  1. Hello Everyone,

    We applied form 1-751 form to remove conditions from my husband green card.  USCIS received it on Nov 25, 2019 and they send us an extension letter for 18 month. My husband's green card will expire in Feb 2020.  We have a travel plan that will require us 6 weeks outside USA. i read other posts says they used that extension letter when traveling with expired Green Card. We never traveled and kind of worried if my husband will face any issue when we come back . other concern is the processing time. i checked for Nebraska is over 15 months. will it take that long?  What if they send us requesting finger print or additional documents when we are traveling, what can be done?

Thanks again for you all.. i gathered up many docs to get prepared, all our wedding pics, utility bill, bank statement, he was added to my credit card and phone bill but his name does not show on the bill it just in the activity page, does that work? also i have so many pics from places we went in USA like our honey moon and vacations and so on, should i print those too? we also had IVF done ( trying to have a baby) i have doctor paper, should i take this also? 

    I bought my house before he came here and its paid off but we live in. so we don't have like rental or mortgage paper, does that affect anything? 

    What else should i get?

    They asked for his medical saying ( if not submitted ) he submitted that in the airport when he first came in over a year

    also they asked for the afidavid of support ( if not submitted ) we submitted that in his I485 form.  Are we ok on that or should we get that again?

  3. Hi All,

    After so long wait, we finally got a letter today saying we have an interview on Nov 14th . We are excited but nervous at same time as we do not know what to expect at the interview, in the letter they have a check list like the medical ( if not already submitted) well,, its already been submitted more than a year ago, i don't know if that's ok or we need to do a new one. Also they are asking for all kind of documents that was sent to us from uscis and we sent to them like prior marriages,birth certificates, citizenships and all proof that we are married living together and proof of job and so on,, it is overwhelming . We still have some time to gather all evidences but need some advice.. please help! thank you. 

  4. I had similar experience here in colorado . I was told because i didnt have the work authorization at the time i would have to go thru the save system. It meant going to a different dvm office with my original marriage certificate ssn ead and the noa's from immigration (which they made copies off). I was told it could take up to 8 weeks but mind took 2 weeks. I was then given the ok to get the learners permit (although i had been driving in my country and all over the world for 30 years)....

    yes, they made copies of all the documents my husband took with him, its been a week for us so hopefully it wont be long,

    I am a US citizen wishing to start the K-1 fiance visa process for my fiance & I, but I have a question. I am 5 years older than him & am wondering if that'll affect our processing at all. I'm 24, and he's 19.

    Please don't judge me about our age difference because that's quite frankly our business. My question is if that could be a reason to not be approved.

    Age cap is not an issue , a friend petitioned her fiance she was 15 years older than him and he came here.

  6. When i applied for my SSN it got approved immediately but SAVE said under review so I don't know how accurate SAVE status's are... I would call the head office in the state you live in and just ask them they can tell you the status of it also... Thad how I found out that I got approved I called Virginias head DMV office customer service number and they told me it was approved

    This is who i called today and she said that, she told me to keep checking online until it is approved there is nothing that can do about it.

  7. Question on REF.

    I am a USC and submitted an I-129F for a K1 finance visa with all the necessary documents and photo evidence of meeting my fiance in the last two years cos I travelled to visit her in Nigeira in May 2016 and was there for 10days. I also submitted my divorce decree to my ex I was married to for 14yrs and have been divorced now 4 years. Although I was previously married to a Nigerian woman for just a year prior to coming here in the 90s but that marriage was terminated way back in the 90s before marrying my former ex. Though I didn't talk about that previous marriage in my I-129F form. But did in my I-130 before I became a USC almost 23yrs ago.

    Now I got an RFE for the following:

    1.Provide legible divorce decree of marriage (s) between you and the beneficiary signed by a judge. My fiance has never been married.

    2. Provide US Passport with identification page and stamped page of visit to meet with beneficiary with two years preceeding the filing.

    Question is since I didn't talk about the previous marriage in the 90s before my ex on the I-129F form and I only talked about my divorce to my ex, should I include both divorce decrees of all previous marriages or just send back a nortorized copy of the last divorce to my ex?

    Should I make copies of stamped passport showing evidence of visit to fiance and get it nortorized?

    Now if I send copies of the prior marriage before my ex which was not mentioned in my I-129F form, will that jeopardize any chances of approval?

    Help needed before responding to the RFE. I will really appreciate.

