    Please tell your roommate that she can never adjust status through him. She can only adjust through her K-1 petitioner, and that ship passed a long time ago.

    The only way he can make her legal is through marriage, a hardship waiver, and interviewing for an immigration visa in her home country. She could end up being banned for 10 years.

    Things to think about.

    To tell the truth I cant stand the lady,

    I moved into the house 6 years ago and the owner of the house rented rooms to people and I happen to rent one. He likes Filipinos and would fly over for a few weeks a year. He met one lady and was doing a K1 with her. That was going good until the lady at the Doctors app. said she tried drugs before and was declined. She found someone that would give her a new Identity(stupid as stupid can get). She had everything changed to the new name and even went to school to be a nurse with the new name. Then my roommate married her in the Philippines, and they tried to get a spousal visa. They were doing good until the interview and they asked her if she has been to the embassy before, she said no and they asked again, lol. Lol, it does not take a genius to know that once they get your fingerprints, there is no fooling them.

    Well, he finally realized that he wont be able to sponsor anybody else for a visa and he found his current girlfriend on the internet via website for dating.

    It was a huge coincidence, that I happen to met my future wife on the internet and we also did a K1. After my wife arrived in the US last year, she to could not stand the Girlfriend,

    Luckily, my wife is in Washington now and I will soon be relocating from Chicago to Washington in 4 days. I really want to turn in the lady to immigration as she really pissed off my wife and me. The roommate is still a good friend though and he knows he cant marry her and he basically just wants a companion when he goes to the bars on the weekend. So, I probably wont say anything and will be glad to be back with my wife and our baby boy.

    also, she wasn't paying for a new appointment, you don't pay for the appointment, probably they has to refile the whole adjustment of status packet, maybe minus the i130, who knows

    the I485 costs now as you know, $1070, back then it cost a lot less

    Thank you. Glad we got it finally. My wife travelled back to Malaysia to have our first child and I was a tad worried that something would go wrong while she was over there. I went over and we had to get emergency passport for our baby, as the passport agency was having issues , at least it was free and we made it back to the US with no other issues.

    sorry, she's partially right, you're wrong

    the purpose of the K1 is to marry and get a GC through the person that filed for you, AKA your fiancé, nothing has changed it has always been like that since it was created

    if it doesn't work out and you don't get a GC through your spouse, you have to return to your country or remain illegally in the country

    you cannot remarry and adjust status with another USC, overstay is not forgiven and it is on you if you don't return, the K1 visa is very strict on that

    the ONLY purpose of a K1 is to enter the country legally, marry and get a GC through you fiancé and later spouse

    now what she is talking about is removing conditions. Once you have your 2 year GC, if things don't work out and the marriage was in good faith, a person can divorce and remove conditions to get the 10 year GC

    two separate issues, one before you get a GC, there is no other way to get the GC, but through spouse who petitioned the K1

    once you get the 2 year GC, if things don't work out, you can divorce and file for removal of conditions on your own to get the 10 year GC, providing evidence that the marriage was in good faith

    I have no problem being wrong, lol. I'm used to it, hehe.

    But, it is possible to be divorce before you get a Green card, If you Don't have to have an interview and you are approved before the divorce. We were approved 6 months ago and were told we would not have an interview. But, I would say that would be very rare that someone would get a divorce and not have to have an interview.

  4. I have a Roommate who is dating a lady from the Philippines that is illegal, her story to me sounds very fishy. Anyways, we are at odds on what she thinks is corrected and my experience doing my and my wifes K1 visa, which we just got her Green card in the mail today.

    She says that when she arrived on her k1 visa, ten years ago and got married and filed the AOS, they were a hour late to the interview appointment and in doing so they were declined and had to resubmit a $700+ payment for a new appointment and at that time they could not afford to get another appointment and she left the guy and got a divorce. Since then she has been in the US illegally, working. She cant even get a drivers license for illegals, as she has a SSN and they recently denied her.

    I told her that somebody coming to the US on a K1 and if they get married and it doesn't work out, that person could continue with getting their green card, even though they are no longer with the person that they married. She told me that ten years ago that could not happen. You had to be married for 2 years and if at any time you got a divorce, then you had to return to your country of origin. I say that is not true.

    The way I see it, as long as the couple tried to make a good marriage and it does not work out then that person does not have to return to their country if they decided to divorce.

    I think she screwed up big time, 10 years ago and something about her story just does not make a lot of sense, from all that I can get from her. I tell her what we have had to do and she has said that everything back then was different then it is now, which I don't think its that different then now. I think she just does not know what she is talking about.

    I, on the other hand, have no attention of getting a divorce with my lovely wife and we are proud parents to a 2 month old boy.

    So, my question, have the rules change a lot in the past 10 years or so?

  5. Just an update

    We went back to the Elgin, IL office this morning to get her name changed and we were questioned again about getting a SSN and how we violated procedure and that the other office that gave us a SSN did not follow procedure. The lady even said that they get a lot of people from other offices, so that they can correct the mistakes they have done and she was going to report the other office to the regional office

    .

