  1. Hi everyone, I want you all to weigh in on something. I think I know the answer, bit just want to see what you think. At Poe my husband will get a stamp in his passport that acts as a temporary green card until the 2 year arrives? With this stamp in his passport he should be able to exit and enter the USA again? We plan in taking a cruise within a few days of my husband arriving. Just want to make sure he's going to be able to enter when we get back. For this will kind of be our honeymoon since we never had a proper honeymoon.

  2. My husband just received a letter today from USCIS saying our case was transferred from National Benefits Center to Local USCIS field office in Atlanta. After 9 months waiting finally we hear from USCIS. Hoping it was the Noa2 (:

still need more prayers...patience until such time this waiting and separation will be over.

Strange that they transferred you so late. But then again nothing really surprises me anymore with the uscic. Hang in there. And yes prayers is a must when dealing with the uscis.

Be sure to post about your info pass. I like to see how atl handles each case

  3. Hi,

I am fed up the Atlanta office. They don't know what they are doing. Here is a rundown of my nightmare. We got approved on may 24, 2013. I have been calling the NVC since June to find out if my case was sent there. The NVC keeps saying they don't have it. I called uscis they kept saying it can take up to 90 days. I contacted my local congressman's office, they inquired on my behalf and uscis told them my case was still here in Atlanta and their system is saying it was sent to NVC, but it was not. They said they needed to look into why this happened, and they would contact the congressman when they sent out my case. I also received a letter from the local office saying they had my case and would forward it to nvc, but they could not give me a date. I got a phone call from the congressman this morning and now uscis is saying our case along with many others were sent to the National Records Center by mistake and they are in the process of getting them back. I can't believe this. I did make an info pass appointment at the local office and they never called my number. I waited all day. I was beyond pissed. I also spoke to tier 2 supervisors and I filed a complaint with the uscis ombudsman. The ombudsman has yet to get back to me.

gosh that is insane. So sorry to hear this. You would think that putting something in the mail to the right address would be a simple task, but I guess their case not so much. Tha need some major restructuring on how the conduct business in Atlanta. And what the heck is the national records center?

Maybe we should protest the Atlanta office.

Protest and get a little media attention

  4. Is this an APPROVAL for Ds-3032? is this means that they already accept my ds-3032?

this is the email i receive today? how long it shows the IV BILL?

    Dear Sir/Madam:

The National Visa Center (NVC) received your inquiry regarding the

immigrant visa petition: MNLXXXXXXXX filed by SXXXXXXXXX on

    behalf of DELIA XXXXXXXXXXX

We received the principal applicant's DS-3032 (Choice of Address and

Agent) form designating an address and agent. Instructions for paying

the immigrant visa application processing fee and all future

correspondence will be sent to the agent at the address selected on the

    DS-3032.

I got this same email today at 4:30. I immediately checked the payment portal and nothing. I then checked it again at 5:30 and the bill was generated, so keep checking it could be anytime between now and Friday if it's not already generated.
  5. This is what my lawyer emailed me today.

I was at the immigration office today and checked on Nahals file. I spoke with one of the officers that I know well and does interviews usually. She indicated to me that Nahals file was in fact in the Atlanta office waiting to be assigned to an officer for review. She indicated that since August and September mark the end of the fiscal year for Department of Homeland Security, their focus right now is on citizenship and oath ceremonies and that most likely the I-130 files will not get any attention until October, which marks the beginning of the new fiscal year for DHS.

Unfortunately, the officers are no longer allowed to pull files as a directive by the supervisors were given because they are trying to adjudicate and complete files in order of date. So Nahals file is still pending. I will do another appointment in November if we have not received an answer on her case.

Does this sound believable? I mean can they do that? just hold files?

It sounds like a big load of s**t if you ask me. Atlanta is so screwed up. Maybe try another info pass.
  6. so guyz I received a email vary next day from my visit to local office. in this mail, they pretty much said they have many of these type of I-130 and that is why its taking so long. Only thing we can do is wait. they can not tell how long it will take. They reference all my inquiries in this mail: inquiry submitted by senator, inquiry i submitted on the phone on july 17, and inquiry submitted by officer on the day i visited local field office. :-(. One letter and all three of my hopes went down. I dont even know what to do any more. I guess i just have to wait. it has been 9 months now. I do have a lawyer but she sucks. I've contacted her when 7 months were up and she said we need to wait until 10 month is over until she contacts USCIS. I am gona make sure I write bad reviews about this lawyer every where I can once my wife is here.

Have you heard anything new from uscis?

  7. Hi I am new to VJ. I'm not sure if anyone has been through this before. But this is what had happen to me.

Receipt notice of petition for I129F on 03/20/2013

    Rfe notice on 07/11/2013

Uscis recieved rfe request on 7/17/2013

Approval notice of I129F on 7/23/2013

When I called on 08/05/2013 to the NVC if they recieved my petition for I129F fianace they told me that they did recieved it and sent it back to USCIS on 08/02/2013f or to review again. I had ask why and they told me that I forgot tofill in part C on the I130. So I asked was that why you sent it back to uscis and they said that is what it is saying on our computer. So I hung up and dtarted doing some research on that petition I130. Why would I need to fill out the I130 for spousal visa when I'm doing a i129f petiton fianace. So I checked all my paper work and fourms and no where did I even file for I130. Did NVC make a mistake. So on 08/07/2013 I recieved an email from Uscis saying my I129F petiton was return back by the Department of State for further review. On 08/08/2013 my approve i129f went back to intial review and said that my case is being generated. I then call uscis why was my petition sent back. They said did NVC tell me why and I said yes, nvc told me that I forgot part C on I130. I told uscis that why would I need a i130 when I am filing a I129f for fiance only. I told them it must be a mistake. But all uscis said if it is a mistake than when we look into it and find out it is that then we would send it back for nvc.but for me to give them at least 3-4weeks to look at why nvc sent it back.Than on 08/13/2013 I recieved a notice of decision from uscis saying that my i129f was appove and sent to the embassy or consulate with the finding that the k1 visa has not been issue to the beneficary. And that the validty of my petion has now expire and that I can refile a new i129f for a fee.

How can that be. The notice of decision was review on 06/25/2013 and sent on 8/13/2013 and I didn't even get approve for the i129f until 7/23/2013. Plus my approve i129f was push back to uscis on 8/7/2013. Til to this date my i129f petition is still in intial review on the website. Nothing has change yet. I keep calling uscis for an explantion on why I would need a i130 (which was told to me by nvc the reason they sent my petition back to uscis) when I'm just filing for i129f. I did not apply for a spousal visa. Second why would uscis send my a notice of decision that my k1 visa expire when the review date was 6/25/2013. And my approval i129f was just approve on 07/23/2013. And why is my i129f is still in intial review. I am fustrated and confuse. Not sure what to do but wait. Does anyone have any suggestions

This sounds like a nightmare :(. Only. Thing I know for sure is that your right about not having to file the I-130. Its not part of the k-1. Just keep calling and bugging them. Call everyday
