    Even if you get your 10 year green card I think they will look even closer at your situation at the N-400 interview.  I would consider meeting with an attorney to discuss your situation and be completely honest about everything.  They can guide you to what is best to do.  The next month is very important for you and I worry that you may be beyond a do it yourself site.  This of course is just my opinion, but what can one meeting with a good immigration attorney hurt?

Then in your RFE response I would provide (again) a written statement indicating their original error and that you filed an I-90 as a result of that, which included the erroneous green card in that package. I would include a copy of the tracking information for the original I-90 packet indicating it was delivered to them, as well as a copy of the I-90 NOA. This should suffice.

    Thanks for replying Hypnos. Yes, we have proof they received the I-90, but there is no way to actually prove that the GC was in the mailing. Only our cover letter stating it was included. They would not allow him to get a new GC without returning the incorrect one. Per I-90 directions:

    Item Number 2.d. My existing card has incorrect data because of Department of Homeland Security error. Select this reason if your card has incorrect data and the error was caused by DHS. Attach the original Permanent Resident Card issued with the incorrect data. A copy of the card is not acceptable in this case.

    They obviously had to have gotten the card because they sent him a new GC. We had a similar problem at his AOS interview. They said my husband never submitted his medical which he clearly did or he would not have been allowed into the country. They finally admitted that they had misplaced it, but we still needed to re-do his medical exam delaying his GC by months. At least we could do something about that. I can't make a GC appear that he no longer has.

  4. Hi. I'm looking to see if anyone has ever had this issue and how they dealt with it. My husband was originally sent a 10yr card instead of a 2yr card. We did the correct thing and returned the 10yr card along with the I-90 for USCIS to fix. He eventually received his 2 yr card (although it still has an incorrect expire date on it). We recently submitted the I-751 packet and received an RFE stating they have cashed our check and that our file is on hold until he returns his 10yr card. My husband doesn't have the GC as he was required to send it in with the I-90. We stated that fact in the I-751 paperwork that was sent to them. So what do we do now? Just send another statement saying it was already turned in? We can prove we mailed the I-90 packet and got the new card, but other than sending a copy of the I-90 cover letter stating the orig GC was included, we can't actually prove that they got the card.

    Yes, I am well aware of that. A UK citizen interviewing in London for a visit visa (if they aren't using VWP for some reason) will also probably not experience the same interview as a Pakistani citizen interviewing in London. I was trying to give her some insight on how the interview may go as there didn't seem to be any Pakistani's that were sharing info about recent interviews in London.

  6. My Pakistani MIL just received a 5 year visit visa to see my husband and I in the US. She interviewed in Islamabad and it was very easy. They had openings to interview starting a couple of days after she paid the fee. The interview took 5 minutes. They asked who was calling her to the US and asked about her other children. That was it and she was approved...took about a week after the interview to have passport/visa in hand. I am not sure how your mother's interview will go in the UK, but as long as she has strong ties there hopefully she can get approved. Congrats on your pregnancy. I hope your mother will be able to come visit you.

  7. Hi everyone,

    I am writing on behalf of a friend of ours. His wife has tried to kill him twice (Police reports both times). This last time had audio of her threatening to kill him with a knife (they live in a state where his taping her is admissible without her consent). And a video from outside their apartment complex which shows her attacking him with said knife. She was very drunk at the time and called the police herself to have him arrested. Once they arrived and obtained the audio/video, she was the one arrested and has subsequently been charged with a slew of charges including felony attempted murder. She was released on bail today so we are working to get him out of the state immediately. I just don't have the time right now to go through all the Vawa posts on here, which I'm sure give a wealth of info, so could someone please give me a quick rundown of what we need to get done asap? Obviously right now my main concern is getting him out of there to safety, get an order of protection (which I doubt will do much good as the woman obviously has some issues that a piece of paper isn't going to resolve), and start divorce proceedings. I would guess he will be eligible for Vawa, correct? Is it something we could help him file on his own or does he really need a lawyer? We're going to help him with the $$ for the divorce, but I don't think we'd have enough to help with a Vawa lawyer. He came here on a CR1 about 1 1/2 years ago and has a conditional card and it was a bonafide marriage. Any guidance would be much appreciated.

  8. I had trouble getting a visit a few of years ago to see my then fiance in Pakistan and I'm Muslim so I know it can be hard. Have you thought about Dubai or anywhere in the UAE? I think it is fairly easy for Pakistani's to travel there and it's pretty safe for Americans. As others have said, you need to overcome the doubts USCIS has about you as a couple. If you do marry in a 3rd country make sure to have his family there for the wedding and get lots of pics with them. I couldn't meet mymother in law since I couldn't get a visit visa, but I had pics with 2 of his sisters that live in Europe which I think may have helped. There are many people in Pakistan that accept other religions, but it's not the norm so showing pics with his family (especially the parents) show that they accept you and might help with the USCIS issue in the future. I see different things on the USCIS site, one referring to 90 days prior to his 2 yr residency, but the directions on the I-751 state 90 days before the card expires.

