  1. I haven't had a job in the last two years either but I am still on many things and have access to everything including joint credit cards etc. We just sent our package in on Monday. I think the only thing I am not on is the mortgage because I moved in to the condo. But we know when we move and we pick a place that is "ours" I will be put on the mortgage or lease or whatever we decide to do at that point. But this was a personal decision for me and us.

    I think writing a letter would help but I think showing you still have access to these things like a joint bank account is better. Hope this helps and good luck.

    Yes, this helps a lot. Thanks for the response. We have a lot of joint documents except the savings and checking accounts. I will put all that in and see what happens.

    I just don't think it will be a good idea running up and about the bank now trying to get joint accounts just to prove a point to USCIS.

    I don't know if the lack of a joint account would be a problem but I do know by having one shows commitment to each other and it shows trust. When my wife arrived from Kenya. I placed her on my checking and saving account within the first month and we never received a RFE during the entire process. I would rather be safe than sorry later. One joint account that's in use would be better than sending a letter as to why you don't have a joint account. You guys could keep your separate accounts and have a single joint one. We only have the joint and we put money in and take it out. I pay all the bills while she handles the smaller things like shoe and clothes buying (as in she loves to shop) and highway toll charges which I always forget to pay.

  2. The write to avoid RFE is to write a letter explaining why. this way, they cannot ask for a RFE regarding that matter because they saw you thought about it, and could not provide it for X particular reason.

    That is what I did for my package, I do not have a joint account with activity, we will see what happen

  3. Mingling finances is not just about pooling your money into one pot, it is about you having access

    to your spouse's bank account even though you are not working, you can have one joint bank account which you BOTH use.

    Go over the list in the ROC guide and see what else you can come up with that you may not be thinking of to submit.

    I know that we can have one account, but we do not. It works for us that way, at least for now. I wanted to hear from people who have not had the same account and how they went about it, thanks though.

  4. Well, I had no income either for the most part of the 2 years either. But I was on my partner's saving and checking account.

    one may question: if you haven't had a stable job, then how could you have survived?

    Did you have access to your husband's money? Joint credit card only for emergencies? Then how did you spend money then?

    I survived because I have had jobs here and there and a checking account of my own, though it wasn't much. My husband takes care of the bigger bills like rent and so on. I take care of car payments and groceries with my salary, thats how we agreed. If theres anything we needed to pool money together for, I would do a transfer to his account and vice versa.

    Now, my situation may not be ideal according to you, but I would like to hear from someone who has been in the same situation.

    My husband (USC) and I (green card holder) are in the process of removal of conditions on our 2 year green cards I-751. We have not mingled our finances much because I have not had a stable job in the last few months. We only share a joint credit card which we signed up for in cases of emergencies, but have never used it.


    We however have lease agreements with both our names, utility bills, vehicle and medial insurances. Should we include an excerpt with our application, explaining to USCIS why we do not have joint bank accounts to show financial co-mingling, just in case they want to send as an RFE?

    Will the lack of shared savings and checking bank accounts pose any problems to us?

    I am filing to remove conditions on our green cards (my daughter and I). We both received our green cards within 30 days of each other, so I will be filing her petition together with mine. Please advice if i should fill in just one form I-751 and include her under 'children'. Or should i fill in a separate form I-751 for each one of us and send the two forms in the same packet?

    I apologize if this has been discussed elsewhere, I wasn't able to pull out tangible information on it.

  7. Hi Sjandsj,

    I posted a similar case on the forum a couple of weeks ago. I am having the same issue with my green card. The 90 day window period for ROC is open but my green card doesn't expire until some time next year. This is because the original ones were not delivered by the post office and we had to re-apply for re-issuance. When the new ones came, they had a different date on them, giving us almost an extra year of validity. The impression i got from the forum was that it was a mistake on USCIS side. So, I am seeking to make an Infopass appointment to clarify everything. Please keep me posted if you come up with any solid answers. I will keep you posted too.

    I recently received a letter from USCIS reminding me that its about time i applied for my ROC on my conditional residency. I was initially approved for the 2 year conditional residency in August 2014. After the approval, we waited for our daughter and I's green cards to arrive in the mail to no avail. After much following up with UPS and sending in another application with a fee waiver that was denied, we finally sent in the documents, with full payment (2nd time), had a second set of biometrics and got the green cards in August 2015. The validity date on the green cards is up to August 2017.

