  1. I've been a little absent these past weeks, but I'll give you an update on whats been happening lately;

    On August 14th I sent a mail to NSCFollowUp.NSCS@uscis.dhs.gov as suggested by other users and you guys. On September 13th, we sent a mail to SCOPSSCATA@uscis.dhs.gov forwarding our original mail to NSCFollowUp, since they haven't replied in 30 days. We got a reply from NSCFollowUp shortly after (September 19th), were we could see that SCOPSSCATA had forwarded our email to the NSCFollowUP with the following text: "For resolution and response. Thank you.".

    The reply from NSCFollowUp; "

    Greetings,

    Thank you for your inquiry about this I-130, Petition for Alien Relative.

    USCIS records show that we received this emailed inquiry previously, and that inquiry is currently being researched. Based on that, we will close this inquiry as to not duplicate effort.

    The National Customer Service Center’s toll free number is 1-800-375-5283 or you may access the CIS web site at www.uscis.gov should you have any further questions or need additional information.

    So fast forward to September 22nd, we get a reply from NSCFollowUp. Keep in mind, that it was I (The beneficiary who sent the inquiry to NSCFollowUp, from my email, but signing it with both our names and file number), this is the reply we got:

    Mr. Holden:

    This E-mail message acknowledges your inquiry regarding the Form I-130, Petition for Alien Relative, which was filed with USCIS on your behalf.

    U.S. law and federal regulation prohibit us from providing case status information to anyone other than the petitioner/applicant or the Form G-28 attorney/representative in an immigration case. Please note that you are not the petitioner who filed the Form I-130 mentioned in your inquiry. Consequently, we are unable to respond to your request. However, we would be pleased to respond to an inquiry submitted by the petitioner in this Form I-130 case. We are sorry for any inconvenience that this may cause.

    In short, it should always be the petitioner who sends emails to the USCIS I guess :/ Anyway, my wife forwarded the exact same mail that I wrote to them, sending it from her own email (registered on the application).

    We have not yet received a reply from them as this was sent yesterday (September 23rd).

    Lastly, in late August we sent an inquiry to the Ombudsman about our case. After not getting a reply from them within 30 days. On September 14th we called them and asked if the case has been received and they said they had received our case, and that we would get a response from them within 30 days about our case. We also called the service center and spoke to a Tier2 multiple times in September, still the same reply, "additional processing", "backround check" etc.

    I honestly do not know which one of these desperate attempts got us approved, if it was any at all or just a fluke. Anyway, I hope this is helpful to someone.

    Post Decision Activity

    On September 24, 2014, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

  3. Hello guys, after I emailed SCOPSSCATA I received a reply from Nebraska SC informing me that our petition is "assigned to an officer" and should we not hear anything in 30 days, to contact them again. This is day 2.

    Exciting news... :)

    How long did it take for them to write you back? I sent them an email on September 13th and still havent heard back.

    Wife has been in contact with tier 2 several times and even talked to the ombudsman's office but still the same BS replies about "additional review".....

  4. Small update:

    My wife called USCIS and spoke to a tier 2 (for the third time) yesterday, she said she spoke to a very nice guy.

    Anyway, he could confirm (like the three others) that we were delayed due to the background check, however, he said something interesting;

    that most likely the delay was on Norway's end, and not the US, and that its Norway that is taking its sweet ### time to confirm my identity. He also said that this has happened with a few countries, but he could not disclose which countries.

    Anyway, next step for me will be to figure out what institution here in Norway is in charge of giving this information to the USCIS and tell them to get their heads out of their a**es and get a move on!

  5. In 13 days its 9 months for us :( Never have I ever believed this process would be delayed to this extent. I was so happy when I saw processing times at USCIS adjusted from 9 months to 5 months back in October 2013. But here we are, almost 9 months later, and nothing has happened. With the backlogs at NVC we are probably still looking at 4-6 months for an interview after we get our NOA2.