    Again, we explained to her what we were entitled to and what we wanted to have done and she took my wife SS card and the form and said we would get it changed card in a couple weeks.

    So, if anybody lives in the Elgin, IL area AVIOD the SS office and save some time and drive to Aurora, IL, What it takes to drive there you save in waiting and hassle

  6. You do not have to get a green card approval in order to get an SSN. A K-1 entrant should get the SSN soon after arrival while the I-94 is acceptable to use in order to receive an SSN. You should get it in your maiden name because that will match the name they have their system from you getting the K-1 visa.

    If you did not get the SSN in time, or the SSA worker gives out misinformation(like many of them do) you are able to get the SSN with the EAD, which you should have applied for along with the green card. The EAD will be received 60-90 days after applying.

    Also, you cannot claim a spouse as a dependent on your taxes. They are your spouse, not your dependent.

    That's what our moronic local SS office told us too.

    We went after we were married and we were told since we were married we were no longer a K, our status changed and needed to wait until we were approved for a Greencard. They did say that we could have got a SSN before marriage. Anyways, they let us fill out an application for SSN and said that if its denied, we would receive a letter about 7 days and if it was approved, then they would send it to DHS to get an approval from them and it would take about 120 days.

    Last Friday we received a letter, which was just 3 days, stating it was denied, probably the local office did not even send it in and even if they did, they did not even want to see our I-94.

    But, no biggie, Friday morning we went to another SS office and told the lady what happen at the other office and she had no problems giving my wife a SSN.

    go back on monday or tuesday,

    and get the number. they won't have the card for you (they never do) but they will have the number,

    or

    you learn of other silliness on monday or tuesday.

    I do hope you were adamant about a lookup in the SAVE database on Visa Name and/or A#.

    I was thinking of going to Elgin office after we get the card and to get an name change and to let them know how stupid they are. But, my wife said not to make ones self feel superior to single cell organisms.

  8. We went to another SSA office about 30 miles away today, which was bigger and quicker. After waiting about 10 minutes we were called up and at first we just explained that we were doing a k1 and we needed a SSN. Then we explained further that the Elgin office denied her but could gives us a reason as to why we were denied and we explained we were married and that was why they were denying the SSN.

    The lady did not seem to mind and proceeded to type our info into the computer, and she gave us a letter stating that we would receive a SSN in two weeks. It will be in her maiden name, which is ok.

    So all is good, for now.

  9. I just got off the phone with the SSA and the lady was no help, she could not find a policy for k1 visa.

    If anyabody reads this can someone find a ssa policy regarding k1 visa and marriage. They(Elgin office) keep insisting her status changes after we are married and we need to do the AOS before she allowed to get a SSN.

  10. Curious, did you apply in her maiden name or her new married name? When my wife applied for her SSN, before she filed for AOS, she applied in her maiden name, which matched her I-94. From our discussions with the SSA person processing our application, the name on the SS-5 has to match the I-94 as they need to cross-reference in S.A.F.E.

    The office told this would be fraud if we tried to get her a SSN under maiden name after we were married

  11. They are letting us apply for one, and they told us that we would probably get a denial letter in 7 to 10 days, if they don't then it will take up to 120 days to get answer.

    I asked them to show me the policy for what they told me and they can't do that now.

    This is exactly correct!

    We went through the same thing! When my now wife, came here she was her maiden name, under her I-94 which is good for 90 days.

    We waited until we were married then went to SS office. There was no record of my wife with her married name. We had to wait until she got her EAD/AP card, and then we got her SS card in a couple of weeks!

    I have said here many times.,.,.,.,.as soon as you un-pack, go to SS office and get your card on your maiden name before you are married, then.,,.,.after you are married, get a name change, with your "certified" marriage license

    That's not Correct and it really does not make sense when you think about it.

    So, if this was correct then a man migrating to the US to marry a female could in reality go to the SSN and get a number at anytime, before or after marriage, since he does not change his name. It should be the same for a women. It should not matter if she changed her name or not and in fact, every document we had had her name as it appeared on her I-94, including our wedding cert. the only place we had had her married name was on the SSN form to get a SSN card.

    Tomorrow we will have a print out of everything we have found in this thread and hopefully they will learn that a k1 does not become a k3 after marriage, like they told us today. And hopefully this will help future k1's that come to the Elgin office for their SSN.

  14. It should not mater from what state we apply, its not a state issued agency, its federal.

    In the denial letter they gave, they listed the reason as

    No proof of US citizenship or lawful aliean status.

    So I tried to tell them she is here on a k1 and we are still within our 90 days. She arrived sept 12, we were married October 10th. They saw her passport, they never checked there system. She is here lawfully.

    Tomorrow we are going back and to ask for an SSN under her maiden name, then we will just ask for an he name change at a later date, I guess.

  15. My Fiancée(wife) came over on a K1 visa and we were married about 4 weeks after she arrived. We went to the SSN because they said she was married and was no longer k1 and now they say we must wait for AOS before we can get SSN.

    Is this correct? They said she could have received one before she was married, but now we must wait. This does not sound correct to me.
