  1. Thanks for the replies....

You are saying the airlines will already know to pull her luggage at port of entry and she just goes to baggage area to pick it up? Sounds pretty simple.

    Hi,

Someone just told me that even though my wife has a ticket package with all planes including connecting flights.... She will still have to get her baggage for customs/immigration at the port of entry airport.

How can she do that when the airlines automatically transfers checked baggage to the next connecting plane.

After point of entry in Portland, Oregon she connects on another plane to Medford, Oregon.

Any one with experience on this?

    Thanks,

    Mike

The airport will not transfer your wife's bags automatically at her POE. She will collect her bags before passing through customs, and then recheck them for the final leg of her flight. Everyone else will be doing the same, and the staff in Portland will help her. My fiance did this in New York. Allow plenty of time between flights to clear customs/immigration, and she will be fine. Good luck, and happy reunion.

  3. Ooops! Sorry PW!

I forgot to post in this thread, hehehe! Going crazy now! :-)

Yes we finally got our visa after being refused at the interview cuz of my small income. Don't need much to live on here in Oregon and I had plenty of assets that NVC accepted.

Anyway, the CO told Lorna I needed a co-sponsor.

Yes, the papers got to the CO only 6 days after getting to the Embassy. I was shocked cuz it was so fast.

And actually it took 5 biz days for delbros to deliver to CEBU(lapu-Lapu)

Anyway Its been so great having this site to learn from and ask questions and read about other's adventures. But especially to keep me company while I went through the visa process without my wife.

Thanks everyone. Bought the tickets (NWA $850.00 to Medford Oregon)

Lorna will be here June 6 after she spends a week in Basilan visiting her family and saying goodbye!

Love you guys.... God bless and I pray for everyone's happiness and success.

    Mike & Lorna

  4. Well today the Delbros courier handed Lorna her Visa. Still can't believe it.

At her interview March 19 the CO told her there was no way I could support the both of us based on my earnings. Even though I had plenty in property assets and sailed through NVC with no problems.

He said we needed a co-sponsor.

So after 6 weeks and beginning to lose hope, one of my best friends offered to co-sponsor Lorna.

Sent the paperwork in and 6 days after it arrived at the Embassy, Lorna's visa was released to delbros.

Thanks to everyone for their prayers and also to the regulars who were a GREAT help in the total adventure.

    God bless you all......

    Mike & Lorna

  5. Election day....

    Hi,

My wife was going to Basilan from Cebu to visit her family before coming to USA.

The Boat leaves Cebu on Monday, but it is Election Day Monday.

Does anyone know if the boat will still leave on monday? If not will it leave on Tue. instead? Or will boat delay until the next monday?

    Thanks,

    Mike

  6. Hi,

AR is when they want to check something.....

Security check, or they might want to have NSO send them another copy of your MC or her BC just to make sure you are all legal and stuff. They could also ask NBI for another certificate if yours is older. The point is, that this is VERY common in PI and usually takes 4 to 6 weeks. Sometimes less.

You can call the Embassy at this number which is a normal long distance call (no fee) Try to call around 8:30am their time.

    Manila Embassy 011-63-2528-6300 ext 5184 or 5185

Hey be happy and thankful! We were given a 221G (refusal) and I had to find a joint-sponsor. What a headache! We sent Embassy the papers of our new joint-sponsor yesterday. Hopefully we will finally get Lorna's visa in a couple of weeks.

    God Bless,

    Mike

  7. Thanks Mike...

Your post brought tears to my eyes. I imagine the same thing happenning when my wife Lorna gets here.

The thing I look forward to most, is just laying with her, holding each other and feeling the great feeling of all this STUFF being over with. I can't wait to get this burden off my shoulders that is the Visa process.

Thanks for the great story. It helps my dreaming of "our turn".

    God bless you both!!

    Mike

  8. Kim,

I also am wthout my wife due to AR during her interview March 19.

I didn't see why you are on AR....

For us, it was my lack of income even though I had plenty in property assets.

