    Ok... I see how it reads now. I did read through it but I guess I didn't get it the first two times.

    As Harpa and Aussie pointed out that your friend would be filing I-130 as well. Has your friend read the guide on VJ? If not I would suggest that they read it over a couple times. Make sure they understand what is needed to file.

    I did send her to VJ right off the bat, but her English is not that great and so she came back to me asking for help. I can barely follow the website myself and English is my first language, so I can't blame her for being overwhelmed by the site.

  2. Well I did read somewhere about a 30/60-day rule? If someone gets married prior to being in the country 30 days on a tourist visa they are suspected of fraud, whereas if they get married after 60 days it's seen as more legit. Not sure I have the numbers right, but that was the general idea. She arrived around November 13th, so I'd say she might be given more leeway having been here 3 months (if that "rule" is true to begin with).

    You said your friends did not have intent to marry and immigrate. So... As I say, that is the correct guide and you simply need to have them read and follow it.

    Looking at the I-485, Part 2 asks for the application type. Would she go with h. other basis of eligibility? Then add an explanation such as "entered on tourist visa and decided to marry" or something like that? Maybe something a little more delicate?

    Oh, and don't ask me why I'm doing all this and not her freaking boyfriend... rolleyes.gif

    Well it basically says don't get married if here with a tourist visa. If you do, then you have to leave. I already know that much, but it seems as though she doesn't have any intention of leaving so I'm trying to figure out what can be done. It says something about a waiver but I don't see the waiver linked anywhere.

    Not trying to be difficult, but I'm not sure if this guide applies to her particular situation.

  5. A friend of mine is here on a tourist visa visiting her boyfriend. She arrived in mid-November and did not have the intention of marrying. However, they have decided they do not want to part so they are talking about getting married. I know this is not the way it's supposed to be done, etc. but I am trying to help them out, as I have been through the K-1 process before.

    So if they marry, do they file an I-485? I can't figure out what forms need to be submitted. Any help would be appreciated.

  6. Do you plan on getting your wife a new Colombian passport with her married name? My wife and I just got back from Colombia (first time traveling with her GC) and I brought along our marriage license to show how her name changed between what was on her passport and what was on her GC. They just looked at the two and never asked to see the license.

    So I guess there's no problem with her having different last names on the documents? Would this matter going to another country (such as Mexico)?

  7. Not sure where is the best place to post this, but my question is: can my wife enter Mexico with a US green card? She is a Colombian citizen and tells me that Colombians need a visa to enter Mexico. Can anyone tell me if US residency changes that requirement or would we still need to apply for a visa?

  8. Ok, I just started the AOS paperwork for my wife and I'm already feeling like an idiot. I'm trying to fill out the G-325A and at the top they ask for a "file number" (presumably starting with an "A") and at the bottom they ask for an "alien registration number."

    Looking at the paperwork we have, there is a "numero de salida" on her I-94 form which looks to be an official type number. There are also various numbers on her visa, such as a "control number" a "passport number" (that begins with "A") a "case number" and then a couple of other numbers that aren't labeled. I'm guessing that the number on the I-94 would be the alien registration number, but I really don't know. HELP!!
