She wouldn't have any such petition or approval with a tourist visa, right?

Well I did read somewhere about a 30/60-day rule? If someone gets married prior to being in the country 30 days on a tourist visa they are suspected of fraud, whereas if they get married after 60 days it's seen as more legit. Not sure I have the numbers right, but that was the general idea. She arrived around November 13th, so I'd say she might be given more leeway having been here 3 months (if that "rule" is true to begin with).

You said your friends did not have intent to marry and immigrate. So... As I say, that is the correct guide and you simply need to have them read and follow it.

Looking at the I-485, Part 2 asks for the application type. Would she go with h. other basis of eligibility? Then add an explanation such as "entered on tourist visa and decided to marry" or something like that? Maybe something a little more delicate?
Oh, and don't ask me why I'm doing all this and not her freaking boyfriend...

Well it basically says don't get married if here with a tourist visa. If you do, then you have to leave. I already know that much, but it seems as though she doesn't have any intention of leaving so I'm trying to figure out what can be done. It says something about a waiver but I don't see the waiver linked anywhere.
Not trying to be difficult, but I'm not sure if this guide applies to her particular situation.

Did you read the guide? You have to go by more than the title of the link...
I did skim through it, and most of it seems non-applicable or "optional." It doesn't seem to be as straightforward as I remember the K-1 process to be.
I-485 for AOS... I'm actually not sure what the I-130 is for. A petition for what? Fill out both or just one?

So it looks like the I-130 is the only one that needs to be filled out?
Also, I know with the K-1 you can overstay your visa if you have filed for the AOS. Is it the same with the tourist visa, or will that be an issue?

I can't say I disagree RhettVoe, I'm just relaying how it was told to me. I even asked her while she was going through the tourist visa process if she was sure she wasn't going to get married, that it would be better to go K-1 if she was, etc. and she told me at that time as well that she was not planning to get married. So I don't know...

A friend of mine is here on a tourist visa visiting her boyfriend. She arrived in mid-November and did not have the intention of marrying. However, they have decided they do not want to part so they are talking about getting married. I know this is not the way it's supposed to be done, etc. but I am trying to help them out, as I have been through the K-1 process before.
So if they marry, do they file an I-485? I can't figure out what forms need to be submitted. Any help would be appreciated.

I've got a buddy going through the process right now and he's wondering which name to use on the I-751. His wife's maiden name was used on the I-485 AOS and that's the name on her social security card (they have not gotten it changed). Can he use her married name on the I-751 or does he have to use her maiden name?

Hmmm... too bad this change still wasn't made in the instructions. I sent my wife's I-751 off to Texas last week and was wondering why they hadn't cashed the check yet...

My wife and I are planning to travel out of the country later this year. We just sent in the I-751 for removal of conditions. What do we need to bring with us so that she will be able to re-enter with her expired card? Is the NOA enough? Does the NOA count as an extension?

I'm in a similar situation with my wife. We would like for her sister to come here, but my wife isn't a US citizen. Is there any way to get work sponsorship from a company here or something like that? She works in accounting.

Do you plan on getting your wife a new Colombian passport with her married name? My wife and I just got back from Colombia (first time traveling with her GC) and I brought along our marriage license to show how her name changed between what was on her passport and what was on her GC. They just looked at the two and never asked to see the license.
So I guess there's no problem with her having different last names on the documents? Would this matter going to another country (such as Mexico)?

Not sure where is the best place to post this, but my question is: can my wife enter Mexico with a US green card? She is a Colombian citizen and tells me that Colombians need a visa to enter Mexico. Can anyone tell me if US residency changes that requirement or would we still need to apply for a visa?

I just sent in my wife's worksheet. No RFE's and her AOS was approved through CSC in five weeks.

I just sent in what they gave my wife at her medical exam (the one for the visa) and didn't bother getting the I-693 from a civil surgeon. We didn't receive an RFE and her AOS was approved through CSC in 5 weeks.

Thanks!! Yeah, it sure was fast... only five weeks! I remember seeing someone write in and say that they were approved 15 days after getting transferred to CSC. So ours was 16 days!

Hey guys, our I-485 was transferred to CSC on 10/10/06 and today we received an e-mail that said:
"On October 26, 2006, a welcome notice was mailed for this case. If 30 days have passed and you have not received this notice. Please call the National Customer Service Center at (800) 375-5283 during business hours."
Does this mean approved???

What name do I use on all the forms (I-485, G-325A, I-864, I-765) for AOS and EAD? Do I use her new married name or her maiden name (that we used for all the K-1 documents)??
If we use her married name, do we need to go to the SS office to get her name changed before submitting the packet?

Ok, I just started the AOS paperwork for my wife and I'm already feeling like an idiot. I'm trying to fill out the G-325A and at the top they ask for a "file number" (presumably starting with an "A") and at the bottom they ask for an "alien registration number."
Looking at the paperwork we have, there is a "numero de salida" on her I-94 form which looks to be an official type number. There are also various numbers on her visa, such as a "control number" a "passport number" (that begins with "A") a "case number" and then a couple of other numbers that aren't labeled. I'm guessing that the number on the I-94 would be the alien registration number, but I really don't know. HELP!!

Ok... I see how it reads now. I did read through it but I guess I didn't get it the first two times.
I did send her to VJ right off the bat, but her English is not that great and so she came back to me asking for help. I can barely follow the website myself and English is my first language, so I can't blame her for being overwhelmed by the site.
