This is not simply a petition being processed and
you want to chance a trip because you have a valid
tourist visa. YOU ARE IN AP your country get torrid
security screenings, why would you think it is OK to
come to the US during "Administrative processing"
even though the embassy did not advise you not to?
Why would you think its NOT ok?? if you have something valuable to add please post it and if not then please don't
Hey haboosh,
I know youre well aware of my husband's long AP and details
We have experience when it comes to this-everyone's experience and therefore advice will vary but I can tell you from first hand experience that in our case it was impossible to prove that my husband has no intent to stay. Initially before I had petitioned for him on his first trip back to the US after we were married, he came into POE like he normally had in the past. after few hours, they denied him entry. I spoke with Border control supervisor and she explained that although I had a ticket to return with my husband and we say we have no intent for him to stay on his business visa, she isnt convinced. She said he is now married to a US citizen whereas in the past we were only engaged so now he would have a higher intent to stay. That doesnt make sense to me personally because w would never risk that knowing that I will petition him in the future but he was turned back. So although you say they're 2 different visas and not connected, on the contrary-they're very connected once youre married to US citizen. The consular officer explained it to my husband later on in the process saying that once you married, that shows even higher intent to immigrate obviously. So more than likely at the airport, the officer will not be convinced and turn you right back around on the next plane. However, Im only speaking from our end of the experience; I have read here on VJ stories of couples who did the same and the alien spouse was allowed in with no issues even after their petition was pending. So it all depends on your luck with the officer at POE, the consular said thats all it comes down to most of the time. It isnt illegal to try, but be aware as another poster was informing you: it does affect the case somewhat. If you are denied entry, later on in the immigration process, the consular section will request records of that denial from the Border control responsible for the airports. This may very well take months, even years to extract from them and therefore lengthens your Ap process. Consular section wont issue visa without first seeing this record as to what happened that day and details of why you were turned away. Sorry post is so long but I like to arm people with as much as real knowledge as possible to save people the headache of assuming.
Thanks Lulu, this is the best answer

What can you show the CBP that will indicate that you MUST return to your home country? You have strong immigrant intent and it may look like you are trying to simply get to the USA because your immigrant visa is taking too long. What can you show to indicate that this is not the case? it must be strong ties.
good luck
PS - I wouldn't risk it. Clearly they are checking on stuff, adding an additional element to your case is, in my opinion, silly.
Thanks, I think i will not take the risk, as you have mentioned it could be silly.

Round trip tickets, letter of employment and bank statement, do you think this will be enough? I applied for immigration in Nov 2010, at that time the visa visa was already stamped on my passport.
-
you not yet hold an immigrant visa, as
it's not been ISSUED yet. Technically, you still hold the tourist visa until the immigrant visa is issued.
where is your passport? in your hand? at mom's house? at the embassy? where?
My passport is with me, not in my mom's house and of course not in your mom's house and also not in the embassy
-
But you have a visa?
yes I have, but I am trying to show you that there is no link between the 2 visas.
-
Firstly like I said nobody really knows, the speculation is that you are in the check process which takes a certain amount of time and by visiting you add another element which adds time.
I read a lot trying to find anything related to this matter but the only thing i found was on the Frequently Asked Questions(official embassy website) :
Can I apply for a tourist visa if I have already applied for an immigrant visa?
Yes. You are eligible to apply for a tourist visa if you have a pending immigrant visa, but you are not allowed to hold both at the same time. If a family member has applied for an Immigrant Visa for you and you would like to travel shortly for tourism, you may apply for an NIV but in order to qualify you must be able to demonstrate strong ties to your host country.

They will have something else to check.
Check what? and when? do you mean upon arrival at the airport? Boiler you always post better responses here
-
The consensus seems to be that it would further delay AP.
Boiler , please give me more details. why it would delay AP?

No, another poster did and got a misrep upon interview with
the CO giving him 221G to file a I601...took 7 mths for his
approval, every case is different & CO, but its not a chance to take
My interview was before 10 months and CO was informed about my visit visa on my passport. If there is a problem then why I was not informed by CO not to use it or why they did not cancel it? The interview was in the same embassy that issued my visit visa.
-
I guess it depends on where yer passport is.
Since the immigrant visa isn't issued yet,
and there's already a tourist visa glued inside of your passport,
I have to think the tourist visa has not be invalidated, yet.
USUALLY the tourist visa is invalidated by the IV Unit when the immigrant visa is issued.
Where's yer passport?
[note I'm saying 'maybe' here. I could, of course, be dead wrong]
My passport is from Jordan, and my visit visa is valid till end of 2015, the immidrant visa is not issued yet and the CO asked me about my visa during my interview.

