    What flight school did you go to?? My husband is waiting for his greencard (AOS approved waiting on name check) and the flight school that he wants to go to won't even speak to him till he has his greencard in hand. My husband has was a pilot in Chile. HELP any info is good!!

    I was training at teh Aeroclub at Maxwell Air Force Base in Montgomery Alabama. the flight school at Montgomery airport had no problem with me when i talked to them too.

    He should not even think about training with a school that is too lazy to understand these regulations...how well are thye maintaiing their aircraft?

    I got a little screwed up biometrics. I was supposed to get my biometrics done on the 15th.. but since I didn't receive the letter till 14th.. i got it done on the 13th already. I went to Santa Ana office on the 19th of Dec just to make sure that my biometrics are on file since it was done earlier than they were supposed to be.. and they told me that biometrics were received by them on the 14th of December, a day after it was done, and today (the 19th of december) my name check has been cleared.. I received an interview letter for Feb 13th at Santa Ana Office.

    Does this mean that if approved on the interview there would be no FBI clearing left ? Have I already cleared it or there is any further clearance required?

    Hey! Is your timeline correct? You don't show a K3 interview. Also, was it really 3 weeks between sending AOS stuff and getting an interview date?

  3. i havent been touched since 10/30 so you guys can relax!

    Just wondering did you get your EAD card without a touch?

    I got 5 emails in one day all saying the same thing...that my EAD was approved. I don't check every day so I don't know if I was touched in the few days before the email. But it certainly wasn't like I was touched a week before and then got the emails. So it could have been completely out of the blue with no touch beforehand.

  4. and as for the RFE, they dont care how much money you make, weather its a million or a hundred, they need the most recent and 2005 was the most recent, even if hadnt filed for it yet bc of complications, if they see that its not in there with the paperwork, then they will rfe for it.

    That isn't exactly true. It says that if the most recent is not available you can send a letter explaining why it isn't...which we did.

    We also sent them copies of the money sent in advance to IRS for estimated tax payments for 2005 which was over $500,000. You think they could figure out that if we sent $500,000 in to cover our taxes, we might have made more than the poverty level?

  5. i just recieved this rfe and am a little confused.

    "The petitioner or joint sponsor's income as reported on the federal tax return submitted with Form I-864 Affidavit of Support Does not meet or exceed 125% (100% if military) of the poverty line. The petitioner's or joint sponsor's current income as reported on Form I-864 or Form I-864EZ Affidavit of Support is sufficient but no evidence has been submitted as proof of the current income. Submit evidence of the sponsor's current income. Evidence includes a letter of employment from current employers and should show dates of employment, nature of the job(s), wages or salary earned, number of hours/weeks worked, and prospects for future employment and advancement. The sponsor should also include pay stubs for the most recent 6 months."

    My husband's tax records show that he doesnt meet the 125% poverty line but his letter from employer and pay stubs for this year does, so i know that they are asking for that from him.

    however, we had my father in law as a joint sponsor and even with 6 of us as his household size as my husband and i are living with him at the moment he still make almost 4 times the 125% poverty line. so surely it shouldnt matter what the petitioners tax records show because the joint sponsors records are sufficient??

    so im gonna send in what they want, pay stubs employment letters etc, but should i also send in my father in laws tax records again showing him to be way over the poverty line for his household size? (i sent in all 3 most recent years for him and my husband originally) also, do we need to fill out the 1864 again, or just send in the evidence?

    whats the point of having a joint sponsor if they rfe me for the original petitioner? seems to me they havent paid any attention to my father in laws I-864 so i might have well only sent in my husbands.

    frustrates me, but anyway would love to hear anyones ideas. thanks!

    They don't read things very carefully. We make over a million bucks a year and have net assets of four times that and sent in brokerage accounts and bank accounts etc.

    They wanted a letter from my wife's employer (she owns the company and has 250 employees) proving that she works there and "what her chances of promotion are".

    I nearly wet myself laughing at the boneheadedness of that one.

    So just send in his tax stuff again but don't send another 864. Include a letter saying that you sent all this stuff last time. Hopefully they will read it, be embarassed and do it right this time.

  6. Got married in January. Did the K3 thing. Knocked the wife up in Paris in March. Baby due next week. Takes about 2 weeks to get a kid a SSN. Me...still can't get an SSN. Managed to get a bank account and a drivers license, but it sure would be nice to get a credit card instead of using my Canadian ones.

    We make over a million bucks a year and got RFE'd cause we sent 3 years tax returns but not the one for 2005 because it it really complex and wasn't done at the time we applied for AOS.

    As a single Canadian, I could just come and live here and they wouldn't give a rat's tail. I was already spending over 6 months a year here without any visa. But now that I'm married to one of their citizens, it becomes MORE difficult????

    Shouldn't the guy wasting time on my file be looking for immigration fraud instead?

    Oh well...we are very fortunate in so many ways and it really doesn't affect us much...but one does have to laugh...

  7. I-765 EAD gets processed at Missouri, and the 485 processing time can be found at your regional office. Since you did not bother putting any info in your profile I cannot tell you exactly what the processing dates are for your case. But in my case my regional center is Buffalo, NY and they are working on cases with receipt dates of May 16.

    Thanks...is my time line not working? I put all the info in. Anyway my receipt date is Sept 19, 2006
