsake right now her home, and everything she left for the next at least year so you can get a I-130 petition approved.
I am sorry i just don't buy it. She what has no home, job, family to see or take care of? Really??
Think like immigration and stop this "she didn't intend when she crossed the border to stay". You are plotting and planning now. How is that not fraud in every sense of the word?

Once again - we filed for K1 visa.
Then after waiting for over 5 months she came here to Visit and wait for an approval together.
And yes, she has no job in her home country, as well as no money problems.

GaryBig, what I meant was relating to, if you marry her here in the US, an then adjust, they will find out, the best is to go to her country and marry her there then file for the spousal Visa , I realized time is an essence and everyone hate to wait, but if you wanted to do it right.

Fiance is already in the country and didn't enter with intent to immigrate on that visa, so I don't think it would be fraud as long as she planned to go back before you received the denial

She was planning to leave , but then we received an RFE, and she decided to stay a bit longer, and wait for our approval after RFE together.
And then... Denial.

They will find out your fiancee has intent to immigrate, due to the fact your petition was denied and recorded on file. Government scanned and kept all files electronically, one click of a mouse, and that's all it takes.
But when she entered the US on her tourist visa, she didn't have an intent to marry and stay!
That's why we filed for K1, we wanted to do everything legally!

Our petition was denied.
Apparently we couldn't prove that we has seen each other in past 2 years. Although we were living together in her country for half a year.
We got our denial decision while my fiancée is here in the us on her b2 tourist visa.
So my question is- can I marry her right now and here and file for an adjustment of status?
Thank you guys for help.
I'm so disappointed and sick and tired of it.

After they received our documents (for RFE ) we waited for 2 months and then the denial came.
And we sent plenty of pictures, but unfortunately it didn't work out:(
