    Straight answer: No. The conditions of the 3 yr filling is for you to still be married to the same US citizen both during the filling and by the time of the interview and submit documentation supporting that claim. You can’t file and then say you’re in divorce proceedings except under extenuating circumstances.

    If you choose to divorce soon, then go ahead, but wait for 5 yrs before filing the N-400. Note that even at that time you may be questioned about how genuine the marriage was so brace yourself for some scrutiny.

    I am sorry for your loss. No you don’t need to inform USCIS about his demise. Go ahead and read through the form and give the appropriate information about him where required. You are eligible on the basis of being a PR for more than 5 yrs (regardless of how you got it) and not on the basis of marriage which would have been required if your filed after 3 years. Good luck.

    Hi guys, have you called uscis? Dree 60 days after your RFE status changes to RFE response review, there ought to be some activity on your file. I know it doesn't always work but when mine went beyond the 60 days i called in. I got transfered to a tier 2 and i asked very nicely if anything could be done to speed up the process. I had school plans that needed my greencard in order for me to start. The tier 2 officer said she couldn't do anything but would make a general inquiry for me. I saw the inquiry update on my case status file and 11 days later my status changed to interview fixed for feb 4th.

    Pls call. It may help.

    Hi, I had my interview in Milwaukee last week and generally speaking it is not a difficult office. The fact that you were separated right at the beginning means your file was flagged as a potential fraud case. Is there a big age difference or educational difference? Are your careers glaringly different? All those put together may lead to a suspicion of marriage fraud. You will have to wait a few days to hear from them, that letter will let you know if there will be a potential 2nd interview, approval or denial. Hang in there.