I have a valid visit visa to USA but on the same time I have an immigrant visa under administrative processing,Can I visit USA on my tourist visa?? Please help

yup I know you can't see what I sent in private, but you can see my reply above where I told him I sent it. They don't need to get it through a foreign embassy, she has been living in Amman for a year.
Then bravo you got the answer first , don't take it personal
-
I already sent him this info with the address. It takes 2 weeks to receive it after applying for it
By the way i can't see what you sent in a private message, and FYI they have mentioned " There are no procedures to obtain these certificates through Jordanian embassies in foreign countries" but i got it through the embassy.
-
I have submitted "Certificate of Non Criminal Record from Ministry of Justice " but the embassy refused that one and sent me an email about what should be done.
Please read below on how to process Jordanian police clearance.
Police Records
Available to resident Jordanian citizens and foreigners. The General Intelligence Directorate (GID) is responsible for issuing good conduct certificates. They are considered to be reliable, but cover primarily security-related records, i.e. not necessarily criminal information. These certificates must be applied for in person at the local GID office, and are valid for one year. It takes up to two weeks to obtain the certificate from the GID. Foreigners must reside continuously in Jordan for six months before the GID will issue a certificate. There are no procedures to obtain these certificates through Jordanian embassies in foreign countries.
its clearly mentioned that "Jordanian citizens and foreigners" so i don't think you should face any problems issuing this certificate.
Other than this; I am Jordanian living in Kuwait so the same happened to me when i tried to issue a Police Clearance Certificate from Kuwait and they have asked for a letter from the embassy, I sent an email to the embassy and received that letter, so maybe it's the same case with you, better to send an email to the US embassy in Jordan so they may give you a letter.
Hope this is helpful for you. Good luck

What you really need to understand now is that if the other woman(ur ex's wife) find out how you have been stucking her marriage, you will get charged, and everything would be use against u in the court of law.
Your ex can still deny all the allegation and the uscis are not stupid, they understand how impatient women can be so jealous and try to rope their husbands. USCIS has nothing to do with your ex concealed previous marriage in Russia. They would throw it out of the window because even Obama would not sponsor them to go verify ur prove in Russia.
The innocent woman that u called Obese can do everything to make the USCIS believe that all your allegation are false and out of jealousy............I am speaking from experienced... Your ex would definitely get approved again.....
*Repent and stop being noisy and move on with your life*

It has been 7 months under ap now .. still going .. no luck yet ..
I have completed 9 months in AP, no worries one day we will finish this process

Hi Haboosh,
I heard from the Senators office. They responded with a letter stating that they wished they could help but that the case was still in processing and that the DOS could not give them a time frame and that AP cannot be expidited. They also enclosed the reply that they got from the DOS. It is nothing new. In fact I have read it on this forum before.
I emailed and left a voice mail with the embassy over a month ago and have not gotten a responce to either. Our case updated, but only because (I asume) they read my email. I emailed them again a few days ago. Still nothing.
Ill keep you updated.
How about you? your in Kuwait also right?
Hi naye4lynn, any update on your case? I am still in AP
-
Yes. Still in AP. Have not heard any news from the embassy. I asked them for a status update and its been over 2 weeks and no reply. :-(
Please keep us updated, have you finished the AP?
-
I think you are the wife and trying to be clever to find a way for your EX not to come back, this is a Visa process website not a social problem solving website.
-
A UPDATE: We will be going to our K-1 Visa interview Tuesday 29th Oct. I asked them how many years of 1040's they would like, 3 years WAS the reply.
Hi, any update after your interview?
-
Yes. Still in AP. Have not heard any news from the embassy. I asked them for a status update and its been over 2 weeks and no reply. :-(
Are you still in AP, I am stuck for the last 10 months now
-
Hi Yhana, I am sorry for this situation but if you are seeking for help here i think you have to change the subject, your case is not a matter of being in the AP for 7 months.
