  1. My wife is the petitioner, and we want working to get the I-864 form filled out for the sponsorship. We have two visa cases, IR5's, one for each, (mom and dad). We've only had to pay the AOS fee once, not twice, but had to pay each IV applicant fee. 1 for mom and 1 for dad

     

    Because my wife doesn't have employment. I'll have to be the only joint sponsor. So my question is, do I have to fill out two I-864 forms for each? (mom and dad)?

  2. My wife who just recently came on a K1 visa, is having her brother along with his wife and their baby visit us for our wedding ceremony for 1 week.

    QUESTION:

    My wife's brother and his wife who are from Honduras were here in the United States when their baby was born so now the baby has United States citizenship.

    We are wondering if they come to the United States from Honduras if they will have problems with bringing the baby into the US because it was born here in the United States.

    We would really like their presence at our wedding along with their new little baby under two years old.

    Any thoughts or suggestions about this?!!!?!?

  3. Did she look at the social security card or just ask if she had one. It is pretty standard for an employer to say bring a driver's license or ID and your social security card. Look at the I-9 you attached. The social security card will work only if it is not annotated which your wifes is. Probably the HR person is not familiar with this annotation or was having a brain freeze. She IS NOT legal to work until she has an EAD or her green card in her hand.

    I agree with you that is why I was posting this on here, but they actually did look at her social security card.... and Im thinking why they didn't read "VALID ONLY FOR WORK ONLY WITH DHS AUTHORIZATION"

    I guess I will have to tell my wife to tell Human Resources to check out the I-9 form and see if she complies with that.

  4. The thing is we told the company, and HR (human resources). They confirmed she is okay to work. That is why I am afraid they dont have something right.... What could we tell them? Ask the Human Resources to check out the i-9 form?

    What I am wondering is her k1 visa expires on February 18th, 2014, and we expect her EAD to be arriving early february. So maybe they can legally hire her from now until the 18th of Februrary.

    She took the written test and passed. She now has a learner's permit that expires on the 18th of February, and two forms of identity the human resources asked for was the learner's permit and social security number card


    There is a little confusion here. A K-1 entrant can apply for an EAD independent of AOS. This EAD must be paid for ($360 or thereabout), it takes about 2-3 months to receive, and it expires at the same time as the I-94 (usually 90 days after entry). That is why it is advised to not apply for this EAD as it is almost worthless.

    The EAD you apply for with the AOS, which is free with the AOS filing, is good for one year and can be renewed if the AOS is delayed.

    We applied for the the EAD with the AOS filing along with the travel document.

  5. QUESTION:


    My fiancee arrived in November 21st of 2013, but we have already filed for AOS in December after getting our marriage license on December 4th.

    We applied for the social security number under her maiden name. She has been offered a job.

    The company human resources has confirmed with her they can hire her, but I am afraid that they might not understand the whole situation.


    We filed for AOS, employment authorization, and travel authorization in December, so I am assuming that at the end of January or middle of February she will receive her authorization to travel, and authorization to work. She is scheduled to start work on January 27th.


    We are still waiting on her green card which might not be until April 2014.


    Her social security card says VALID FOR WORK ONLY WITH DHS AUTHORIZATION.


    If she can work then why did we have to submit a employment authorization form i765?

  7. How long should we expect to wait for the receipt of our AOS package that I sent late afternoon of Friday December 6th, 2013?

    We sent it to this address box via USPS asking for confirmation of receipt via email, and a certified mail signature that requires someone to sign showing they received it.

  8. Ok great thank you. I was not wanting to get the SSN number so that we could get married but that is a good thought to check on that.

    According to the USCIS website, Fort Smith, AR shows for i-485 that it is four months. Please correct me if I am wrong.

    The i-485 is the AOS adjustment of status which shows four months. The i-865 is the Affidavit of Support which we do not need because I make enough money to above the poverty guidelines.

    Hopefully when we submit the i-485 we can then submit the AOS/EAD/AP all at once, and possibly receive back confirmation we have been approved for the EAD and AP before the AOS.

    Once we receive the EAD, we can try and go to the DMV and see if they will issue her a driver license then.

    Another note, somewhere I read it said to wait at least two weeks before arrival to the US before applying for SSN. I think that if you wait the two weeks then apply for the SSN, it will be in the system according to a document here on visajourney. Then when we fill out the i485 AOS form, we can put the SSN in the form so that its in the whole process.

    Any thoughts, please add.

