Contact an immigration lawyer before withdrawing your AOS. I read posts where a similar situation occurred and after 2 months the person's AP card come in the mail, had it sent to them and was able to enter without issues. I personally would try this, and if it was an emergency to leave I would gather the evidence to show this.
Don't act just on this forum, get professional consultation.
Thank you for your advice. I really appreciate you trying to help. Whether we contact an immigration lawyer or not, it still boils down to USCIS rules - leaving without AP is abandoning the application. I was thinking, perhaps making a K-3 visa would be quicker (maybe couple months shorter) and we'd be together.
I left because of my own health, but not sure if the documents we have would suffice for the emergency AP. Really sad right now.

Thank you for answers, everyone.

OK, so, here it goes.We went through the whole K-1 visa process, got married in the US and filed for AOS, EAD and AP within 90 days timeframe after entering the US (NOA1 received without the 90 days, if that matters).I (the fiancee) had to travel out of the US about 1 month after 90 day period was over and obviously my visa had expired. I called and asked to expedite my Advance Parole application before leaving, hoping they'd approve it and my husband could send me the AP card. But I had to leave before we had the answer from USCIS in the mail asking for proof of emergency.I assume our AOS will be seen as abandoned now and we'll be sent a denial. My husband and I are devastated with not being able to see each other and be together, so we are here, asking for your help, VisaJourney members. Our questions are:1. Is there a ban after leaving US with about 1 month of overstay (while adjusting status as a K-1)?2. How do we go about our AOS papers? Do we call USCIS and ask them to cancel the application because I left US or wait for the denial notice in the mail? How long does it take for them to mail the denial?3. I assume our only option to be together in the US is filling for a spouse visa IR-1. Can we start the process now not waiting for the denial notice for AOS?We are also considering other options, but currently it's the only one we give any serious thought to because of work situation.Thank you for your help and support, guys!

I don't think request for expedite will delay your case. If its approved, you will need to go to the medical exam (it's nothing to worry about by the way) and go to the interview.
Just read more on the forums about medical exam in your country and interview to get yourself acquainted with how its done in your country (every country is a little bit different).
On a medical test they will ask you if you had or have this or that and I don't think depression or panic attacks would prevent you from getting a visa, but you might need to show a proof of treating it.
On an interview that should not be a problem as well. But, if you get all nervous how you are going to pass the interview and go to the Embassy with panic attacks? Put your health on a first place and get some treatment if you are suffering.
Personally I see from your posts that you are very anxious. Your process goes very fast comparing to others. Request for expedite won't significantly affect the timing of processing, if its denied. So the application will be processed as it normally would.
Now for your panic attacks and anxiety and hair loss. If you have them, go get some help - from a doctor or psychotherapist because immigration road is not an easy one and you will need all the strength and calm nerves to get through it.
For now, what you could do to get some relief is to walk on fresh air more, maybe forests, nature, sea whichever makes you calm, eat good food - vegetables, fruits and meat, don't drink coffee, strong tea or pepsi and its analogs as they contain caffeine and you get agitated more easily. Get to do some exercises, whichever you come more comfortable with, especially I would recommend yoga. For calming your nerves, do meditation at least 3 times a day for 15 min.
Take care of yourself and your stress, as if you won't be healthy there's no way you could get through immigration. The K-1 visa is pretty straightforward from other ones and there's not much unpredictabilities. Get yourself acquainted with the posts on forums of your country and medical and interview processes, this way you'll see and know there's not much to worry about.
Good luck on your journey to recovery and immigration to live with your loved one!

