I think there are 2 separate issues.

First for your drivers license, I don't think you need to show your green card to them. Technically I recall (esp in NYS) you need to prove identity with several documents the first time applying, however after you get your license or state id, then you just take that as you don't need to prove identity again. I would go to the DMV and say you need to renew and see what info they would need. (They may not need anything)

Second for I751 approval. I would schedule at a different office for extension. I would think even though your field office is booked, going to a diff office should be ok. I would think they see your case in their system. For example, if you had to move during the case being processed, then they should have a process to account for that. 

I don't think it hurts to look for help at your local congress representative. Most have a link on their websites for immigration assistance.

Has anyone experienced this issue?

I am USC and sponsored my parents while they were in USA. Sent in I-130 and I-485 for both, with one set of all supporting documents (ie birth certificate copies on one sheet, passport, etc).

So far only one of them was fully approved (both I 485 and I 130) with card being mailed (waiting to receive), while the other still has no activity.

Any thoughts?

Can you submit G-1145 E-notification of acceptance with the I-751? I did not see it on uscic as part of submission of document options so just wondering if folks did.

I think the lawyer needs to explain what he needs. From above, the proof is the 1099 from Fidelity, and you can include the Social Security receipts. Basically the documents used to create the 1040.

On the Green Card we have her middle initial as M (for Maria). On her social security card (the one prior to receiving green card stating work authorization valid with DHS authorization), they wrote her full middle name Maria...

Now on her new Social Security card it reads only with her middle initial (exactly how written on green card). Is this normal? Is this how other people have their social security cards as well?

K1 petition to be approved took us about 5.5 months and another month to make it to interview stage

Adjustment of Status took about 6 months (and others waited longer/are still waiting)

Removal of Conditions current timeline is 6 months...and I'm guessing will be longer 2 years from now

US citizenship processing is prob going to be close to a year

The I-693 process is confusing, generally speaking. I read posts that some people sent in their DS3025 papers they obtained overseas and had no issues, however I also read other posts that other folks encountered issues.

To circumvent these issues we located our nearest civil surgeon, printed the I-693 form and asked the surgeon to fill out page 1, and page 5 to transfer the vaccinations from DS3025 onto I-693. In addition they informed us an add'l vaccine test was necessary, to which we performed.

They then provided us back a sealed envelope labeled "for uscis only", in which contained page 1 and 5 of the i 693, with updated vaccine form onto which the box "all vaccinations complete" was checked, a copy of the supplemental blood work, along with copy of old DS 3025 evidencing medical test was performed within the year.

We did not encounter any issues and were approved.

o Sponsor Employer Letter to Evidence Salary

o Sponsor IRS Tax Return Transcripts 2010 – 2012

o Sponsor W-2 and Most Recent Pay Stubs

That's definitely good news! It means processing is moving along. Hopefully, we'd get something soon too! (Our Field Office, Saint Paul MN, is stuck at August 20, 2013 as of January 31st 2014!)

Why would local field office processing impact us who got interview waivers?

Did your status on uscis website change to approved or did the green card just show up in mailbox (similiar to the interview waiver)?

Our 485 was accepted on October 30, 2013. We received and completed biometrics, and have also received our EAD with the travel permit on January 03, 2014. However the Case status for the 485 has not changed from "acceptance" and is being processed at the National Benefits Center.

It has been 120 days since our application was accepted, and we've heard nothing. Is something wrong?

Ours was accepted Oct 3 and has been in acceptance as well for now 148 days. I read in the forums that this is common and it will change to once approved. I'm not too worried about it, we got the EAD/Travel documents, and interview waiver so I'm sure it's in queue.

If filling for one applicant $1070 covers I485, I131, I765.

What time of day would approval notices be sent to email or text msg? Our EAD approval came in the morning and now anticipating when AOS approval will come :- /

If they left AOS was abandoned. If they use anything issued in error it will catch up with them later and all benefits gained will be revoked. If it doesn't catch up at AOS or ROC they will find it at citizenship where they really check into everything . Do NOT advise people to bend immigration law.