The CO told my wife "there is no way your husband can support you on what he earns." (Not true!) And that she needed a joint sponsor.

This has been killer for us as I had no one to be the joint-sponsor. We were going crazy with all hope fading.

But Glory to God a good friend's wife stepped up and signed the papers!

Finally I will send in the required papers tomorrow. Hopefully get our visa within a month. We are overjoyed and thankful.

Anyway Kim this just shows you and us that it's God's speed....not ours... and He has a devine plan for us.... in His time frame.

    Good luck and God bless!!

    Mike

It looks like everyone's getting their visa and I'm only the one left here. I feel so depress. :crying: :crying:WAH!!WAH!!
  9. Thanks Yodrak!

    And Thanks meauxna.....

Yea, I ordered transcripts for my taxes when I sent in my I-864 as sponsor.

But the 221g that Lorna received at her interview was an older form from 2005 and it requested an "I-864 from a co-sponsor in the USA with original notorized signitures"

And... Federal Income Tax returns for years(left blank)

And...W-2 forms from years (left blank)

So I'm giving them EXACTLY what they asked for including 3yrs federals and W-2's. I'm not taking any chances at this point, hehehe!

The documents will head for Cebu tomorrow....whew!

    Mike

  10. Hi,

I was copying my joint-sponsor's 1040 and W-2 today and need advice.

My J-Sponsor is Sara + she filed joint taxes with her husband. The husband is self-employed, so he needed to add the 1040-C, for profit and loss.

Since Sara didnt need the 1040-C for her part of the taxes, do I still need to include the 1040-C with the 1040?

The I-864 directions say to include 1040 and w-2.... would that mean the 1040-C for the husband as well? He is not envolved with the sponsorship.

    Thanks a lot,

    Mike

  11. Thanks alot PW...

    Actually Lorna is a CR-1.

I get confused on who is the visa petitioner me or her...???

In an immigrant visa case, once a consular officer has issued an immigrant visa, no Form I-864, I-864EZ or I-864A may be withdrawn unless the visa petitioner also withdraws the visa petition.”

God bless and good luck to you!

    Mike

    -----------------------------

Thank you all for your sympathies and condolences. Finally got done with the travel arrangements and we're getting on a plane this afternoon... not looking forward to this homecoming.

Be strong sillygirl. We will pray for the repose of your Mom's soul. It is a sad homecoming indeed. of of

Hi guys, Im off for our medical, leaving soon, hope to be there before lunch, I dont like driving in Manila too much of a hassle. Wish me and my baby luck :)

    Good luck!

I agree on the driving in Manila.....I was very much in shock with the driving in the Philippines when I arrived the first time. :o

Guilty! I drive like a Manila bus driver hehe. My fiance steps on his "imaginary brakes" all the time

You posted something recently for Glenn about if Lorna was to leave me before her lifting of conditions (CR-1) then (1) she would need me to do the lifting of conditions process? I mean...I'm trying to cover all bases for my co-sponsor. (2) If she can't get her conditions lifted after 2 yrs because I'm not in her life, then her visa status would be terminated? (3) Which would relieve the co-sponsor of obligation?

    (4) This is a "what if" scenario that must be looked at.... just like what happens if I die before she becomes a citizen.

    1. Since Lorna will come on a K visa, her conditional residency would be based upon her marriage to you. The major condition that she needs to fulfill to remove condition is for her to stay married to you and nobody else. A CR-1, however, may lift conditions on her own if she married in good faith but is a victim of violence or abuse by her US citizen spouse. So never, never hit a wife or she may use this against you in the future.