We read thru the posts on the forums, and we saw how some people applied for EXPEDITED advance parole in person, or thru the phone.
We sent the AOS packet with the 131 early january, and got the NOA for all that jan 26. As my wife wishes to travel by end of this month, we wanted to expedite the AP, so we went to the local office in person, after making the info pass appointment.
When our turn came, the officer at the window said that expedited APs cannot be done in person. We asked the man, 'are you sure? we know of cases where this has been done in person.' And the man said, 'no, this needs to be done through the mail.' We left and proceeded to call the 800 number on the notice 2 different times.
We spoke to 2 different agents, and after they read a script of how you can qualify for an AP, then they ask, how can they help. We asked if we could expedite the AP, and two different people on the phone told us to mail in the form as instructed on the instructions for the 131. We asked if we could do it over the phone, and both of them said no. We decided to call again next day. By the way, so sit in and navigate through all the options, takes about 10 min...
We called again today, and this time we spoke to an agent that after reading the same script that we got read yesterday, said: 'do you qualify for an expedited ap?' we said yes. Then she said, 'which of the following reasons do you qualify for?' We then said, emergency case. Then she said, "to expedite the ap over the phone, i need your receipt number and alien number." we gave those details and then she said, 'give me a brief reason why this needs to be expedited. If we need more proof, we will request it from you.' We gave the brief reason, she gave us a number as a reference for the call, and that was it.
Now, to get to the agent, we went through the following menus:
-When you call the 800 number that is in your NOA, you first choose 1 for english.
-in the next option, we select 2, which is to report a problem.
Then it says, 'if you know your receipt number, press 1' We pressed 1, and then you have to dial in your receipt number that starts with MSC....
-The automated voice reads back your number, and you press 1 again to verify that the number is correct.
The automated voice then gives you the status of your case, such as the date it was received, the date they sent the notice, etc.
Then when it finishes with all that, it asks you to select again from another menu.
-From that menu we selected 3, which was something like 'to report a problem with your case....'
-Again, another long menu, and this time we choose 6, to request expedited parole.
-Then we chose 1, and I don't recall what the choice was, but i think it was expedited processing.
-Then an agent comes on the line, and she is reading from a script saying stuff like, 'to qualify for an expedited ap, you must satisfy the following criteria...' When she is finished with that, then you can talk to her!!!!
So bottom line, call, and call and call, until you get somebody that can expedite it for you. AS you have read, 2 different agents told us yesterday that it couldn't be done thru the phone!!!!
With the agent today, we didn't even open our mouth, she asked, if we qualified, and after that, she asked for details, and that was that. Of course, we don't know if it will be approved or not, and we have to wait 5 days for the answer, but, yes, you can request your expedited ap thru the phone.
Also, our appt for the biometrics is in florida; because of work we are temporarily in texas and as we are next door to the ASC, we went there to see if we could do our biometrics there, and that was not a problem. So yes, you can do your biometrics as a walk in, in a completely different office from your appointed place.
Hope this helps others.
Thank you so much for the info! I have also applied for an Expedited AP over the phone, getting to the agent before the second menu started. That was very helpful to read your tips as she was going fast with the Expedited Reasons
Thank you so much! Fingers crossed ours will be approved as well!

usually, during PMS, chocolate and red wine are useful. That's all I'm a gonna say. Oh Wait ! Midol also !
I would add meditation, yoga, green calming tee and Agnus Castus (sold in pills usually).
To set the immigration problems aside (there are a lot of answers on that already), I'd answer your PMS concerns.
It's difficult for a woman to handle the PMS (hormones are fluctuating, headaches, crying over nothing
) and certain organization such as doing yoga regularly and exercising, swimming would help.
I can only imagine how difficult that might be for a man or anyone around to handle a behavior like that. I didn't read your post till the end, and not sure if you would like to safe the relationship, but I would try to talk to your wife when she doesn't have mood swings and try to make her understand how difficult that has been for you but that you love her no matter what and want the best for your relationship.
If she wants the same, she will make the effort to make it better. It certainly requires certain will power to change a lifestyle to a more healthy one - maybe see a doctor and accept that what's going on with her is not helping your relationship in any way.
I hope everything works out better for you.

Congratulations! Good luck for your interview!

You can send papers/documents with DHL, but you cannot mail things (clothes, gifts etc.) for some reason. It's very reliable and quick.

Try to stay positive and keep in constant contact with each other, love and support each other. It will be over soon and you will be together. Stay strong! Praying helps as well.

