Hey guys. My mom is Green Card holder and im US Citizen. I sponsored for her and also signed an I-864, Affidavit of Support . If she will apply for Medicaid , will i be in a trouble as a sponsor?

National Visa Center sent my brothers I-130 to wrong consulate, to wrong country. What should i do?

I am US Citizen. How long it will take for my brother to get Green Card if i will file for him?

What will happened if we will file i -485 right now , without waiting for his priority date? ( July, 2015)

So only way to get green Card for my brothger left the USA and get a visa in his country of origin?

Ok that's good, it means he doesn't have any unlawful presence issues (because that only begins when you turn 18). Unfortunately, the bad news is as I said above: he cannot adjust status because he has failed to maintain a lawful nonimmigrant status. The only way he can file for AoS is through being an immediate relative of a US citizen, and he is not.

Given that he has no overstay issues, he has a path to an immigrant visa once his priority date becomes current on F2A. If he's 19 now then it's going to be close with the dates, but under CSPA you can deduct the four months his I-130 was pending with USCIS, and hopefully that will be enough to keep him eligible.

Assuming his CSPA age is under 21 once his priority date becomes current, he would interview overseas for an immigrant visa, and upon (re-)entry to the US would automatically become an LPR.

It goes without saying that you should speak to an immigration attorney, and ideally one knowledgeable about DACA, to confirm all this before doing it.

He is on DACA since he was 16,5 years old.

How did he most recently enter the US?

He did enter in the USA with B-2 Visa.

My mother got her Green Card and applied i-130 for him In July 2015. On November 16th , 2015 his I -130 got approved. When should we file i-485? How long its going to take for him to get his Green Card thru my Mom? Thank you.

Sorry but no GC path for DACA through Mother or siblings.

Was he inspected when he first came to the US? If yes, AOS through marriage seems to be his only option to obtain GC.

Yes , he came To the USA with Visa. He overstayed. He was only 9 years old.

I am US Citizen and About to file I-130 and I-485 together for my parents who overstayed their visas and in the USA now. We live in one city but have a different address. Which address i should put on I-130 ? MIne or my parents address ? Address on I-485, I-765, and I-693 will be my parents address. Which one i should put on I-130? Thanks.

B2 visa holders.

They had B2 visas. But right now their both visas are expired. So should i write B2 visas or just out of status in i 130 and i 485?

Hello to everyone. Reveived letter with my interview date today ( 06/02/2014 ) . But unfortunatelly, cant make it because of family vacation from 06/01 intil 06/08 . So i went to my USCIS office right after i received my interview letter with my Hotel booked information. The clerk was very nice , he asked me to wait in a lobby for a little bit, came back with I-797 NOA that says that interview was discheduled by USCIS and he told me i should get new interview letter in 10 days . Hope my Interview still will be in June . Any thoughts and ideas when i should get my interview letter with new date. Thanks.
