I've been given a one month notice. You need to look at the I-485 processing times.

I say wait till they get the documents at the embassy. Once they do, they should contact your fiancée and give her the instructions on the medical exams, interview, etc. So no need to rush like Mirhen said. If you see on the website that the Embassy already received the documents and she has not been contacted yet then she can write an email or call the embassy. Good luck!

Ugh how frustrating! You can't trust lawyers 100% so that's why I did a lot of research myself. At the beginning my lawyer told me not to apply for AP but I told him to do it anyways. You never know! In this particular case I don't think it was discrimination, only misinformation. But anyways no point to cry over spilt milk, I hope your consular processing goes fast and smooth. Good luck!

Acceptance
On July 24, 2014, your fingerprint fee was accepted and we have mailed you a notice describing how we will process your case. Please follow any instructions on this notice. Your case is being processed at our NEBRASKA SERVICE CENTER location. You will be notified by mail when a decision is made, or if the office needs something from you. During the acceptance step USCIS reviews newly received applications and petitions to ensure that they are properly filed (i.e. signed by the applicant, appropriate fees, etc.) USCIS issues a receipt number for the application or petition, and sends a receipt notice to the applicant or petitioner.
The acceptance step is typically completed within 2 business days of when the application is received. With mail time it may take several weeks for you to get the receipt or rejection notice in the mail. The thing is that the case still in Acceptance more than five days... Should I worry about that??? what should I do?? Thanks in advance
Nothing to worry about my case has been in acceptance for 2 months and recently changed to Testing & Interview. So do not need to call USCIS just wait patiently

Is he a permanent resident or US citizen? I ask because your profile says you are filing for IR-1 but you mention I-129F which is a form for the fiancé visa, if it's a fiancé visa what you are doing he must be a US citizen, if he was a permanent resident before he can find his A number on his green card or in his naturalization certificate

Hi All!
My Fiancé and I have pretty much everything in order to send off for the K-1 Visa. He's from the UK and has gone about 2 years without filing (not sure if that's what they call it), his taxes over there. Would this be an issue that could possibly delay the visa process or even deny it? If so, we'd like to know in advance so we can remedy the situation sooner than we had initially expected to.
And as a side note question...for the medical examination, I read that they will look through your medical records. Is this correct? And if so, is this just to make sure the person doesn’t have a severe illness?

He will have to undergo a medical examination I-693 to make sure he is healthy and he doesn't have diseases like TB. They will take blood samples, etc. Also make sure he has all the proper vaccinations (Dtap). He can get those vaccinations with the civil surgeon that will do his examination if he doesn't have the vaccines but it will cost more money.

Olivia, my only advise would be that in order to avoid a discretionary denial by IO, you file the AOS after he has been in the country for 60 days. If you acted in good faith there should be no problems. Good luck!

Well maybe at least you can write the number of her naturalization certificate or tell her to search online so she can convince herself that a xerox is ok for the purpose of proving citizenship

I don't think it's a good idea to do it "frequently" though some immigration officers might give her a hard time at the POE. Remember she is in the process of adjusting her status for that reason she should only leave the country when it's extremely necessary.

I called the Social Security office and they said they can issue a card with her new last name as long as I bring in the original wedding contract.
My question is then if it will be an issue for traveling if she has her maiden name on her passport/visa and green card and my last name on her social security?
really? well if that's what you were told you can go ahead and try that. As per your question, hmm I don't think it will be a problem because u r not required to travel with your SS card or show it when you go through immigration. As long as her passport and green card have the same names I don't see a problem.

I am from Hong Kong and my partner is from the US. I was living in Beijing and I met My partner who was studying abroad . We fell in love and I decided to come to the states to be with him. I came on a F visa and have maintained my status for 6 years. Back then same sex marriage was not legal and we didn't have immigration benefits. We've been living together all this time since I came , I renewed my visa once in Canada.
My question is , could IO see this as something wrongful ? That I came on a F1 visa but knowingly would maintain a relationship with a USC ? Could they deny my i485 because that my intention was to migrate here ?
I don't see how it would be wrongful. You came on a F1 visa and have been here for 6 years with that status so in that time frame it is impossible someone does not start a romantic relationship with someone. we are human beings! who can be single for 6 years? One question, why did you have to go to Canada to renew your visa?

I guess i don't have to worry about that anymore. But the envelope thing uughh haha well does my envelope go inside another usps envelope? If so, can i just put 'original submission bla bla bla' with a marker on my yellow envelope and the addresses (mine and the po box) on the usps envelope? Im sending this today and im so stressed about this whole thing haha thanks again
yes, you can do that and USPS can put a priority mail sticker on your yellow envelope

Yeah i think you are right! The plastic envelopes that i got don't fit anyways so i'll go with one yellow envelope with my address and po box chicago address outside and inside i'll put the two forms clipped with binder clips and the overall cover letter on top! i put the check as the second item on both forms (after the g325a) is that ok? Or do they have to be on top of each table of contents? Thanks for helping me
I put the papers in this sequence Cover letter, both checks, form I-30, G235A, Evidence of a bona fide marriage, form I-485, G235A, Form 755, Form I-131 and at the end I put the Form G-1145 (e-notification).
But I suppose it won't hurt if you put the checks independently on each file. Hope I could help and good luck!

Yeah i have an overall cover letter with both names, address and all that plus 1 cover letter with a table of contents for the i-130 and one for the i-485 but i wasn't sure about the plastic emvelopes, i don't think ther should be a problem. Do i have to put the overall cover letter outiside those two envelopes? Because those two will go inside another envelope from usps so im not sure where to place that cover letter. And maybe i should just write outside the envelopes (on the stickers) form i-130 and i-485??? This whole thing is freaking me out!! Haha thanks
Ok I think I get you, I think the plastic envelopes will be fine. But why don't you just put I-30 and I-485 in one envelope and put the cover letter on top of both. If you decide to put them in separate envelopes yeah you can put the stickers and the cover letter outside both envelopes meaning directly into the USPS envelope. But in my opinion one envelope works best.

Pardon me if I am intruding, but are you a same-sex couple? I was wondering if this would be an issue especially in a conservative country like the UAE.
Also, what kind of documentation did they request regarding financials? Both of us live here and I am afraid that the fact I am not living and employed in the US (as the petitioner) might be an issue.

Hi, the consular officer should be american and not from UAE, I can understand your fear though. By now all consulate officers should have received the proper training on how to deal with same sex couples after Section 3 of DOMA was repealed. If you want to petition your fiance though I think you need your last 3 years income tax returns. Do you work in the UAE then?

We did it the old way...in those yellow manila envelopes. You can make a cover letter describing all the things you are including on your package. Regarding the names on the envelope, it's best you put both of your names ...yours and his as the senders since you are including the I-130.

Hi, it depends on what state you live as name change is regulated by state laws. Usually to change a name legally you need a court order. I'm guessing you got married outside the US correct? The easiest way is always to do it through your marriage certificate when u get married in the US.

Agree with Mike. He will probably get a notice to appear in court and will have a chance to explain the judge why he did not file on time. But I would not wait to get the NTA, and I would contact a lawyer asap.
