  1. 1) What do I do with the white I-94 I received upon entering the USA on my K-1 fiancee visa. (I still have it in my passport). I am worried they may take it at check-in when I still need to retain it.

Well, just take it off your passport yourself :) Honestly, I don't think you need it anymore.

    2) Do I just need my GC and passport to travel and re-enter the US? Is there anything else I need?

That's all. Obviously, you will need to fill out the customs form before you clear immigration.

  2. Lenders are interested in your payment history. If you have never had a credit card or taken any loans in the US, then there is nothing they can base their decision on. I would suggest applying for a card at the bank where you have your account - they will at least know that you have regular income.

And yes, it is annoying. I still keep my Irish visa card, just to have a card with a decent credit limit...

  3. The only thing is that I have visited my fiancee on a number of times, have had J1 Visa's and have overstayed a holiday 90 day visa in the states ;)

I have lost my passport though and am not 100% sure of dates of entry or exit to the states.. does anyone have any words of advise for me-

I'd recommend writing more or less what you wrote here. For example "one visit in the first half of 2005, approximately three and a half months...". You don't have to emphasize your overstay :) They are probably only looking for overstays of over 180 days - those that would trigger a ban.

also does anyone know A time frame of how ling the process should be from here?

That depends mainly on you :) Be sure to make a doctor appointment as soon as possible - the next available date may be in a month or so. Also, when you send all the paperwork to the embassy, wait a week or two and call them. Otherwise you may wait a long time for your interview date.

And do not worry. The US Embassy staff in Dublin are really nice and helpful - at least those in the immigrant visa section. Good luck!

  4. WHAT WILL HAPPEN IF YOU WAS NOT ABLE TO FILE YOUR ADJUSTMENT OF STATUS AND YOUR K-1 EXPIRE ALREADY? YOU WILL BE DEPORTED? WHAT WILL HAPPEN?

You will be technically out of status. Do not worry about it, though. As others said, if you file for AOS as soon as possible, you will be fine.

Some people believe that as long as they marry within 90 days of entry they do not have to file for AOS at all, if the accept being unable to work and travel. They are wrong.

  5. I'm not sure where this is suposed to go but how does clearing us immigration @ shannon effect someone holding a K1 visa? Will it delay things like applying for a SSN etc?

I cleared immigration in Dublin, and two weeks after that I still was "not in the system". It might have been an exception or it might be typical of US POEs in Ireland.

I tried again in two weeks and got my SSN.

Aer Lingus seems a cheap flight, but we have to clear immigration in Shannon!

I would consider it to be a good thing. I much prefer to stand in a line before my flight (when I have to be at the airport anyway) than after it (when I am tired and only want to go home).

  6. Just last week we received the notice scheduling the Interview. I have read a few times where others have not gone to the interview after receiving a notice that "descheduled" it and have been denied due to not showing up for the interview.

If you also receive a paper cancellation notice, then it's your choice. You do not risk much by going. However, if the email is all you have, then GO!

  7. My husband got turned away today, they said he needs a letter stating that our AOS is pending. Did any of you have that problem? He showed his NOA1 for AOS and they said it wasn't enough. DO we have to wait for his EAD to come through?

I had to wait - this seems to be the official policy of the CA DMV :( Isn't is strange? Every time they change the law to make the law difficult to illegals, it's us who really suffer. Illegals just drive with no DL and uninsured...

  8. The question is, but what about things that people would need and F-1 for such as for getting Private Pilots licence at a flight school, would that be permissible while under AOS or not?

My guess is that it would be fine. Keep in mind that as a non-citizen you will need a TSA clearance to learn to fly - unless you want to fly gliders only. See: http://www.aopa.org/tsa_rule/

  9. Just got the green card in the mail today but the middle name is misspelled. We called them at 3 weeks ago when they sent the RFE to tell them that they spelled her middle name incorrectly. When they sent the first RFE everything was correct all until the second. So my question is will we be able to get a social security # so we can finally file taxes or not? Any help would be appreciated. Too bad Mdyoung is not around :(

I would go ahead and try to get a SSN. Chances are that you will get one, possibly with a correct name. If the name is misspelled, you can always correct it later. And if they refuse... well, all you lose is half a day.

    Good luck!