    Having received a reminder form USCIS recently that i should remove the conditions following the near 2 year anniversary of our initial approval, what should i do? Will my green card be technically invalid even though the validity period has not reached. Will i be out of status if i do not apply to remove conditions within this time? The thing is, I would gladly send in the ROC packet with the ~1200$ (for my daughter and I) but finances are a little too tight. Anybody been in a situation like this?

    What would you advise me to do?

  9. I have used IAH a couple of times myself. The first few times with my tourist visa and then my K-1.

    With my B1 it took about 30 mins processing at the booth, including waiting in the line and going through customs.

    When I used my K1 visa, it was a different story. Had to wait in line to get to the booths, then we were taken into the DHS waiting rooms where we sat waiting for more than 3 hrs. Some people had been waiting longer, and had missed their connecting flights. There was no harassment whatsoever, it just takes a freaking long time.

    I applied for a B2 visa while my K1/k2 application was pending at the USCIS.

    I had applied through my company because i was going to represent the company at a conference in Las Vegas. I duly noted in the application that i had a pending immigrant case with USCIS (They never made reference to it at the interview).

    MY ties were of course my stable job and i had a child under my care, whose K2 was also pending. I had also received other B1B2 visas in the past and had never overstayed. So probably this worked to my advantage.

    I would say give it a try, but like everyone else says, make sure you can prove strong ties back in Kenya.

    Its 265$. I remember encountering the same when I submitted my forms. The 300 is for immigrant visas, for which K-1 is somehow not considered so at this time.

    As for the medicals, you can have vaccines at other government approved facilities and bring the records with you to IOM. The panel will then decide what you need and what you might not.

    Thank you very much for your responses. We had out interview today at the Houston office.

    We decided to go with the little evidence of co-mingling that we had accumulated. Honestly, it was close to non at all and we had tried to get a joint credit card which did not come in the mail.

    All in all, we went in time and were interviewed with a very kind lady. She asked me questions on the AOS form and i answered on the affirmative. Asked for our government issued IDs, when i last came into the country, if i had left the country since my last entry and our address.

    After almost 10 minutes of conversation, she asked us to wait at the reception as she needed to review all our documentation once more. All this time, she never asked to see any evidence of co-mingling.

    We waited another 30 minutes and she came back to let us know that she had approved our case for the 2 year conditional green card. That was easier than we expected!! :-).

    We recently received our notice to appear for the AOS interview in 2 weeks time. W e are adjusting from K1 and K2.

    So we have been married for 4 months now. Our interview notice came just 2.5 months after the application, and i am grateful.

    But looking at the requirements, we feel a little insufficient.

    So we do not have the 'traditional' joint bank accounts, utility bills, car insurance etc under both names. I just received my EAD in the mail a few days ago and still looking for work. Husband has been taking care of all bills from his checking account, and i thank God for him. We were sort of waiting for when i can start working and then we can start sharing the bills. I have read here widely on the kind of questions asked at the interview and we feel that we have no problems with what we might be asked about our lives together. Its the 'other documents' that are giving us some gray areas.

    This is a list of what we have, please review and advice on what we may do to certify the IO:

    -Lease agreement (We added my name to this recently).

    -Family medical cover (From his work)

    -Family Y membership

    -Pictures from everyday and trips we have taken together

    -Mails from my daughters school (listing both of us as parents)

    -Cards from each other on various occasions (and from family too)

    -Future vacation trips booked and paid for the 3 of us.

  14. You have to get married to your petitioner before September 13 in order to apply for adjustment of status. That was the stipulation of getting a K-1 visa - you MUST get married within 90 days to adjust status off of the K-1.

    So, step one is to get married to your petitioner (I'm assuming you're the beneficiary).

    The OP clearly stated that they got married to their petitioner soon after arrival.

  15. OP, as long as your parents have entered the US legally, they can travel pretty much anywhere within the United States without any worries. They can go to Vegas and have all the fun they want.

    A language barrier should not be a problem at the POE. I remember I had to assist an old lady who was travelling on the same plane and could not read nor write. The immigration officer asked if I could help her fill her forms and it was ok. So don't worry, they will be fine.
