    I think you may be confusing 2 separate things. Conditional Residents are required to submit the Biometrics Fee while filing the I-751 to remove conditions. You're a conditional resident until your ROC is approved and you're issued the 10 yr greencard. Read page 2 under Biometrics Fee (https://www.uscis.gov/sites/default/files/files/form/i-751instr.pdf). US Citizens and US lawful permanent residents do not need to file I-751 hence no biometrics fee is needed until USCIS sees a need for it. If one does not submit the exact required fee, the ROC package will be returned back to you causing further delays.

    "1. Conditional Resident. Each conditional resident and conditional resident dependent included in the principal petitioner’s Form I-751 is required to submit a biometric services fee with this petition, in addition to the required filing fee...."

    Just a reminder . Just wanted to pass on our goof, what we learned the hard way (our friends did too before us) and it appears I am reading that other people have done this too.

    If you are a current citizen or have a conditional permanent green card (which most people do on this forum) :

    *YOU DO NOT NEED TO SUBMIT YOUR BIOMETRICS FEE when sending in the I-751 application to remove conditions. .

    They will determine if you do need them and send you a letter requesting that you do so, but you should not send the extra fee in at that time.

    They will not refund your money, nor tell you if you goofed or not, this is free money for them.

    This is in the I-751 instructions:

    U.S. Citizen or Lawful Permanent Resident Spouse.
    If you are the U.S. citizen or lawful permanent resident
    spouse, you do not need to include a biometric services fee at the time this petition is submitted. If USCIS later
    notifies you that you must submit your biometrics, you will receive a biometric services appointment notice with
    instructions on how to submit the additional fee.

    Just to chime in what some other posters have suggested. First of all, you're not adjusting your status; you're removing the conditions on your 2-yr greencard. Which means that you must show USCIS that you and your spouse have maintained a bonafide marriage in the eyes of USCIS. Yes, most Americans don't have joint insurance or bank accounts but they don't have to prove anything to anyone; immigrants do.

    It is your duty to show the officer, on paper, via proofs that you and your spouse have maintained your marriage over the last 2 yrs by submitting solid proofs.

    Anyone can travel on vacation with friends and show pictures. But USCIS believes that you have to have various commingling of assets to show as solid proof. If your spouse refuses to adjust his tax filing status, do not include it in your package as that would greatly jeopardize your case. There shouldn't be anything listed as 'single' in your package.

    You really should gather more 'solid' evidence than what you have so far. Bank statements, Bills, Cellphone bills, drivers license or ID showing same address. Joint Insurance (of any kind) etc. I would also suggest searching this forum for what other people submitted to give you a better idea. All the best to you.

  3. You can always travel within the US with a Passport. Imagine if you didn't live in the US and lived in the UK visiting the US on vacation and needed to travel from California to Florida? You won't have a US Driver's license.

    So to answer that 2nd part of your question, no it doesn't look suspect. Many people visiting the US from other countries travel within the US with their passports without consequense everyday. Travel outside the US is a completely different story.

    A quick question I think I've asked this before but without a knowledgeable answer
    Okay here is it be patient with me
    Currently going through the ROC process green card expires April as does my drivers license on the same day
    I have my extension letter and my biometrics letter also
    I'm going to Florida for a family vacation in may I'm planning on renewing my drivers license with extension letter but heard it doesn't always work with the dmv hopefully it does and it comes in time before I fly
    So I was wondering if that doesn't work out am I able to fly with my British passport from C.A to F.L or will it look suspect ????
    Anyone ever been through this before all help Is appreciated

  4. It looks like you're mistaken the NOA (Notice of Action) as the "letter of approval". When you submit your ROC documents, you're sent a NOA letter which also serves as a 1 year extension of your green card while your paperwork is being processed.

    Afterwards, you receive a Biometrics appointment letter. This is to take fingerprints and a photo. Once a decision is made on your husband's case, usually between 3-9 months, you will receive your "Welcome to the US" letter and 10yr green card.

    my husband two year green card anniversary was october 23rd so we filed August, received a letter of approval and notice of appointment for September 18th, 2015. We went to biometric appointment on September 18th. Now it is November 3rd and we still have not received any letter or green card. Can someone explain this to me? Should I wait longer?

