Well in order for him to come under the K2 he has to come within the year your husband POE and you will the have to file adjustment of status for him as well and wait for his green card to arrive before he could travel. If you decide to do that once he has his green card you could ask for a special permission for him to go back to DR and stay for a while. I am in the same situation but i will not be bringing my stepson since it is more expensive to adjust status and he needs to stay with his mom for a longer time. We will later petition for him to come. Hope this helps. As per him just visiting I doubt you could get a tourist visa with a pending K2.

    How long does it take to get the approval after you sent the RFE? Can I ask what is the RFE about? I am waiting for the waiver for 5 months now. Feel like taking forever!

    thanks!!! after you respond to an rfe they are suppose to take 60 days to make their decision but I had to submit an inquiry bc the 60 had passed and it took them in total 78 business days to make the approval. Since I submitted the waiver on my own and I thought the letter from my fiance was enough they wanted more information. A letter from me, my monthly expenses, work paystubs, a letter from a doctor stating how him not being here is affecting me, and I also submitted our sons birth certificate and a letter from my mother. Also I had to show he did not have a criminal record here. I felt like it took forever but don't lose hope. If this is your case that you have an rfe it hits day 60 and no response submit an inquiry asap

Hello just wanted to say my I601 was received on april 8.I got a boiler-plate rfe in july 26 turned in on aug 26.Uscis said I should be receiving a response within 60 days which leads me to believe it will be around Oct 8.It is very similar when I did my I 130.Good luck everyone its not eazy going through this process.

    thanks for the info.. I hope I get it before the 60 days since I have an open interview at the embassy that will expire nov 25.

You have to express your hardship in the I-601... the spouses have to show how they will suffer from both sides, In addition, they are asking for your financial information, so that you can prove hardship on your behalf, being the reason why you need him to come home...If you expressed depression or he mentioned you suffer from any type of medical problems, you have to get the proof of that, I went to my doctors and had them pull my medical records which showed what they diagnosed me with and what medications I was put on at the times. Sounds like they are looking for the hardsship from your end verses his, if you get the proof they need together and send it, I bet you get a response in like 10-15 days, most people that have sent in the RFE's get the approival really quick...you may want to seek legal help, if you dont already have it. good luck! and dont loose faith.

    I am stressed but I do not go to a doctor bc I do not have time and do not want to be on medication. They make it very difficult. I have everything else but the medical letter. I mean god do they want everyone to be on medication in order to prove extreme hardship. I'm drowning in bills what more do they want and a baby without a father.

  5. received my fiance's rfe letter and it is a long one. They want a statement from me describing that his denial will be extreme hardship for me, also letters from doctors my financial information, IDK what else to do. What else do thay want me to do. they want me to send his criminal history from the us?/??? he's out of the country. He wrote a long letter and they want more. How else could I prove extreme hardship

    I'm just done with all of this... :((((((((

  6. Yes I have seen at least 1 March approval that was not an expedite....many Feb filers are approved...mine and the case numbers all around mine are mostly approved.

    Sadly there are always cases that take much longer....I feel terrible for those waiting since last year...Good luck to everyone. Don't believe too much negativity you find on the internet and be positive.

    Im glad to hear some have been approved! im an early march filer hope to hear something beginning of july or just before august! thanks

    Ooo ok, I got you, and I I understand your saying the visa appt date was like November 25th of last year? So you have till November 25th of this year..I have seen many with that issue, what they do is make you may the visa fee again. To my understanding, and do the update of sponsor paper work. After 6 months you have to redo medical and criminal records, anyways.. I know it makes it harder...I think you will be ok though, I am seeing a trending 6 month turn around now...Good Luck!

No, they don't expedite, if there is one pending...mmm not sure what the applicant would have pending...In order to file the I-601 you have to have been denied the visa, and on the letter the immigracion officer gives the applicant it states why he or she is not eligible to enter the united states, and what waivers he or she must apply for. The I-212 is for people who have been in the U.S. that were deported...Or signed a deportation waiver and left under some sort of grounds of deportation. Those are the people who have to file it. The Officer will know when he pulls the record at the visa interview whether or not that he/she needs this.

    That is the reason why I filed because we were denied and I was told we needed the I 601 waiver by the embassy. What I meant by Pending meaning that we have until Nov 25 to get this waiver approved and submit it to the embassy in the dominican republic if not I will have to start all over. His petition is on hold. it was refused not denied not sure if that makes a difference

  9. He could only do one minute calls at a time and I think it's like 50 calls so it's really not worth it if your going to just use it for that. I used another website just like boss but it was just too expensive and a limited of time, I love that I could go whenever I want and he could speak with our son etc. It does have the calls that have been made to that cell phone number.But whatever works for your :)

  10. I have a question to all those that have met via social media or per say online!! How long did you guys waited before deciding filling for a K-1 Visa? I ask this question because I met my fiancé through Instagram, back in November 2014, from day one we have been in contact 24/7 since, I met all his family in NY. I traveled to the Dominican to meet in person in March 2014, I was there for a week and he proposed… I don’t have the funds, the schedule or time ( I’m a single parent of two beautiful girls and just started a new job) to travel again before I summit my petition. My concerned is, if the fact, that we have known each other for such a short period of time may raise suspicions, since we have only know each other for 6 months. I’m debating if I should wait a few more months or should I sent the petition. I love him and we can’t wait to be together and I feel the longer I wait to send it, the longer will take for him to be here. Anyone in the same or similar situation??