    Please close this topic. I was able to get good advice on another site and the same advice with USCIS (which I don't always trust). In case anyone reads this thread in the future here is what you should do:

    USCIS rule is that you must remove conditions before the end of your 2 yr residency ends, but not more than 90 days before. Usually the expiry date on your green card is exactly 2 years after the residency starts. In my husband's case they had the expire date wrong the 1st time. After we sent it back in to have it corrected they sent it back with another wrong date. The I-751 says to remove conditions no more than 90 days prior to expiration, but they are assuming USCIS put the right date on the card to begin with so this is not always correct. The law is that removal of conditions is based on the date you became an LPR, NOT necessarily the expiration date. We were told we can file up to 90 days before the date he became an LPR and to ignore the expire date. We were also told to to write a statement explaining why we were filing in 10/ instead of 5/17 so they would not reject the submission because they weren't paying attention to the Residency date.

  10. It would be best to contact USCIS via phone or meet with an immigration officer in person and ask how to proceed. If the issue date was 01/15/2015 then the expiry date should have been 01/15/2017 when they re-issued the correct 2 year GC card.

    We contacted them by phone and as usual, they were clueless. I guess we can try to set an infopass appointment. This agency has screwed up so many things on our file and cost us so much extra time and money I guess I just don't want to take another vacation day to sit there for 5 hrs to find out no one there knows what to do either.

  11. He is eligible to apply to have his conditions removed 90 days prior to 07/25/2017. That would be anywhere from 04/27/2017 to 07/25/2017.

    I am worried if we wait until then that they will say he is late in removing conditions as technically his 2 yrs would be up on 1/15/17. Technically he should be applying before 1/15/17. You don't think it will be a problem applying late?

  12. If your original card was issued on 01/15/2015 and the expiry was 01/15/2017, USCIS correctly issued you a 2 year GC card. Why did you return it? Where does the date 07/25/2017 come into play?

    Geez...I still got the dates wrong and I was looking at a copy of the original card. They originally sent a 10 yr card with a 2025 expiration date. They had us mail it back in so they could send the correct 2 yr card. When the 2 year card arrived it still had the 1/15/15 resident since date, but the expiration date changed to 7/25/15. Sorry...I've been fasting today and my mind clearly isn't as sharp as it usually is.

    My husband received his green card in Jan 2015. They sent him a 10yr card instead of the 2yr card so we had to send it back. They re-issued with the right card, but it has an expiry date of Mar 2015. We're planning on submitting paperwork to remove conditions in Oct 2016 (90 days shy of 2 yrs since approval). Will there be any problem doing that considering his GC shows a later expiration date?

  15. I am the petitioner(MALE), and I legally changed my name 30 years ago. On the I-129F where it asks, "other names used" do I have to put my birth name, when in fact my birth certificate and SS card reflects my new name. and I do not have anything in the old name?

    I thought that area only pertained to the petitioner(FEMALE).

    I also had a name change 20+ years ago. Use your current legal name, but I would suggest sending along a copy of the court docs showing the legal name change. I received an RFE asking for mine and it delayed our case by about a month.

  16. As long as you are only changing your name and not moving to a different state from where your current driver's license is from you shouldn't have to tell them you're on an I-94. For a name change just update it with SSA, wait a few days, and then most states will only ask for one of the following:

    • Marriage certificate or license.
    • Divorce decree.
    • Court order.
    • Citizenship or naturalization certificate.

    They should just update the license you already have with no change in expiry dates. My husband got his AZ ID card using a 10yr green card (didn't know how to drive yet). Once he passed his driver's test they didn't ask for any other info as they had already 'vetted' him for the ID card. They just issued the DL with the same expiry as the ID.

  17. In OP's case they are just starting the NVC stage. Their case file is still with NVC, not with any consulate yet.

    To OP, be proactive and call NVC soonish. It's just a typo error I think and should easily be addressed coz your file is still with them. Good luck.

    Yes. As I stated before, they assigned us to the wrong embassy. We were told we would have to ask the Embassy we wanted our file moved to for a change of location and it was up to that Embassy to make the decision if they would take it or not. NVC did not care that they screwed it up. We had to wait for the paperwork to get to London then request the change. I hope you are correct and NVC will change it for them, but they would not do it for us.

  18. We had the same issue, but they sent it to the London Embassy instead of the Islamabad Embassy. We had to request to move our case through the Islamabad Embassy via email. Once they approved the transfer they contacted the other Embassy to transfer the file. It was almost impossible to get a response from anyone at the Islamabad Embassy by phone or email as to whether they were approving the transfer or not, but about 2 months after our emailed request, we got a notice from them of the new file number starting with ISL

  19. Hi. My husband went through Abu Dhabi on Etihad last year. Everything went smoothly, but took almost 2 hours to get through security so leave enough time for your connecting flight. They also ended up losing all of his paperwork somewhere between Abu Dhabi and the US which caused my husband to have to get his medical exam done again in the US and delayed him getting his green card (he was on a k-1 visa) not to mention costing us a lot of extra money. That being said, I don't recall seeing others that have had major issues going through Abu Dhabi. Congrats on getting your visa!