    We got a REF for more evidence of a, I hate this term, "bonafide" marriage. My wife and I have been in the same house living our lives for the last 4 years so yeah it is bonafided.

    Anyway, I can easily add her to the deed to house, my question is, is it necessary to add her to the mortgage?

    To add a spouse to a mortgage you have to refinance your house. So I am wondering if being on the deed is enough, or do I really have to refinance to satisfy USCIS?

    Hi Art,

    Names on mortgage is only 1 of the many evidence options you can submit. It all depends on the other evidence you have to send or have sent to USCIS. My spouse is not on the mortgage and we explained this in the cover letter. You can only send them what you have. If you don't have both names on the mortgage, then send them other things that have both names. Best of luck to you!

  6. My conditional greencard is expiring in March 2016. My daughter who is basd overseas is giving birth in January and is requesting me to be with her for at least 3 months. Meaning from January to March 2016.

    Filing for request to remove conditions on residency is 90 days, can't file earlier than that.

    We will file it this December 2015.

    Can I travel outside the US after filing it or I need to wait for the confirmation/acknowledgement from USCIS as well as the notice of 1 year extension approval before I can leave ti ensure I will not have a problem coming bck?

    Would appreciate a step by step guidance.

    Once you file the I751, you get the confirmation which also serves as the 1yr extension letter. After that, you're scheduled for a biometrics appointment; which you have to go for. You can always request for the biometrics to be re-scheduled. But that's after you receive the appointment letter. If you're out of the country, how would you attend the biometrics appt or request a re-schedule?

  7. Just out of curiosity...what was the rfe for? Did they just ask you for like one specific thing? Just seems really fast that you responded and 10 days later you got the approval. That's barely enough time to gather info and mail it to them.

    Good question! Honestly I was quite surprised we got an RFE as I sent what I thought was a stellar package (lol). The RFE was pretty generic.

    Below is what was in the original filing:

    · Copy (front and back) of XXX's Permanent Resident Card

    · Copies (front and back) of our Driver Licenses

    · 2012, 2013 and 2014 IRS Tax Transcripts

    · Joint Checking Account Bank Statements from account open date (12/2012) to current

    · Retirement Beneficiary verification showing primary beneficiary

    · Joint Auto Insurance policies from 2013 - current

    · Utility bills in both of our names from 12/2012 – current

    · Family plan Cellphone (Family plan started in 2014)

    · A few of our photos together.

    · Two affidavits

    · Some miscellaneous letters we received.

    We don't have a lease or mortgage together and filed taxes "married filing separately" nor do we have any kids together yet. I'm really not sure what triggered the RFE but my response was simply more bank statements from the time we filed, more bills and more insurance bills. I explained everything else in a cover letter. I really didn't have anything new to add to the list.

    Regarding the joint bank statements, I'd suggest you send bank statement for every quarter (every 3 months) that you had the account open not just the 1st 3 and last 3 statements. They want to see ongoing stuff for the duration of marriage or conditional green card.

    Regarding other evidence, do you have other utility bills in both names other than just 1? Also, be sure this is not just 1 bill statement but multiple bills that span at least 2 years.

    I was hoping to get some advice regarding my situation. I am filing my i-175. So far, the supporting documents I have are as follows:

    1. Our joint health and car insurance, copy of both of our driver's licenses

    2. Life insurance policy with each other as beneficiaries

    3. Joint tax returns for 2013 and 2014

    4. Affidavit of support from my brother-in-law and a friend

    5. Documents showing our vacation together (email from travel agency, our boarding passes showing we flew together, hotel reservations)

    6. Pictures of us together. Mostly with just her and I during our vacation and attached a few pictures with my family.

    7. Lease with both of us on it - We moved twice last year and I have joint lease from both apartments.

    8. Utility bill with both of our names on it

    My biggest question is regarding our joint bank account. We had a joint account up until few months ago and then we had to close it because of some issues with the bank. So, I had my paychecks deposited to my wife's account and we've been paying all our house bills from that account. I have attached documents showing our previous joint account (statements from 1st 3 months and last 3 months) also, my paychecks being deposited directly to her account and statements from her bank account showing paychecks being deposited to her account.