    2. If you are not in her life and there is no proof of spousal abuse, her petition to adjust status would most likely be denied. She will be asked to leave the country but most people just stay and become illegal immigrants. If you and your co-sponsor do not withdraw your I-864, both of you will be responsible for her for 10 years (?) I believe. A sponsor or co-sponsor has the option to withdraw I-864 while the adjustment is pending. Do note however that if your spouse came as CR or IR, which is an immigrant visa, you cannot withdraw I-864 without withdrawing the visa petition itself. Here’s what the USCIS say:

Withdrawal of an affidavit of support or Form I-864A . A person who has signed a Form I-864, I-864EZ or I-864A may withdraw the Form. If the person does so, USCIS will adjudicate the application for adjustment of status as if the withdrawn Form I-864, I-864A or I-864EZ had never been filed. In an adjustment of status case, a withdrawal of the Form I-864, I-864EZ or I-864A is not effective unless it is in writing and USCIS actually receives the withdrawal before the final decision on the adjustment application. In an immigrant visa case, once a consular officer has issued an immigrant visa, no Form I-864, I-864EZ or I-864A may be withdrawn unless the visa petitioner also withdraws the visa petition.”

    3. Lifted from http://www.uscis.gov/propub/ProPubVAP.jsp?...d3f01ed23e3e117

Termination of Sponsor’s Obligation and Enforcement. The obligations created under Form I-864 and I-864A terminate when the sponsored alien:

    • Becomes naturalized

    • Is credited with at least 40 quarters of employment in the Social Security system;

    • Loses or abandons his or her lawful permanent resident status; or

    • Dies.

    4. If you die before you marry her, she has to go home as she will be unable to fulfill the K visa requirement, that is, to marry the petitioner within 90 days. But if you die before she becomes a citizen, she can adjust status on her own. Death will not deprive her of her right to stay in the US if she married in good faith.

  12. Hi Patiently Waiting....

I'm really excited I finally found a co-sposor for my wife Lorna.....

You posted something recently for Glenn about if Lorna was to leave me before her lifting of conditions (CR-1) then she would need me to do the lifting of conditions process? I mean...I'm trying to cover all bases for my co-sponsor.

If she can't get her conditions lifted after 2 yrs because I'm not in her life, then her visa status would be terminated?

Which would relieve the co-sponsor of olbligation?

Believe me I have no reason to beieve she will leave me. This is a "what if" scenario that must be looked at.... just like what happens if I die before she becomes a citizen.

Anyway, any help on this would be appreciated.

    God bless, Mike

What should I do? It has been over 48 hours now since I have heard anything related to her.I have no choice but to feel that I have been used. We were married in the Philippines on December 29, 2005. Do I file for divorce here in USA? I have emailed my attorney, but no response. I think he is only good at cashing checks. He was a major waste of $3000 for sure. Did she do this just to get here in the USA? If so, how can she stay? We had not applied for AOS. I don't like being used and want to know where she is.

Rosemarie will not be able to adjust status without you and remember, you are the only way she can legally adjust. However, since you are married to her already, she can legally stay in the US for two years before she will need your help in removing conditions. As suggested earlier by another poster and since you don't know what she is thinking right now, protect your finances in the meantime. She may have broken your heart but don't let this situation break you financially too.

Even if you were married in the Philippines, you may file for divorce in the USA. A US divorce between an American citizen and a Filipino citizen is recognized here.

Luvbugs, I will update the list tomorrow night. I'm sleepy. Good night everyone!

  13. I'MMM BAAAAACK!

Wow sorry to impose on Gelnn's problem/thread and my heart and prayers go out to you Glenn.

I think I finally got a joint-sponsor to finish up my wifes's visa stuff. Wow! What a journey/nightmare the last 2 weeks have been.... more on that later.

I have a question about Alien # on the I-864.

Lorna has never had an alien # and I just wanted to make sure she still does not have one.

We got all the way to the inteview with her CR-1 before being put on AR so I'm asking you folks if she has been given an alien # somewhere along the process.

Since she is not an alien yet, I assume she doesn't have this # yet until she actually becomes an alien.

Any thoughts? I really want to make sure we get the joint-sponsor's I-864 correct at this point. :-)

Thanks for all your help and prayers.... and God bless you all!

    Mike

  14. Thanks for the support Yodrak....Appreciate what you do to help on this site.

    meauxna...

Thanks and sure I can change the text size. It looks ok for me and when I reduced it from 6 to 3 it did nothing for my view. I took both the size and bold tags out and the bold went away but size is still the same... for me.

