  1. You and your spouse must apply together to remove the conditions on your residence by filing Form I-751. You should apply during the 90 days before your second anniversary as a conditional resident. The expiration date on your green card is also the date of your second anniversary as a conditional resident. If you do not apply to remove the conditions in time, you could lose your conditional resident status and be removed from the country.

    When you send in your I-751 petition and your documentary evidence, you will receive back a letter from USCIS telling you they have received your application and your green card is extended for one more year. You need to keep this letter with your expired green card as it proves you are still in legal status. You can still work and travel with this letter and your expired green card.

    You will also receive another notice for a biometrics appointment. Here is the catch on your traveling, will you be out of the country when the Bio Appointment is? That's the canary in the mine. Figure that out and you can travel.

    Thank you. Is it safe for us to file early/mid January 2016 since my husband's GC will expire April 2016? I heard if you file too early they will send it back. I was planning to prepare everything by December to have it sent out by January. Hoping that the Bio appointment will be schedule 1 month after they receive the application for ROC like the AOS :)

ROC is all about showing evidence of combining your lives together; joint bank account statements, utility bills, titles to automobiles, deed to the house... all dating back to when you got married and completed AOS. Once you file you will get a year extension (NOA 1) of your current green card so traveling outside the USA is not an issue - as long as biometrics was completed, make sure to carry a copy of the NOA1 once you file ROC until you get the new green card.

    ROC is taking an average of 6 months (I know of a few where it took a month or two longer and for us it took only 4 months).

    Thanks Hank :) As always you are very helpful. We have a joint bank account, insurance card for medical & auto & etc...how long does biometrics take? Will he be doing biometrics after they received the application for ROC like with the AOS?

  3. Hello everyone. My husband and I are planning a trip next year in August. We are going to send his ROC in early/mid January since his 2 year GC will expire on April 2016. Is it safe for us to travel out of country while in the process or ROC? Has anyone traveled out of country while on ROC? I am not sure how long the GC will take to arrive. Any advice would help. Thanks

  4. Most states don't require you to have you RN licenses in Philippines in order to get a RN license in USA.

    Most want your transcripts evaluated by a 3rd party place like CGNFS, ERES. And to make sure the textbooks were in English and after paying fee to the State Board of Nursing, and usually a Criminal History also, you can sit for the NCLEX/RN exam.

    Yea here in New Jersey they require a RN from the Philippines but I know in NYC just like you said they want your transcripts evaluated by CGFNS. Luckily the hospital where my husband works will sponsor his education and will hire him as an RN when he passed the NCLEX.

  6. She does speak fairly good english, but she doesn't have much of an excuse to come over except for me.

    I initially was planning on going over there myself until I read the travel warnings, but if it's the only way I will go.

    I think I will have saved up enough money to go and see her within 8 months.

    Once I have seen her, and have photoproof and all I need carefully gathered up, will the K1 actually work?

    I mainly asked about the danger also because my mom's philippine friend thinks that if I go there, I would be killed or mugged for sure :P

    Listen to Hank & all the other experts here to be able to bring the girl you love :) Don't worry you will not get killed just be careful not to bring any nice electronic gadgets as those are some of the things you will get robbed for. I gave my husband an iPhone 4s when he used to live in the Philippines and he had went to church when he took his nursing license and when he got out of the church the pocket of his bag was open and his iPhone was gone :( But other than visit the girl and enjoy the beautiful places in the Philippines.   7. Hello all. I just wanted to give a little updated since it will be 1 year since my husband came to the states. I petitioned my husband then fiancé on March 2013 and our petition got approve July 2013 (4 months). The whole month of August we prepared for his medical, CFO and interview. We schedule his interview August 20, 2013 but unfortunately it got cancelled because of the rain so USEM told all the people that had interviews that day to come back August 26, 2013 and again it got cancelled because of the rally for the pork barrel, we didn't know what to do since USEM was being difficult about giving information out so my husband decided to do a walk-in interview the following day August 27, 2013 and luckily he was able to get interviewed. I was very nervous about what was going to happen since I was not able to be there for his interview...I could not sleep until he texted me to say he was APPROVED. After about a week or so his visa arrived and he picked up at 2Go MOA and then went to the CFO to get his sticker.. we booked his ticket as soon as he got his visa on hand and September 23, 2013 he arrived in New York (JFK). That Thursday after his arrival we went to the city hall where we live to get our marriage license and the following week we picked up our marriage license and called the courthouse to schedule a date for our marriage. October 8, 2013 we got married and 1 month later we filed for his AOS we mailed it on November 2, 2013... 1 month later he was schedule to do his biometrics (December 11) so we waited to see when his EAD/AP would arrive and luckily after a month January 6, 2014 his EAD/AP arrived in the mail. Once he got his EAD he started looking for a job and was able to land a couple of interviews but no luck since he had no local experience yet. January 22 a tragedy happened, my husband's grandmother died and my hubby wanted to go home to the Philippines for the funeral but unfortunately my parents and his aunt got scared that if he goes to the Philippines just with the AP and without the GC he may not be able to come back so he was very sad he wasn't there for his grandmother's funeral. March 2014 our very nice neighbor helped him get a job at a local Popeyes near where we live. We received a letter from USCIS on February 2014 saying that our interview was going to be waived and that we had to wait 6 months to get his green card but luckily his GC arrived on April 2014. After working at Popeyes for 5 month he landed a job at the hospital near our house (walking distance...YAY) ...btw my hubby is a nursing graduate from PI but unfortunately he did not pass his nursing license in the PI. We actually had a struggle and battle of him not becoming a RN in the Philippines since my family were judging him that he won't be able to give me the good life I deserve because he isn't a RN but with hard work and determination he proved my family wrong that even though he isn't a RN he is lucky enough to find a job in the hospital and hopefully next year he will get his nursing license to become a RN.