    Would that suffice? Should I even bother attaching them or the documents I have listed above are sufficient.

    I would truly appreciate any advice regarding our situation and thank you all in advance. Good luck to everyone!!

  9. I think it's okay to have your dad sign an affidavit regarding your marriage and that you lived with them for a period of time. I don't see a need to include your mom's death certifcate. Affidavits are light evidence but it doesn't hurt to have 1 or 2 if you wish. All the best!

If so, does it have to be notarized?"

    Ok so If I print a medical power of attorney form and fill it out does it matter if it had lets just say todays date, would USCIS look at that or no? And does it have to be notarized? Thanks for your response! :)

    You seem to have some good stuff. Just make sure that the lease, utility bills, car insurance span the last 2 years and not just 1 recent copy.

    Tax returns - I suggest sending tax transcripts. You can order them from www.irs.gov site.

    If the auto title isn't in your names, I'd skip that. The car insurance is good.

    As long as the Driver license shows the same address for both of you, that's good. This doesn't matter whether it was just issued. If your address isn't the same, I'd omit it.

    Photos are light evidence, so if you're sending them, send a few that you have.

    Affidavits are light evidence, you can get them notarized if you choose.

    Hey guys so here is a list of all the evidence I have:

    • Two years worth of our Savings Account statements. (We had separate checking until a month ago because of the I751 but then I found out through VJ that USCIS prefers to see statements from two years ago so I thought that it wasn't worth sending both or our checking account statements from a month ago because I don't want USCIS to question our marriage, or should I?)
    • Copy of a loan statement in both of our names (we got the loan the beginning of this year but we paid it off in march and I could only find one statement, is that ok?)
    • Copy of a Christmas card my cousin sent us from Chicago with both of our names on it
    • Copy of our Car Insurance in both of our names (the title is in my father's name, haven't changed it because it's expensive and now that I think about it I feel like I should have :( )
    • Copy of our lease agreement with both of our names on it
    • Copy of the light bill with my name on it and a copy of the Comcast bill with his name on it (water is included in the rent so no water bill, should I let USCIS know about this?)
    • Copy of our 2013 and 2014 income taxes that both were filed married and jointly
    • Photos (we haven't traveled but we do have birthday pictures, Christmas, family gatherings and etc, is that ok?)
    • Copy of a best buy credit card statement in both of our names (we had got the credit card from best buy a year ago but we never used it until this year to buy our tv, so we only have about 3 credit card statements, is that ok?)
    • Copy of both of our drivers licenses with the same address (I'm afraid to send this one because my old drivers license had my parent's address and it didn't expire till this year on my birthday in may so I hadn't changed mine and there is an "ISSUE DATE" on it dating in may of this year so I'm afraid they might look at that and have doubts, but we both still have our old drivers licenses with my parents address, should I send a copy of those as well?)

  11. As noted, you may want to include 2 years tax transcripts that shows filing married. You can order the tax transcripts online at www.irs.gov. W2s aren't needed. Use the tax transcripts instead.

    - They don't just want to see that you have a joint bank account. They want to see that there's activities in the account(s). The account statements should span 2 years (if possible) or since inception. Some people include statements from every quarter instead of monthly. But that's totally up to you.

    - Make sure the evidence you're sending for the different insurance spans 2 years (if available). They want to see that you've maintained a joint life for the 2 years you've had the CPR card.

    Hi all,

    I'm wanting to make sure what I have listed below will be sufficient for ROC which will open in about two weeks. We don't have much evidence regarding joint bills, utilities, or credit cards, so anything anyone can recommend would be appreciated. Also, if anyone can see anything that's just wasted paper, that would be appreciated, too.