So let me know if its fixed and if not I will just remove the text..... no problems.

Oh what DCF forum are you refering to? Here at VJ?

    Mike

  15. Thanks to you all!!

This is a great discussion as it just isn't talked about in detail in this site or any other site I have visited. And every person I have talked to about sponsoring my wife has raised some issue of risk.

I'm really surprised noone else has run into this problem and asked questions.

    Example....

My mom is VERY rich, retired, alone, and never spends any of her money.

But, she is a worry-aholic. It's up to me to releieve her of the worry by learning the facts so she will even listen to me. Once she and I have learned that she basically has no burden, then she will relax and I can pay a lawyer to sit with her and tell her what I already told her but as absolute fact.

I have read and reread the I-864 instructions and rules etc.

I have read and reread the 213a and the laws it makes reference to.

I've done many searches on any topic related. But the hard part is figuring out the topic for the search.... and which government agencey to look up.

I am doing my homework. It's all I can think about. This is the only thing keeping me away from my wife.

I've put possible joint-sponsor burdon into 3 categories....

    1. Being sued from auto accident. Solution.... My wife will just have to wait to get her license until after she becomes a US citizen.(3yrs)

    <Problem solved>

    2. Health issues like not having funds for surgery. Solution... I buy her health insurance.

    <Problem solved.>

    3. Becoming a public charge. Only applies if she devoriced me and I didnt continue to support her(which I would)

    a. If she were even able to receive gov. assistance, then I as the primary Sponsor, whould pay that back. No burden to the Joint-sponsor.(If they trust me)

b.If she requested living expenses directly form the sponsors, then again, I would do what it takes to pay these expenses so it would not become a burden to the joint-sponsor.

    So I'm getting close.

Still wondering about if, say... she was riding a bicycle and hit an old lady on the sidewalk and then the lady sued. If that would be the husband's burden or if they can go to the sponsor for that.

I guess I could by some kind of accident insurance.

Its almost time for me to sit with an immigration attourney noe that I have specific questions to ask. And some solutions.

Again thanks so much to all of you for your help and insight.

    Mike

  16. Yes, I agree but it would be nice to find out for sure so I can tell a possible joint-sponsor their exact burden.

I have decided buy health insurance for my wife. That will elimminate the health issue but I still would like to find out about who is responsible if an accident where she might be sued.

Thanks a lot for your input. You sound like you really know your stuff. I'm listening! :-)

    Mike

  17. Thanks alot diaddie mermaid....

Actually in that case the ex-wife decided to take the matter to federal court so the issue would be about the I-864 burden as opposed to marital/devorice burden which I think is a state issue.

You can read about it here.... excellent reading!

    LINK

meauxna... Thanks to you as well.

I would love to learn about sponsor/co-sponsor as far as who the gov. goes after first. I have searched all over for that kind of info as well as what is going on with the 864 "between the lines"...

I have been studying the 213a law and the laws that the 213a refers to but there is not much out there to research.

For example the 864 doen't talk about what happens if my wife was in an auto accident and was sued for whatever the car insurance didnt cover. Would that debt go to me the husband? Or me the primary sponsor? Or the joint sponsor?

If the husband.... then does that relieve obligation to the sponsors?

Or what happens if my wife needed surgery and the bill was say 20,000. Who do they go after? Husband or sponsors. Its not a government issue and therefore nothing about it in the 864(213a)

Any links to articles would be greatly appreciated.

    Thanks again for the help.

    Mike

  18. No hidden meaning.

My wife was refused her visa at interview even though I had 130,000.oo in property assets. I had a bad few years with income and when the CO saw my earnings, he told my wife she needed a co-sponsor.

Everyone I talk to about being a co-sponsor is afraid of what could happen.

So I'm searching every possible fact I can find to put them at ease.

I read that in one case a wife devoriced her american husband, and ended up sueing him for 19,000.00 for living expenses.

But no.... I love my wife. We both cry everyday we are apart because of this issue.

    Mike
