  1. Hi all,

     

    I am a US citizen and my wife is a green card holder. Due to my work transfer I moved to singapore with my wife. We didnt apply for re entry permit or anything else when leaving the US. We move here 13 months ago and I recently found that due to this my wife can loose her permanent residency. 

     

    Not sure if i am posting this at the right place. But if anyone know where she can enter back in the US or not, with the green card and GC has not expired yet it is valid till 2023. 


    I called the embassy here and they said I have fill out i130 application again and restart the whole process. 

     

    Does anyone know if there is any other process we can follow to go back home without having to go through the entire process again?

  2. What Kind Of VIsa Did she come with?

    She got here on CR1

    If your spouse had CR-1 visa and entered USA, did you pay the immigrant fee (either before she entered US or after she entered US)? If the immigrant fee is not paid, green card won't be produced and mailed to your US residence address. If she don't receive a green card for more than one month, you/she should contact USCIS or set up the infoPASS appointment and meet USCIS officer at your local USCIS office. Officer might say that your spouse may have to fill out the I-90 form (fee is $0). http://www.uscis.gov/i-90

    The Green Card usually shows up about 4-5 weeks after an immigrant's arrival in the U.S. (if the $165 online Green Card fee is paid soon after visa is issued).

    A conditional permanent resident receives a green card valid for 2 years. In order to remain a permanent resident, a conditional permanent resident must file a petition to remove the condition during the 90 days before the card expires. The conditional card cannot be renewed. The conditions must be removed or you will lose your permanent resident status. http://www.uscis.gov/green-card/after-green-card-granted/conditional-permanent-residence.

    Thanks for the detailed information. we paid the fees of $165, before she got here. it has been more than a month now so I will call them. Appreciate your guidance.

    My wife just gave her interviewer at the Mumbai consulate. The interviewer said ' approved ' but the people who checked her documents prior to the interview told her. to submit one document to the visa drop box facility that is situated locally and once she submits we will receive the visa within 2-3 days. Her passport is taken. The problem is that we do not have that document and only have the translation of the document.

    I don't know how to approach this, will we get the visa? Shall we approach drop box people?

  4. Hi everyone,

    In the documentation for interview preparation mumbai consulate has mentioned that they do not let folders zippers in the facility at the time of the interview. We have a lot of documents and therefore are using accordian folder to store everything. Will that be allowed? Can anyone help?

  5. It'll be AFTER the interview and, preferrably, before your entry to the USA. It's the Immigrant Fee (not to be confused with the Immigrant Visa Fee) and goes towards the physical production of your green card. They won't proceed with printing your green card until they've received this payment. I believe all countries pay through USCIS ELIS online system where you can use a bank transfer or credit card.

    And the $165 is the green card fees that has to be paid after the interview & visa approval. This is what I have read from other people's postings on visajourney, haven't reached that step yet. Hoping to reach at that step soon God willingly.

    Yes... Its a fee you have to pay online. Some consular officers at Mumbai gives out the instruction handout after the interview but some don't.. You will get the instruction handout with passport

    Oh ok.. So they will tell us what to do, if not then I will pay it online right after the interview. Thank you..

  6. Hi everyone,

    I have read that at the time of the interview, we are requried to pay $165. Can you please tell me what are these fees for? I am not sure whether I paid it already or not. I have paid fees at teh time fo submitting the i130 petition, then $88 and $420. Have already paid?

    If I need to pay it, does it have to be in US Currency or a bankers draft of the local currency for the same amount can be paid?

    Are there any other fees that needs to be paid at the time of entry at the port?

    Please help.

  7. What state are you from? .. Are you petitioner?.. where is former spouse living (both) ?

    I am in MA and the petitioner. Ex-wfe lives in the same state but different town with her bf.

    Hey Swapnil.

    Just go in the interview. Dont freak out. They dont know what your friends look like. If they happen to ask you the question, just tell them that the photographer may not have taken a photo of them during the wedding because there are several thousand people in our indian weddings.

    There is nothing wrong with not having a pic. of them.

    Do you live in US?

    Do you have any income?

    They might ask you additional questions to make sure that you guys dont start milking the government assistance once your spouse moves here...thats all. Where as..they may not even ask you any questions pertaining to this thing.

    Thank you - that makes sense. I live in the US and my income is above poverty level.

  8. first of all .. did you register your marriage,, you have a valid copy of the civil document... also if you done religious ceremony .. copy of the that certificate.. then there is no need for affidavits .. any way you submitted it... they are not there to find all your faults.. if none of you have prior marriage or no red flags then the interview will go smooth...

    Thank you for your reply. Yes we did register the marriage and have given the marriage certificate a civil document for that. Both of us were married before. We have given our divorce papers as well. Does that mean that we should be prepared for a prolonged questioning because we were married before??

  9. Hi everyone,

    I am a US citizen and my wife is scheduled for an interview in few weeks. We just found one thing that may be an issue and we are kind of freaking out.

    We had our friends who lives in the US and were our neighbours in India, submit an affidavit of support letter explaining that the marriage was genuine. This letter was part of other documents we submitted for i130 petition. At the time of our marriage they were in India and attended our wedding and they have mentioned that in the letter. But we do not have a picture of them in our wedding photo album. I am worried that the interviewer may ask where is the picture of the neighbour who attended the wedding. We have pictures of some their other family members but not them. Because of this I am just hoping that this doesnt create a problem. Any ideas?

    Any insight on this would be helpful.

  10. Hi, I have a question about the police clearance certificate...I am the petitioner.. My wife has been living at the current address for more than a year. and we have a PCC for that locality but she also lived in a different part of the country in a different state for 2 years, do we need a PCC for that place as well?

    We filed on June 17th 2013 and have not received an approval yet. On March 7th we received RFE, to my surprise the request was a for a passport size photo which I already included in the file initially. I am wondering why would they need that if they already had it? Were they buying more time - I am not sure.. We sent that right away.

    They have mentioned in the letter that it can take 60 days. Does anyone know how long does it take usually after the RFE is submitted? We are already past the average processing time, is there any way to expedite our case or know what's happening with it. The people over the phone are just reading off the website and don't have any additional information. I have read some posts where people have sent letters to their local senator to escalate this. Can I do that or will it prolong the process.

    Please shed some light if you have any insight on such situation.