    1. A joint signed copy of our previous lease (Mar, 2014 - Jun, 2015)
    2. A joint signed copy of our present lease (Jun, 2015 - Jun, 2016)
    3. Evidence of a shared bank account with a credit union
    4. Evidence of a shared bank account with a bank (would it be beneficial to print off statements to prove we use said account?)
    5. Car insurance in both our names
    6. Renter's insurance in both our names
    7. Health share plan (alternative to insurance) in both our names.
    8. W-2s
    9. Birth certificate of our eight month old daughter
    10. Boarding tickets/photos of Australian vacation, 2013
    11. Photos and birth announcement of daughter, us together as a family etc
    12. Cards addressed to us (though not to our new apartment).

    Anything else? Would this be sufficient? Thanks in advance.

    Your most accurate information will be found on the USCIS website. All other sites may have outdated information. The USCIS site is what you should always go by. Based on that, it shows Florida residents should send their package to CSC. All the best.

  13. I just did my Biometrics today and they only asked for a photo ID (government issued). I know the letter does state to bring the green-card with you but most people there with me had just their Driver's license. I won't necessarily panic yet; maybe he can try doing an early walk-in and see if they'll accept him with just the ID. Good luck!

    Hello All!

    I am posting on behalf of my husband, who came over on a K-1 from the Philippines in 2012. It took us 2.5 years, but we did it!

    Now, it was time to file his I-751 to adjust his status from Temporary to Permanent.

    We sent in his paperwork in early May, and got a letter the first week of June telling him that his temporary Perm. Resident Card was renewed for a year and to wait for a biometrics appointment.

    However, his wallet was lost/stolen including his card a couple of days after we got the extension letter. I wasn't sure whether to report it to USCIS (we did file with the police) because a replacement costs around $400 and we just had our check cashed for $600 to get the new card.

    Unfortunately, we got his letter for a biometrics apt this week and he needs to have the card!

    It's pretty much my fault, since I used a lawyer for his K-1, but we didn't this time around. They would have known what to do, and I simply didn't.

    So... what do we do???! If I report and order the card now, it won't come in time. I am so angry about the extra cost, but obviously keeping him here with me and our daughter is more important.

    Any advice or comments would be really appreciated!

    Under the circumstance you've stated, I won't suggest filing jointly as that would be lying to USCIS. Filing jointly means you're still in a bona fide marriage with the applicant. She can file a I-751 divorce waiver and she'll get RFE'd for the divorce decree. Hopefully, by the time she gets the RFE, the divorce will be finalized. The way you can support or assist her in this process is by helping with any evidence and you can go to the interview (if she gets one). Hope that helps. All the best!

    I am an American citizen who married a Filipina on the K-1 process. To be honest - we tried, but were never able to really form a good relationship. After a year, we separated and decided to divorce. Now, I live in Maryland, where we must wait a year before filing. Soo... for the last year, we'd been living our separate lives.

    At this point, we're nearly done with the divorce (it's been filed - we're looking at a few weeks I hope). She's wanting (needing) to file her I-751. While we didn't exactly separate under the best of circumstances, I still feel she's a good person. As we're not yet officially divorced, she can't file a waiver (http://www.aa-law.com/images/stories/i-751-waiver-joint-filing-41003.pdf) until we're divorced. She's therefore wanting me to file jointly.

    While I want her to have a good life - the fact is she doesn't have diddly for evidence of a bonified relationship after the marriage. If I decide to try and help her - file jointly - I have three questions:

    1. How can I relay to the USCIS that we're in the process of divorce? SHE will be filing the paperwork.

    2. What kind of issues could arise for me? At this point, it's really between her and the US Government, but I'm essentially vouching that we had a good relationship, which obviously we didn't and there's certainly no proof of this.

    3. Anything else I haven't thought of?

  15. Hello,

    You would want to order tax transcripts from the IRS website www.irs.gov. I read somewhere that you can no longer print them directly online and would have to request them to be mailed to you. So I suggest getting on that asap. If you have the IRS transcripts (for both you and your spouse since you filed separately), then you do not need W2s. I won't even dare send W2s that show single status. So the transcripts would be the best way to go for you anyway.

    Hello fellow Visa Journeyers!

    My Green Card is about to expire soon and I am starting to gather documents to submit for my Removal of Conditions. I will include copies of tax returns.

    My questions are:

    1) Do I need to submit my husband's (US citizen) tax return together with mine?

