  1. Got a checklist just now regarding the birth certificate:

    ______CORRESPONDENCE INSTRUCTIONS:_________________________________
    For electronic processing, all forms and documents that we request and require from you should be scanned and e-mailed to
    NVC as Adobe Portable Document Format (PDF) files. The documents should be sent as attachments with your e-mail
    response and not in a web file. NVC is unable to process documents submitted in web files. Forms and documents should not
    be mailed through the postal service. The applicant must present all original forms and documents to the Consular officer at
    the visa interview. Failure to present the required originals at the visa interview will result in a denial or delay in obtaining a
    visa for the sponsored applicant. Any questions regarding your petition should continue to be directed to
    NVCElectronic@state.gov.
    PLEASE NOTE: No interview will be scheduled until ALL of the information requested has been emailed to the National
    Visa Center.
    ______3 - BIRTH CERTIFICATE:_______________________________________
    Please submit this applicant's original, or a certified copy of the original document listed above. Each
    applicant must obtain an original birth certificate issued by the official custodian of birth records in the
    country of birth, showing the date and place of birth, and the parentage of the alien, based upon the
    original registration of birth.
    Documents must be from the appropriate issuing government authority. Failure to provide the
    correct document will delay your case and may result in re-scheduling of your interview or refusal
    of a visa.
    The certificate must contain the following information:
    ? Person's date of birth
    ? Person's place of birth
    ? Names of both parents, and
    ? Annotation by the appropriate authority indicating that it is an extract from the official records
    If the certificate is a certified copy of the original, it must come from the issuing government authority
    and it must contain annotation by the issuing authority indicating that it is an extract from the official
    records.
    In addition to sending the original documents or certified copies of the documents to the NVC, a
    photocopy of the original documents must be submitted.
    Unobtainable birth certificates
    If the applicant's birth record is unobtainable, please obtain a certified statement from the appropriate
    government authority stating the reason that the applicant's birth record is not available. The applicant
    must submit secondary evidence with the certified statement. For example:
    ? A baptismal certificate that contains the date and place of birth, as well as both parents names
    (providing the baptism took place shortly after birth)
    ? An adoption decree for an adopted child
    ? An affidavit from a close relative, preferably the applicant's mother, stating the date and place of
    birth, both parents names, and the mother's maiden name
    Suitability of documentation for immigration purposes
    For many countries, the U.S. Department of State has established country-specific criteria for ensuring
    that applicants submit documents appropriate for visa processing. Please go to our website
    immigrantvisas.state.gov to determine if the U.S. Department of State has issued any country-specific
    guidelines for the document requested.
    All documents not in English or in the official language of the country where the visa application will be
    processed must be accompanied by a certified translation. Your translation must include a statement by
    the translator which includes the following:
    ? Translation is accurate.
    ?Translator is competent to translate.

    Canada has two official languages, French and English, and my wife's in French. I don't know what was wrong with what was provided as it includes all required information. I'm going to email them the birth certificate again tomorrow morning. Strange.

  2. Anyone have any tips on how soon I should start calling the NVC about case status after I received the email stating to wait 20 business days to review our documents? We got that email on the 19th of this month, so it's really only been a few days, but obviously we're anxious to move along with either a checklist or case complete.



    Is the full 20 business days for review pretty normal for those who have reached that point?


  3. My wife tells me she is choosing not to become an American citizen because of her personal feelings against renouncing other citizenship during the oath. She is a proud Canadian and while dual citizenship doesn't affect that, she feels more comfortable staying solely a Canadian citizen and a permanent resident of the US.

    Basically you can use the EZ form if all of your income comes just from W2 forms, you don't have a co sponsor, and you are petitioning for only one person. The catch is you must hit all three criteria before you can use form I-864EZ.

    In my wife and I's journey, I had a form 1099 with interest income for my taxes the previous year so I used form I-864 and not the EZ form.

  5. He should have filed Married filing separate from everything I've read up on the subject. That's how I've filed the last two years as my wife has no tax ID (SSN) and we decided not to get her a tax ID number. I

    I'm not a tax expert, but I would think he could amend his return with the proper filing status.

  6. I feel your pain on this. I sent an email almost three weeks ago and received no response. Finally called and got busy tone after busy tone, just as my wife had gotten prior to me sending that email.

    I called and after repeatedly hanging up and calling back I was able to sneak into the queue and waited 20 minutes before talking to an operator for my questions that took about 2 minutes to answer.

    About a week and a half after I got my questions answered from that email I sent, I got the response in the email.

    Frustrating, to say the least.

  7. I was hoping someone would know that when I am submitting my AOS supporting documents to the NVC electronically with the naming convention of this: ABC2009123456_John_Doe_I864.pdf

    Am I to use my wife's name, the benefitiary, or my own name, when submitting these documents? This would include the I864 itself along with my tax return, employment verification letter, etc.

    Also, and I know it has nothing to do with eletronic submission, but does anyone know if getting an interest income form 1099A disqualifies me from using the form I-864EZ since all of my income doesn't come from just W2s?

    Any advice given would be really helpful.

    wow i cant believe it. im finally approved. My wife gave birth to a beautiful little girl sunday evening and monday her 130 gets approved. how cool is that!

  9. I can't believe it, but our application was approved today!!!! 4 days short of 8 months. Friends, I know the process is long and frustrating. And I know we all feel helpless sometimes. But keep the faith, because good things can and will happen for us all!
