It appears they did not decide that on their own. It was she who made the decision for them, by leaving the country and taking up residence in the US. The very fact she is here waiting for her greencard is enough evidence she has no plans to reside in Australia anytime soon.
It may not seem fair but they are not off the mark on this one when you actually look at it from the outside.
So you are not allowed to have dual citizenship anymore ? I thought you can still have US and Australian citizenship.

Hi guys,While we couldn’t be happier that we have been together since last six months, we have run into a situation with my wife's Australian Citizenship. So I just wanted to share our story and see if anyone else has also run into this with Australia. To give a little background, my wife is currently an Australian resident and she had applied for the Australian Citizenship last year and had given the exam and passed in September. All she had left to do was to attend the ceremony but she had to travel to India for family emergency in October 2013. Then she came to states in December and we got married here. She hasn’t since returned to Australia but was planning to return as soon as she got her travel authorization from USCIS. We were communicating with Australian Citizenship and were trying to request that she is allowed to attend the ceremony in states since she still didn't have her travel authorization and unfortunately it back fired on us. The Australian Citizenship came back to us and said she has been out of country since October and she no longer has any close association with the country so they will cancel her citizenship approval. So then we responded back with some information that they had requested to prove the close association (i.e. immediate family residing in Australia, tax transcripts from last year and intended travel as soon as she has her approval from USCIS). And after all that they came back and said weighing all the information that was provided to them, they have decided to cancel the citizenship because it still doesn't prove that she will be coming to Australia anytime soon and will be residing there.This ticked us off because it has only been 7 months and she has 12 months to attend the ceremony and to take an oath. How can they just decide on their own that she won’t be returning to Australia or will not reside in Australia in future. We are so disappointed and now wondering what should we do.

You are filing for AOS from a K1 visa so it is Chicago regardless of where you are filing from.
Both advise to send it to chicago. http://www.uscis.gov/i-485-addresses k-1 falls in the first category.
+3 for Chicago on a K1 AOS.
Chicago Lock Box is a good choice.
My husband and I are living in the DC Metro area and we have just sent our AOS to the Chicago lockbox yesterday.
For the Form I-693, we went to a civil surgeon: page 1 and 5 are in a sealed envelope in our Package (don't forget to sign it with the civil surgeon). We also submitted a copy of the DS3025.

Chicago, I sent mine there in Nov and it's going through, I have EAD and AP through. You should not need another medical, hers is still good and it should be in the package she handed over at POE.

I am sure this has been asked numerous times and also it is mentioned in the guide as well as on USCIS site but I am still confused about where should I send my application.
On VJ, it says that I485 should go to Chicago lockbox (http://www.visajourney.com/content/k1k3aos) but on USCIS page it states that it should be going to Dallas lockbox (http://www.uscis.gov/i-485).
Has anyone recently filed I485 from DC Metro area? Where did you guys send your application to? Did USCIS receive your package?
Also, I had a question about I693 form. My wife had her medical done in Sydney in September 2013 and we are wondering if we need to fill out I693 form or not. She handed over the brown/yello package to CBP when she first entered states. Do we still need to get medical done again?

It IS 6 months validity, ALWAYS. The only exception is if your medical will expire in less than 6 months so the visa is only valid until the medical expiration date.

I have often read that once the visa is approved, the beneficiary has 6 months from the date visa is issued to enter the US. Since you just got your visa approved very recently at Sydney, I was wondering if you could share what is the validity of your visa? Do you have 6 months to enter US? Just asking out of curiosity.

Yes, you pay the visa fee to the Australia Post. You print out the deposit slip here: http://www.ustraveldocs.com/au/Fee240.pdf and take it to the post office to pay and bring the receipt from the post office to the consulate.
Oh, and because you are a K1 applicant, you don't have to go to the website and do anything afterwards, even though the deposit slip says otherwise. That pertains to other visas- if you go to the website, you can't even find the K1 on there and it is totally confusing.

Thank you for the response. Yes, I did come across couple of other posts on VJ that we don't need to create a profile and when you go to the traveldocs website you can just click on the deposit slip link and print it out. I saw your timeline, you guys were recently approved. Congrats !!

Hi All,
its been such a loooong wait but finally have my interview date for this Tuesday!! yay!!...and now I am a bit nervous...what do I have to take with me, the letter I received just said bring passport and envelope for sendingj passport back, I know I have to take two visa sized photos as well but what else??? any help
would be great!
My Fiancee also has the interview next Tuesday (3rd Sept.).
The list we received mentioned the following:
Form DS156 - My fiancee mentioned that she went back and checked all the documents and the one she sent didn't have the barcode, so may be that's why they asked for it again
Passport
Visa Fee
Envelope to return documents
So I am assuming everything we have sent until now may have been correct.
We are still little confused about the visa fees that needs to be paid. The document they sent mentions that you have to print a deposit slip to Take it to Australia Post and bring the receipt of payment to interview. So does this means that the fees must be paid in the name of Australia Post because the documents says it is not payable to Consulate?

The Sydney doctor always sends it directly to the consulate. You won't be able to include the medical exam results in Packet 3. I would suggest sending Packet 3 now with a note stating the medical results are being sent directly to the consulate. The consulate people are used to this as everyone who has their medical in Sydney are in the same situation.