    It is heartbreaking and very stressful :(

  6. Everyone seem to be getting the exact same response from them regarding service requests/congressional inquiries.

    I refuse to believe that all of these people: http://www.visajourney.com/timeline/monthly_filers.php?form=2&visa=3&scenter=5&option=2&sortby=2 , are all cases that require special attention for whatever cause.

    I understand that a handful may have specific things in their cases requiring additional processing, but come on, all of us early december filers? Just another lame excuse.

    By this rate it would be quicker to file another I-130 hoping it would land at VSC or another service center that are actually working on cases.

  7. am curios to know if any of our December filers that are still waiting on NOA2 have ever had another case of issue that was ever pending with USCIS? Just want to know if this is a possible reason why there is a hold up. Also for service request that just say that they are doing additional review. When I called and spoke to the tier 2 officer I told him I need more information than additional review which doesn't tell me anything. I asked what was the additional review for? and why? maybe that was why I got my response. I told him I need something more than just simply telling me additional review.

    This is our first case with the USCIS ever, for both of us. I've only applied for a B2 visa last year (that got denied) but that was at the embassy in Norway.

    Other then that we have nothing on us that would qualify for an additional review.

  8. I basically got the same response from my service request. So I called and spoke to a tier 2 officer who advised that they usually say 6 months but it doesn't necessarily mean it will take that long. In our case he was able to give me more details advising us that the petition we first file for the k1 in 2012 was still open. After sending them a letter back then telling them we no longer wanted to proceed with the k1 petition because we were going to proceed with the i-130. We then got a response back that they have received my letter and once marrying my fiance at the time the k1 was no longer valid. Apparently that is not the case, because he said he still showed the k1 being active so they will need to look into this further and see why it wasn't close; however he was extremely nice actually taken over 40 minutes on the line with me looking into both cases for me. So am still keeping the faith. Come August 5 it will be 8 months and still no NO2. Keep faith everyone and am praying for us all.

    Thanks for some encouraging words CBO! I'll definitely have my wife call them and get in touch with a tier 2 officer to find out whats going on!

    It seems us december filers have fallen into a black hole :(

  9. Thought I should update you guys on our case status:

    We sent an inquiry to our congressman on July 18th, who forwarded the request to USCIS, and we got an answer yesterday:

    USCIS records indicate that your constituent’s petition received an initial review by an officer at the NSC. However, a background check process was subsequently initiated in this Form I-130 case; and it is not yet complete.

    Please note that a small percentage of immigration applications and petitions have unresolved background check issues that can delay adjudication. Although USCIS makes every effort to resolve such cases promptly, USCIS is unable to determine when the background check process will be completed in your constituent’s Form I-130 case. If a background check reveals an issue that may impact eligibility for a requested immigration benefit, further inquiry is needed. The inquiry may include an interview and/or contact with another agency or USCIS office for updates or more comprehensive information. Upon gathering and assessing all available information, USCIS will adjudicate the application or petition as quickly as possible.

    If your constituent does not receive a decision or other notice of action within 90 days, please contact us for an update."

    Please let us know when you hear back from USCIS so we can maintain your case updated.

    We also sent a service request about the delay in processing, and we also got a reply yesterday from the USCIS:

    The status of this service request is:

    Recently, you or your representative contacted USCIS concerning your Form I-130 to notify us that you believe your case is outside of our normal processing time. Below is a summary of what we found and how the issue has been or may be resolved.

    Based on your request we researched the status of this case. We are actively processing this case. However, we have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice of action from us within 6 months from this letter, please call customer service at the number provided below.

    We hope this information is helpful and appreciate your continued patience.

    So basically here we have two different answers given. One is that the background check is delayed, and the other is that additional review is needed for the case. I do not understand why our case would require additional processing at all. We can't wait 6 more months for a NOA2, that would put us at 13 months and 21 days for NOA2 (which may or may not be a new record, 5 months average? HAH). Our next step is to contact the Ombudsman and set up an infopass appointment.

    Good luck to everyone this week and I hope you get more encouraging answers from the USCIS then we just did.
    This is utter nonsense and I'm appalled by the way that USCIS is treating US citizens who want to have their families with them.