You know, that's a great point you make. It may get caught in ROC or Citizenship. I personally would still look to an immigration lawyer, and to schedule an infopass appointment to get better answers before making a final decision.

OK, so, here it goes.

We went through the whole K-1 visa process, got married in the US and filed for AOS, EAD and AP within 90 days timeframe after entering the US (NOA1 received without the 90 days, if that matters).

I (the fiancee) had to travel out of the US about 1 month after 90 day period was over and obviously my visa had expired. I called and asked to expedite my Advance Parole application before leaving, hoping they'd approve it and my husband could send me the AP card. But I had to leave before we had the answer from USCIS in the mail asking for proof of emergency.

I assume our AOS will be seen as abandoned now and we'll be sent a denial. My husband and I are devastated with not being able to see each other and be together, so we are here, asking for your help, VisaJourney members.

Our questions are:

1. Is there a ban after leaving US with about 1 month of overstay (while adjusting status as a K-1)?

2. How do we go about our AOS papers? Do we call USCIS and ask them to cancel the application because I left US or wait for the denial notice in the mail? How long does it take for them to mail the denial?

3. I assume our only option to be together in the US is filling for a spouse visa IR-1. Can we start the process now not waiting for the denial notice for AOS?

We are also considering other options, but currently it's the only one we give any serious thought to because of work situation.

Contact an immigration lawyer before withdrawing your AOS. I read posts where a similar situation occurred and after 2 months the person's AP card come in the mail, had it sent to them and was able to enter without issues. I personally would try this, and if it was an emergency to leave I would gather the evidence to show this.

Don't act just on this forum, get professional consultation.

I think two things stand out to me, and one suggestion:

1) Certified translation of your birth certificate (you can do this yourself, take a look at USCIS website for certified translation requirement)

2) You may want to prevent having issues with your medical form by having a civil surgeon transfer your DS 3025 onto part II of the I693 and sign it and have you send it back in sealed envelope with your AOS package. We were going to use the copy of DS3025, but went to civil surgeon and he said we needed to do add'l test for varicella as our DS 3025 box was not checked that everything was complete. All this cost us $70 so may be worth it to prevent RFE.

3) I would provide the last 3 years tax return (I guess you don't have to, but we did)

I am unclear of your question.

To the Interview you must bring your petitioner's I 134 Affidavit of support (along with required evidence Tax Return, Bank Letter, Employment Letter), your approved NOA2 K1 petition, birth certificate and copy, Sealed Medical envelope, and proof of relationship. There is an additional affidavit which you can use the fiancee's assets as well, but we did not pursue that option.

So in general I think from what you listed you are ok. I would also recommend to call the embassy and clarify your questions.

Haven't seen any recent posts coming for Oct 2013 filers. We're interview waiver since 1/10/14 and still no new activity. Anyone else in same situation?

I am a US Citizen living in Romania. My Romanian fiance has obtained her K1 visa.

We are moving to the USA this year.

* 10 days after arriving, we will get married.

* 11 days after arriving, we will file for AOS and EAD using her new married name.

* 14 days after arriving, we will apply for a SSN using her new married name.

How do we ensure the Social Security office will find her in the system and properly enter her application using her new name? I called a local SS office and they said they wouldn't be able to do it until Immigration had updated their system with her new name. Is this true? How long does it take?

Also, her Passport will still retain her old name. How do we update this and when does it need to occur?

10 business days after arriving go to SS ofc and apply for ss card in maiden name (This is to ensure immigration systems sync up)

2 weeks later you receive in the mail the ss card get ss card

Get married

Married +1 Day file for AOS and can go to SS Ofc to change name on SS card. Note at SS ofc it may take them up to a month (it did for us) as they sent papers to immigration to have them change it in their systems.

We got our work and travel authorization and now continuing to wait for AOS approval

It's pretty straight forward.

Just got a Notice of Potential Interview Waiver Case today. "We anticipate that delay to be approximately 6 months from the date of this letter". Hoping it's earlier and ready for the process.