Hi guys,
I just wanted to see if anyone else has gone through the same situation.
My Fiancee is preparing packet 3 and the check list for DSL-1076 mentions "Medical records - originals only" and the problem is that her medical is scheduled for this Friday in Sydney. She wants to send out the packet 3 but is now confused if she should or not without the medical records. The doctor's office where she has medical scheduled advised her that she doesn't have to have medical records with her for her interview which comes of course after packet 3 is received by the consulate and also that the medical results are sent from doctor's office to directly to consulate. We are in a dilemma what should we do? Should we wait for the medical results and then send it with packet 3 or should we go ahead and send packet 3 without the medical and hope that the consulate receives that in time? I would appreciate any suggestion/recommendation you may have.

I don't have a printer; so, I want to fill out the forms and save them to be printed later, but I can NOT save them.
Example DS 156k: I have downloaded and when I open it, I get a message at the top "Click sign to fill out and sign this form. When you are done, you can save a copy by clicking "Done Signing".
I have click Sign, but can't find where the "Done Signing" is to click. I have also tried many other ways to save the form after filling it in, but wasn't able to.
I have seen where it says to Save a copy, but when I click it, I get a message that Adobe Reader can only save a blank copy.
Any suggestions?

If none of the suggestions offered by other members work, try updating the Adobe Reader to 11.0.3. This recently happened to my Fiancee and I had to ask her to do the same which then let her save the form in PDF. hope this helps.

Yes, the paystubs can be sent after getting the packet 3 since they can just be scanned and e-mailed and don't need to be signed. But I-134 needs to be with original signature so just make sure you receive that as soon as possible to send it with packet 3. Good luck !!

Can my fiancé email the pay stubs once we get an interview date since they want the most recent ones? They aren't signed or anything.
I believe the 1-134 and supporting documents (paystubs being one of them) would need to be submitted together before the interview. Please refer to the original instructions for Packet 3.

Thanks guys.. I guess just to be on the safe side I will include 2 copies, one with the regular short signature and the other one with full name. They can use whichever they want. At least that way the process won't be delayed. Thanks again for all your help !!

Where does it state to sign in your full name? I cannot find that in the instructions. The instructions simply say it will be rejected if not signed. Sign with your normal signature that you use on everything else you sign.
The other box is not an option. They want you to do as it says and type your full name in that box as an acknowledgement that you have read page 2, Sponsor and Alien Liability. That is something separate from where you sign and date the form.
Under the "Execution of Affidavit" it says the I-134 must be signed in your full name. That is what got me confused.

Hi guys,
I was going through the I-134 instructions and wanted to clarify something. The instructions for this form state that the form must be signed in your full name. Does it mean I have to write out my name with my middle name and last name in signature space? or just sign it the way i normally would sign something with a short signature? I do see that there is an option to put your name at the bottom where you acknowledge the liability statement but just wanted to confirm before we submit it.

It is a visa for ENTRY to the United States, it is not a visa for EXIT of Australia. Doesn't matter where she enters from, or when, as long as it's during the visa validity period (which is 6 months max, can be less depending on medical expiration).
I advise entering before the visa is close to expiring. Though it shouldn't matter, I have read of an instance or two where the CBP officers screw up the entry stamp thinking you're supposed to have at least 90 days left on the visa before entering, or that you have to get married before the visa expires (it's the I-94 expiry) etc etc.

Thanks A&B. I did read that the visa can be valid for maximum of six months. I will do some more surfing around and see if I can find out the answer for travelling from a different country, although nothing specific has been mentioned on there. Thanks again.

Hi fellow VJ members,
I had couple of questions:
1. My Fiancee lives in Australia, she will have her interview in Sydney. Once approved, how long does she have to get to US? I have often heard that once issued, Fiancee visa has 6 months validity. Is this something mentioned on USCIS or Travel website? Of course we can always check how long is it valid for once she gets her passport with visa stamp on it but just wanted to know beforehand if possible.
2. Once the visa is issued, she wants to go and spend some time with her family in India before she permanently moves to US. Would this be a problem that after getting her Fiancee visa in Australia, she lives in India for couple of months and then she comes to the States.
If anyone can give this information, would greatly appreciate it.

You do not need W2 if you're sending the official tax transcripts. You only need the W2 if you're sending your own tax return forms. Tax transcripts are proof of what you sent to the IRS (how much you made), W2 are proof of how much you made, your own tax forms aren't proof of anything by themselves as you can write anything in there.

The sputum test is for TB. When she went for medical they take ex-ray and they saw scar in the lungs now she has to go back to the medical clinic 3 days in row to give sample of what she coughs up. They then grow the culture for 2 months to to see if TB grows. If positive for TB then it is 6 month treatment after that, if negative then she can go for Embassy interview. So it is Minimum of like 2-3 more months.
I strongly suggest that you get your prospective spouse to have a medical exam very early on in this process and test specifically for TB so you can deal with it early on!!!
So sorry to hear this. It is the last thing you want especially after waiting this long to be with her. I sincerely hope she tests negative and you guys can be together ASAP. Good luck !!
