  1. Called again today. The police report is not an issue. But, found out some not so good news.

    They reviewed my AOS-

    i need to resubmit my I-864 because something wasn't in black ink. Thinking back, my printer was running out of black ink at the time.

    I need to resubmit my stepmother's I-864A because one field wasn't filled in as N/A.

    I am once again so angry and upset. I can't believe this stupid mistake costs us an extra month!

    If you don't mind, what field in i-864A wasn't filled as N/A.

    I do not want you to get your hope up and stay level minded...

    For a petition filed in the US.. After the I-130 is approved it does not go to the embassy.. It goes to the NVC.. Your filing for expedite at NBC which is only for the I-130.. The NVC will require another expedite request to be approved.. Then if that is approved all goes to the embassy..

    For petitions filed abroad? Maybe someone has experience in this that can explain the process they went through..

    I don't think it's true. If you send an expedite request to NVC, it is actually approved by the consulate and then NVC stage is skipped, and you bring all the documents to the embassy for interview.

  3. On a side note, I think it is a good thing that there is an NVC stage that verifies all the documents. I remember 14 years before for my own immigration (there were no NVC doc intake at the time; you bring all documents to the interview), our family of 5 had to travel 4-5 times to a city 12 hrs away by train. Each time there will be something missing or incorrect. It wasn't fun. Compared to those times, I think the immigration process is better now. Once all consulates are EP, we are looking at a super convenient process.

    Being said that, if it is something you can comply with reasonable resources, just do it. You won't win the govt process by rationale.

  4. hello i came to usa with j-1 and i was out of status for 2yrs , i have migration court to attend on feb but i was married with usc on this yrs sept and i file for I-130 on oct 20 im just wait for approve of I-130 , first time i get to the court i told the just im married and i file for i -130 and judge told me to come on fer 2014 with my receipt , i was have 2 question how long for I -130 TO BE APPROVE and can i apply for work permit while i wait for i-130 be approve

  5. I am the petitioner however, I was under the impression that we both have to be there during the interview. Collect me if I'm wrong.

    In normal situation no, only beneficiary has the interview abroad. But I remember reading somewhere, that either DR or Jamaica needs the petitioner as well present at the consulate. Not sure if it is for K-1 or IR-1 visa. Start a separate thread or check DR or Jamaica forum.

  6. This is my first time posting. My priority day is 05/14/2013. It's going on 6 months Nov 14 since Chicago lockbox received my I130. I need answers ASAP. I am 25 weeks pregnant and I am a USC and live in NY. My husband lives in Dominican Republic. if my I130 gets approve, I won't be able to travel after my 29 weeks.. I'm due Feb 24th 2014 and this is freaking me out. My question to u guys is, if they call us for the interview during that time, can I attend an interview here in NY while my husband attends his in DR. I really don't want to postpone the interview. PLEASE HELP!!!

    Why do you need interview? You are the petitioner, correct?

    I have a question.. I was just told by someone who went through the K1 visa process that if my husband has paid enough SS credits, we won't need to file I-864. can anyone confirm this? Isn't the I-864 Just part of the process??

    It's not for your husband, it for you.

    If you (the intending immigrant) had worked enough to earn (not paid) Social security credits, then you don't need I-864 filled out on behalf of you. Please look at page 2 of i-864 instructions.

    I believe that situation typically applies for someone who is already in the US and is undergoing adjustment of status.

  8. Unfortunately, we are living at my parents house so we don't have a lease etc.

    While we do pay rent, I don't get receipts - I'm going to have to look into getting these.

    We are sending 21 pages in total (with out photographs)

    My husband has been living here with me for the past 1.5 years and hasn't filed a tax return in 2/3 years.

    He hasn't worked while living here, will this be a problem? sad.png

    One is supposed to file returns even while working outside. However if you make below a limit ( ~$8000) for single you don't owe any tax and hence no need to file. Therefore, in his case I think, the second might apply. While filing i-864, he will need to explain why he didn't file the returns.

  9. Don't print all the logs. Use sampling depending on the duration of your relationship. In my case from meeting my wife to 130 filing was about 3 years, so I took screen shot of skype chats/calls during the initial time (1 sheet), then another screen shot for the time of our engagement, next one between engagement and wedding and then at every six month interval. This will be enough and it shows the constant connection rather than just one or two. In my case, my wife's actual name name was not on the screen shot but both our pictures were there. You can highlight dates.

    Rule of thumb: when you make these secondary evidences, make sure the officer who looks at these gets the idea that your are trying to convey. They would appreciate us making their life easier. For eg, when you take screen shots, you could highlight one date in the log and as I said before if you use periodic logs, then they can skim through it and understand that you have kept in touch and you have provided a sampling of the timeline. Think from the perspective of a stranger reading it.

    I am not sure if the email from mom would be useful. It's better not to have it (no specific reason)

    Same with phone logs. Provide periodic logs for the whole time frame.