    From my case, i was married to someone for like 3 month overseas (2nd marriage), that marriage never got registered here, i applied for him i130 but then cancelled it because we decided it is not going to work for us,I did my divorce to him overseas.

    When i applied for my current husband, i only submitted marriage/divorce decree for my 1st husband of 15 years which i petitioned here and he is now a US citizen. the second short marriage was not mentioned and lawyer told me since it was not registered here in USA you do not need to mention anything about.

    Give embassy your ex divorce that you got from the court in USA. ( that's what i submitted)

    The nightmare of waiting is not ended for us, with every step we have to wait and wait and wait, My husband went to get his drivers license after he received his EAD last week, the lady there tells him they have to submit paperwork to verify his case and she gave him a case number to check on uscis.gov/save . It has been a week already and that case keeps saying under review.. I called the DNV and they tell me some people takes them few days to verify and some weeks or even months..all this for a driver's license?? she goes we can not do anything unless home security verifies the case. Even with the EAD that my husband received in the mail and took with him ,they will not accept until his case be verified.

    Has anyone been in this? we are in Michigan, i do not know if this applied in all States.

  9. I think you should ask to the lawyer. because is you didn´t file the I-131 when you introduce you papers then your card will never say that you can travel. Is presented at the same time, this price is included.

    If this is an emergency, dont waist time and determine if you fill it or not and in case of not, then go for it even in emergency it is not that fast to have it approved, now i think that you have to pay us$ 360.( not sure if you have to pay Biometrics again).

    I asked my lawyer he said we did not apply for it because it was not needed at that time to file.( i mean no one know what tomorrow will bring) i was like you should filed it since it was free and it wont delay the process of the EAD and we do not have to run into this now and end up paying $360.

    For us not only paying $360 but also paying for the lawyer to file it again and yes we might pay for the Biometrics,,its a mess.. , so most likely we are not going to do anything until we make sure his father is in critical condition and hospitalized so this way we get get a letter from the hospital with his conditions. I pray to god his father be well and when my husband gets his green card we can go down with a safe return back.

  10. If your husband do want to get an Emergency Advance Parole he should not call USCIS. He should go to your local office ( he does not need to make an appointment) and bring:

    Evidence of the emergency (letter from the doctor treating his father)

    AOS case number

    2 passport photos

    A check for $360 if he has not filed for Advance Parole

    If granted he will receive the Emergency Advance Parole right there and then and he can leave the country immediately. When he comes back he will (most likely) have to go through secondary as I was told this is routine procedure. Be prepared that being in secondary can take a long time which is good to keep in mind if he has a connecting flight. I was in secondary for almost 2 hours.

    So he does not need to make an appointment and go as walk in? oh wow we will have to pay $360 while our lawyer could of filed it along with EAD. Thanks for the helpful info.

  11. In a way wrong. If you have issues with your case then yes it is not recommended to travel. But if you have done it the right way (for exampled adjusting from a K1) the they expect you to travel and you shouldn't have any issues with it whatsoever. This is at least what I have been told by USCIS (not customer service, actually going to an info pass). It's when you stay out too long that you'll get in some serious problems.

    It is the Emergency Advance Parole you can only use in emergencies. Regular Advance Parole is for travel anywhere you want, you don't even have to state a reason on your Advance Parole application.

    yes, we worry about my husband leaving outside USA because we been thru alot and we dont want to take chances, Thanks for sharing

  12. on average 90days from them receiving it... but if an emergency came up with a family member you can get an info appointment show proof of emergency and get an approval immediately... Remember to send acopy of your NOA on your I-485 so its free

    Good Idea. My husband dad is not doing well and my husband is worried his dad might die before he get to see him again. Will see if we can get a proof of emergency and try to get an approval sooner than 90 days.

  13. Neither you need the advanced parole to leave the country until you get your green card ... If you applie for EAD and the AP at the same time then it will come as a combo card and it can be used for leaving the country but if you only applied for the EAD and not the AP then no it can't not be used to leave the country

    I am not sure if my lawyer applied for the Ap along with EAD, I will check with him, Thanks for your reply.

    Last night i got a notification and when i checked it said

    New Card Is Being Produced

    On August 4, 2016, we ordered your new card for Receipt Number MSCxxxxxxxxx , and will mail it to the address you gave us. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

    Will we get an approval letter ? how long will it take till they mail it out. We are so happy we have some relief .
