  1. We did a bad job with our first application to get conditional residence removed. Not surprisingly, we got a request for more information. I made an appointment and spoke to an immigration officer. He said that we should present enough evidence so that we get an interview. He said (paraphrasing) "You want to get to an interview. It is a good thing to get an interview".

     

    We resubmitted evidence out the wazoo -- probably close to 8 inches with everything we could find. Accompanied with a long cover letter. Within a week, we got the green card in the mail. We also got the Congratulations letter headed "Notice of Removal of Conditional Basis of Lawful Permanent Residence." We were pleasantly stunned. 

     

    Now my wife wants to travel overseas and I am big worry wart. I know that this is a silly question, but we just want to be totally sure: It is not a problem that we did not have an interview, correct? I mean the green card is just as valid as any other green card and she can travel overseas, right?

  2. I am wondering about CBP Form 3299. I (petitioner) and my wife (beneficiary) are flying into Miami next week. (My wife just got her visa approved!). Do we have to fill CBP Form 3299 at the airport? The reason I am asking is because CBP Form 3299 seems applicable only if one is not accompanying the the items being declared, for example, the the items are being sent by ship while we fly in by plane. It therefore seems to me that CBP Form 3299 will not be applicable when we fly into Miami?

    Is my interpretation correct? The reason I am worried about the CBP Form 3299 is because it asks for an itemized list of everything, but right now we are just packing and not itemizing anything!!

    If my interpretation is correct (that is, we do not have to fill CBP Form 3299), is Form 6059B the only form we will have to fill? I like Form 6059B because one has to list only gifts or things acquired by me overseas.

    Any light you can shed on this would be much appreciated. Thanks!

  3. I do not know who edits the sample forms on this site, but this sample form for the I-864 has incorrect information: http://www.visajourney.com/examples/INS-Form-I-864.pdf.

    For question 2.a through 2.h, it states the address of the sponsor instead of the principal immigrant (all other information I have found says that it is the address of the principal immigrant).

    In question 5, it also leave the impression that the principal immigrant already has an A-number (that may be the case only very occasionally).

  4. As another member said, yes, it'll have wording like that. But, as they also said, there's a preparer question. NVC understands that not all beneficiaries can fill the online forms out for themselves (either due to a language barrier or due to low/no internet connection [or even both!]), so like I said, it's fine to fill it out on their behalf.

    Not sure what is quoted here and what is not, but many thanks Saylin for your answer to an earlier question about who signs DS 260. Thanks!!

  5. I know that Saylin says that the U.S. citizen can fill DS-261 and and DS-260 in the States. But .... I am nervous about one issue: I looked at the old DS-3032 and DS 230 and I see that there are places where the Applicant (the beneficiary) has to sign. If I fill this these forms online in the U.S. for my wife (who is in Pakistan), will I get to a point that says something like: "By submitting this form you are attaching an electronic signature" (or some similar wording).

    Does anyone know if I actually get to a point like this in the online versions of the form? If this is the case, would I not be forging my wife's signature electronically if I fill out DS 261 and DS-260?

    Maybe I am being too nervous about this, but I would appreciate knowing how you all dealt with this issue.

    I just wanted to take a moment to say thanks to everyone who ever helped me on VJ. My husband had his interview 2 days ago and it went well. The officer told him that he will be getting the visa in a week.

    I JUST WANTED TO SAY THHAANNKKK YYYOOUUU and I pray that everyone is reunited with their loved ones soon. dancin5hr.gif

    Congratulations mbanner!! Certainly good news and glad to see a male not get an AP. I want to ask a question. My apologies if you explained before, but I tried going through your posts but could not find an answer. My question: Why was your case sent back to USCIS for further review?

  7. Both of my applications are shipped to Department of state for visa processing. That "reopened" message was indeed an error then. Happy hump day to all.

    Here is my information to add to the tracking sheet. I have one spouse and one childeren i130 both have same PD and transfer dates.

  8. I see a few posts above that say that if your spouse is abroad (and for our purposes not a green card holder or citizen of the U.S.), then one one should file as "Married filing separately". I do not think that you have to file this way. I think that as long as you are married, you can file as "Married filing jointly". This would of course require a ITTN.

    I am not sure -- just my opinion. I will be trying to find out more about this before filing taxes.

    I would like to file as "Married filing jointly" because it meas a better tax refund! In fact, if you wife has income abroad and paid taxes on that income, there is even a better tax refund.

  9. My 1-130 got approved! My husband received a text message but nothing from email yet. I checked the website and yet i got approved smile.png this is one of my best mornings! I was totally surprised, was just praying for it last night and i had no idea it would come today. Sooo happy!

  11. Finally! Got NOA2 today!! Last week was full of tears of frustration - today is of happiness and relief! I know it is still a long process from here...but I am unbelievably relieved to go to the next step.

  12. I am trying to file a service request online. However, when I get to this point I am not sure which to select.

    Does anyone know what I should select at this point?

    I am trying to file a service request to simply get an update on my case. PD April 4th, transferred to NSC on November 15th and now sitting there!

  13. I actually thought that a lawsuit was not a bad idea. Not because we would win. As many of you pointed out, we will probably lose. But, to me, it is the message and publicity that matter. I think that our pressure so far has helped. A little more pressure from a different angle will help even more.

    (We only now need to find a lawyer who will do it for free for ..... or who thinks that putting "sued the American government to protect the rights of citizens" on his/her resume will help with future business).

    Well .... 6 out of 10 were for spouses from the Philippines and of those more than half (or 3/4; too frustrated to look at the numbers too closely) filed in May or afterwards. Good for those from the Philippines but no fun for me.
