Several posters on here have mentioned calling USCIS to check on the status of their I-130 application. It seems like there's a suggestion that doing so can lead to an application being processed faster (ie the squeaky wheel gets oiled).
Does the petitioner have to call USCIS, or can the beneficiary call?
What does one have to say to be transferred to tghe magic tier-2 representative?
Any other magic formulas that can be uttered?

Hi everyone,
I've decided to join this thread because I'm getting a bit nervous. Husband (USC) is supposed to start new job in his hometown in the US on Jan 1, and we were hoping to spend the holidays with his family.
We have been permanent residents of New Zealand for the past 5 years (I'm a German citizen), and we have two kids who were born here but have dual US/NZ citizenship. We filed our I130 from abroad, with a NOA1 date of May 12, though our cover letter didn't mention why we were applying for a green card for me at this particular time (this may have been a stupid mistake). I was encouraged by the reports of expedited processing for applications filed from abroad, but I guess that's not happening anymore.
I'm not liking the prospect of having to stay behind with our two kids when my husband starts his job, although I know that many on here have been separated from their SOs for a while. -
The NOA1 we received a few weeks ago stated that our case was sent to the National Benefits Center, and our receipt number starts with MSC. When I check on the status of our file on the USCIS website and then use the estimated processing times tool at the bottom of the page, the only option in the last drop-down menu is 'Vermont Service Center'. Does that mean our case is actually at the VSC, or is that just something weird about that tool?

We're also still waiting for NOA2. USC and spouse both living abroad (same place) and using address abroad. Married 5 years, 2 kids. Didn't write anything in detail in cover letter as to why we're applying (maybe we should have?!).
NOA1 (receipt of I-130 app) was dated May 4, 2013. Application forwarded to NBC, acc to NOA1. After seeing this thread, I was hoping we'd hear something very soon. Have been checking the online case status, but nothing. When I use the estimated processing time thing at the bottom of the status page, it only lets me see processing times for the VSC, though.
Any thoughts? -

So it looks like one of my in-laws will have to be a co-sponsor for us on the I-846, since DH has no income in the US currently (we're moving back to the US for him to start a job). Is it possible to change the sponsorship after we arrive in the US and DH has US-based income that would be more than sufficient to be the lone sponsor?

1. Yes, ignore the K3 stuff
2. Your mixing up Affadavit of support and re-establishing domicile, they are not the same. What you have listed, plus the job offer, is enough to show wanting to re-establish domicile. However, it does NOT count for the affadavit of support, because only current and ongoing income counts, a job offer is not good enough. Your husband will need to sponsor you on assets (x3 income needed for your household), or find a co-sponsor.
Thanks for your reponse. So we can't use his current income in NZ or the income attached to the job offer for AOS?

I'm a German citizen and permanent resident of New Zealand, and my husband is a USC and permanent resident of NZ. We got married in the US a little over 5 years ago when I was an F-1 student there. We initially filed for AOS to permanent resident for me, but abandoned the application because DH accepted a job in NZ and we moved here (2008). DH has now accepted an offer for a job back in the US, starting Jan 1, 2014. I've just sent in the I-130 package to the Chicago lockbox and received the email that it was sent to the NBC and was given a receipt number.
I've been trying to read up on what the next steps are, but was wondering if any of you could clarify a few things. Please forgive me if the answers are hidden in plain sight, my head is kind of spinning from reading everything tonight.
1. It looks like the K3 process is a waste of time/money. Should we skip this step? I tried to find the processing times at the NBC for I-130s, but couldn't find any answers. I'm very anxious to receive the visa before my husband leaves for the US in Dec, because we have two small children that would have to stay behind with me until the visa is approved.
2. Any tips for filing the Affidavit of Support from a USC who intends to re-establish domicile in the US? We have a checking account and a credit card in the US (using my MIL's address), and DH has a current driver's license from when we lived in the US for 6 months in 2012, but it's not from the state we plan to move to. DH's parents also live in the city we intend to move to. Would this be enough evidence to show intend to re-establish domicile in the US? Should we supply pay stubs from his current job in NZ and/or NZ tax returns to prove his current.3. I was looking at LingChe's shortcut for NVC processing, but it seems to be geared toward applications where the petitioner is based in the US. Can/should the shortcut still be used when the USC is living abroad?

We filed from abroad and the NOA1 said it was sent to the NBC in Missouri (MSC file number) but I'm not sure if it would have been moved to the new service center in Kansas.
Thanks for the responses. I guess there isn't much of a point in calling until at least some other May filers have gotten their NOA2s....