I'm so sorry this happened to you. Be strong and allow God to take control of everything. You will be fine and please don't over stay in America, you should leave before 90 days. Always look at things positively, this happened for a reason. God knows and continue to TRUST in Him. You will see light in the end. No worry of your immigration, important is you knew it before marriage. And thank God, at least you will not end up getting divorce. Commitment is a must for marriage to be successful. Have a merry christmas !
What a wonderful wish!
I agree with everything above - trust that God knows what is better for you. You never know what you could have missed if married that person. All the Best to you!
-
When you apply for a marriage license you put your maiden name as current and a new desired surname on the application form. After getting married, you receive marriage certificate (at the same day if marriage took place in the city clerk's office) with a new surname. After that you need to go to Social Security office to change the ss card to your new surname.
You can use your new surname anywhere from the day of your wedding. Just be sure to keep a certified copy of marriage certificate with you

Hi!
If she has interview scheduled, she needs to fill in the necessary form/s for the interview with the correct info and bring an updated I-129F with her. I think she she lets the woman that will collect her documents at the Embassy know about the issue, it shouldn't be a problem. She also could call to ustraveldocs help line and try finding it out herself.

Congratulations!

For anyone out there still waiting on their K-1 process or starting out - guys, IT WAS WORTH IT!
I'm finally here, in the US, with my beloved and loving every bit of it. I'm eternally thankful to all of the members of the VJ community for their help and words of encouragement they provided. It's a great website and our success in K-1 visa process journey would not have been as smooth as it was (not without a few bumps on the road but still
).
I want to encourage everyone just starting the process - DON'T DREAD IT. If you truly love that person and are sure you want to spend the rest of your life with him/her then DO IT. It will be worth it in the end. The journey will bring you tests of your relationship and sanity. KEEP STRONG. You know you can do it. Lots of people did, so can you.
It will be very uneasy at times to cope with problems of the process being so far away from your loved one. Be strong. Support each other and stay in as frequent contact as you can. Love each other and care for one another, trying to understand what the other one is going through.
Tips: don't just check and follow the guides on here, keep up with the forums. Use search. RFE or even NOD is not the end of the world - it's a chance to prove your relationship one more time to the USCIS officer.
Be happy and remember to be thankful for being blessed to find the person of your life.

Hi!
You register on ustraveldocs website under Immigrant visa section and fill in all the details for your fiancee, not your info.
The address is the one for the delivery of the visa.
Priority date is a Received date on your NOA1 (look on VisaJourney search more about it).
Problem with being redirected to login page could be with your browser, try another one with reset settings. Or could be their website, try it another day?
First you create a profile, then you get to a delivery address, then you wait for the appointment letter from the U.S. Consulate in Moscow. May take around 10 days for them to receive a hard copy of your case and contact you.
They will send YOU, the petitioner, an email (with details on how to schedule an interview and necessary documents to obtain, you can look it up here now http://russian.moscow.usembassy.gov/iv-fiancee.html), no hard copy letters to your fiancee. You will need to forward it to her though, so she knows what to do
After that you can pay the fee (if you pay in dollars I guess you can pay earlier, if in Rubles wait till you get your appointment letter as Consulate's exchange rate changes).
Payment procedures are pretty clearly described here http://cdn.ustraveldocs.com/ru/ru-niv-paymentinfo.asp You will get a receipt (PDF emailed to you after paying by credit card) for it.
3 hours later (if you pay by credit card) you can schedule the interview as the next step on ustraveldocs. Print the confirmation page! You won't be allowed to the Consulate without it.
Hope that helps! Good luck with your interview

Did you have already the "Ready" message after the interview? And then AP, then "Ready" and AP again?
Or did you go to AP, then "Ready" and AP?
If it's the second variation, I think (I did a search on VJ and we have the same status now
) it will be issued in a couple days.
What do we do after leaving US without advance parole?
in Adjustment of Status (Green Card) from K1 and K3 Family Based Visas

I think you wanted to post a reply in another topic: http://www.visajourney.com/forums/topic/480862-left-the-country-while-advance-parole-and-aos-were-still-pending/