    2) Is it just a copy of the W-2 Form they need?

    3) Should I be worried if I filed as "Married filing Separate". I have started filing for taxes since 2013, so I have that year and 2014.

    I filed both years as "Married Filing Separate" and did not claim our daughter.

    Also on my W-2, I noticed that under my social security number; on taxable marital statues, it says: SINGLE. Although my company did put my Marriage name / last name.

    I hope this does not affect us in a bad way. Our Marriage is legitimate and we are happily living together since he petitioned both me and our daughter.

    I empathize with you on your difficult situation. I'm no marriage expert and I think only you can tell yourself what you should do regarding your marriage. If your issues stem primarily from you living with his parents, then why not wait till you move in together and see how the marriage works out?

    If you're determined to no longer be married, then you can file for your removal of conditions by yourself with a divorce waiver after your divorce is finalized. You will need to provide proof that the marriage was entered into on good faith. All the best!

    Hi, i dont want to tell all my story because its simply too long.

    I just have a simple question. Is it always better to wait till removing conditions or divorce and fight for stay in us?

    We are a marriage that is real. He was coming to my country before I got here, we love each other, and the marriage is true. We already have some.proofs to show the marriage is Bonanfide. We now buying a house on both our names. Soon we will move in probabky. My gc expires in one year.

    However.. Because of many factors and living with his parents too long our love got much weaker, I don't even know if this is the way husband should be like, but anyways.

    Making long story short. We will get house in one week and now I stay in friends house for a week. I could not live with him because of parents (I know I'm not bad, it's smth about them) so I'm like this now. We are married. The marriage is hard and it's hard to say if we can get along like marriage anymore but.. We agreed to try living together. Making some rules so we can live comfortably. And here is my question. Is it better to divorce now and show immigration all the situation or try living together and see what happens even if the marriage could not be real marriage anymore. I don't say I would do it for gc it was never my intention, I married him for love. But it is true I want to stay here because here is my life now.

    My instinct tells me to try. I would like to see other people opinion, pepole who don't know me.

  18. Hmmm... It's quite interesting that you got scheduled for an interview without an RFE while filing jointly, for that matter. Just makes me wonder why. I'm sure you'll do fine since you're in a bona fide marriage. I'm just really surprised. All the best with the interview!

    Sent in an e-request that we were beyond normal processing time (October 2014 filer). They responded by sending us notice of an interview on June 26, 2015 @ 7:15 am. No RFEs. I put together a stellar package (or so I thought). The only thing we can add would photos from; Thanksgiving, Christmas, Mammoth trips and Songkran (New Years) in Thailand with the family, 2014 tax returns and we re-financed so wife is now on title to the house.

    Will we be interviewed together or separately? While my wife's English is good (she just completed ESL level 3, is starting level 4 and citizenship classes), she is shy and tends to get nervous and intimidated around strangers (our AOS interviewer was a very kind man who was nice and patient with my wife). We are a 100% bona fide married couple married for almost three years and having dated for three and half before we got married. No kids yet, just a dog and a cat.

    While it is a good sign that they are doing something with our petition, is it a bad sign that we have an interview?

    What can we expect?

    I am confused because I think I am a conditional resident (through marriage). Will I receive an ASC appointment or no?

    I think you've got some pretty good evidence going. You've got the financial co-mingling and residential covered. Like someone said earlier, no need for W2s with IRS transcripts. All the best and congrats on the birth of your daughter!!!

    - IRS tax return transcripts for 2013 and 2014, showing 'married filing jointly'

    - bank statements of our joint checking account covering 2013-2015

    - quitclaim deed of our house

    - property tax reports for our house (2013-2014), showing both of us as 'the owner'

    - shared car insurance (2013-15)

    - car registration reporting both our names on it (2014-15)

    - my husband's health insurance cards showing me as a dependent (2013-15),

    - driver licenses with the same address

    - boarding passes of trips taken together

    - statements from our retirement accounts reporting the spouse as the beneficiary

    - some water bills with both our names on them

    - birth certificate of our daughter, who should be born anytime soon :)

    I'd be happy not to have to look for the W2s unless I really have to.