    More or less correct -- do note that 4 months would be exceptionally fast to get the actual green card, since many cases are averaging 10 months. So don't count on it any time very soon. EAD and AP should come relatively quickly (2-3 months) though.

    Get SSN as soon as you can -- if you wait too long, you'll be turned away if it's too close to the expiration of her I-94.

    Most states don't require SSN for marriage license/certificate -- you can get married right away without SSN if you so choose, unless Arkansas is unique?

    The paperwork for the AOS/EAD/AP isn't THAT bad, we completed it in one weekend, but it does require all of the financial support documents for the I-864, which were the most time-consuming. Luckily if you prepared well for the K-1 interview and had supporting docs for your I-134, much of it can be re-used this time around.

    I can't speak for Arkansas, but in many states (like for us here in California), having the EAD will be enough to get a driver's license. In most states, the license will have an expiration date tied to the expiration of the EAD, so you may have to go back and renew the driver's license after getting a longer-validity green card, many months later.

  9. Okay thanks everyone for the replies! Okay. Just to clear up any confusion. The revenue office is the DMV office. First of all, not many Hispanics live in this neck of the woods. Secondly, no one from two different cities could tell me what paperwork is needed to get her a drivers license.

    The link for the I-94 worked! I appreciate that. I put in her information and was able to pull her record and print out the i-94. Now I can hopefully take that to the SSN office and get a social security number. Once we receive that SSN, which another user on here told me, it takes maybe two weeks to receive the SSN. Then simply obtain the marriage certificate, and file for the adjustment of status along with the advance parole document for travel, and the employment authorization documentation for employment, and then just wait.

    Any thoughts? Hopefully its is just as simple as that sounds.... :(

    After receiving SSN, obtain marriage certificate.

    Prepare paperwork for the AOS adjustment of status, EAD Employment Authorization Document, and Advance Parole Document

    Submit all documents at once, and hopefully after receiving the green card in 4 months minimum then apply for Drivers License ?

  10. Does anyone know how soon or what documents are needed to get a driver's license for my fiancee in Arkansas? The revenue office doesn't seem to know... No one does. My fiancee did not receive any special documentation when she arrived to the US, so therefore we can't get a social security number. All we will have is when we get married in this 90 day window and get the marriage certificate to show as proof or identification.

    Any thoughts on how I can go about getting a driver's license as soon as possible for fiancee?

    I have a question regarding the $165.00 USCIS Immigrant Fee that the USCIS website says you have to pay before arriving to the United States.

    The link above is pretty straight-forward on how to pay for this fee, etc.

    We have been approved for the fiance visa, (1) but unsure if we need to pay the USCIS fee before arriving to the US, (2) or we will not have to pay it period, (3) or we will have to pay it after she arrives to the US and receives her green card.

    The response I received from the US Embassy in Honduras regarding this question is somewhat confusing.

    With this type of visa, You don't have to pay the USCIS immigration fee of $165.00.

    If I understand correctly the limited response from the embassy, because this is a K1 fiance visa, NOT K3 spousal visa then we do not have to pay the $165.00 Fee, but once we file our adjustment of status (AOS) we will be created an alien number, while waiting to receive the green card? Is the green card the same thing as the resident card?

    Once my fiancee arrives in the US on a k1 visa, and we get married then file our adjustment of status.

    When can she travel back out of the United States?

    Does it only take four months for the adjustment of status to be complete?

    I am curious if we do not file the Advance Parole when we file for adjustment of status (AOS), how long it will be when she can travel outside the United States. The 1-131 Advance Parole Travel Document Fee is $360! Ouch.

    After two years of marriage we request the conditions to be removed from our adjustment of status?

    Any help would be great thanks!

  13. My NOA2 was July 3rd. My case supposedly just arrived to the Embassy today. It says ready when I put my case number in this site. Does this hopefully mean the embassy will have my case? I have been going back and forth with the embassy for the last week and they say they do not have my case.

  14. Interesting... I just got off the phone with NVC and they say they have nothing to do with a fiance visa, and that they just received our case two days ago, and that it will just be simply forwarded to the embassy in Honduras where they handle everything.

    I checked the link you sent above and the case just shows at NVC, thats all it says.... hmmm my attorney says we should be getting a invoice number to submit payment and file proper documents... I guess that happens at the embassy?

  15. After you receive your case number from the NVC? then what can we do with the case number? do we just still wait until NVC does the administrative processing and request for paperwork? Im confused because the NVC told me that it is in administrative processing right now and that they will be forwarding the letter to the embassy. What is this letter that could be talking about? Any idea how long that takes? Thx