    For all those that are going through challenges DON'T GIVE...LISTEN TO YOUR HEART & FOLLOW IT. Also take one step at a time and everything you want will eventually come to you. Don't worry all the waiting from the time of petition to when your love one comes to the states is all WORTH it :)

  8. Usually they don't ask for any chat logs, they ask to see a couple pictures and then... done. Always an exception of course, and that was a great answer on the part of your fiancee! :thumbs:

    I gave my husband (then fiancé) 4 chats (1 for every year)...he said they didn't ask him for that and asked to see our pictures instead :) They only wanted to see the Affidavit of Support & pictures.

  9. Hi every one! I just got married last month gladly with my fiancée. I am from Philippines and was approved to come visit my fiancée in US as K1 visa. So after getting married we filed my I-485 and I-131 and EAD. Now our problem is my Philippine passport will expire this October 2014. And we're clueless if I need to renew it in my country? We'll we are still looking on what the next move should we do.

    Hope to hear from anyone who have an idea on this. Will totally appreciate it . Thank you so much

    I live in New York and we renewed my husband's passport in July 2014 unfortunately we did not know that it would take about 8-10 weeks for us to get his passport back since the Philippine Consulate here told us that they send your passport to Manila to be processed :( Hope it is different from where you live.

  10. Has anyone here hired an immigration atty for filing AOS after marriage?

    is it worth the penny to hire someone? Will that speed up the process? Ive been thinking filing AOS is more complicated than that of filing the k1 application..

    No need to hire an attorney. If you were able to file the K1 visa all by yourself, the AOS process is much easier process. Just follow the advice of others in this site and you will do just fine. If you are not sure of something ask questions here and there are a lot of people who have gone through the AOS process who are very helpful. Filed the K1 & AOS without an attorney just by the help of the people on this site :) Save your money for something else like maybe a vacation :)

  11. Hello everyone. I was planning on taking a trip with my husband to either Mexico or Dominican Republic before he starts his new job 2nd week of September. Anyways we renewed my husband's PI passport last July and was told that since they process the passport in Manila now we won't get his passport back until 3rd of week of September. The PI consulate here in NY did not take his old passport. My husband's passport expires this December 2014 and I was wondering since my husband still has old passport can he still use that? Any advice would be very helpful. Thanks.

  12. Anybody who has an idea if the 8-hour overlay with EvaAir in TPR is fair enough? Is Taipei airport a good one? Thinking of which airlines to go for while waiting for the visa issuance.

    I love the airport in Taipei. I have flown with EVA Air for a very long time. Not to sure if 8-hour overlay is fair...but you can keep your self busy as they have tons of food and shops.

    Had my interview last Jul 11 and I was approved (NO 221G). Let me thank all of you for the support

    we received. It would have been one of a hellish journey if not for the guides and members on here. *bows*

    So, was wondering how long before I can receive my visa? It's for pick up

    at SM Mega Mall 2GO Branch. Trying not to pull my hair out because our wedding will be on Sept 5. :(

    CONGRATS. It took about a week for my husband to receive his visa. Soon you will be with your love and this loooong process will soon be over. Everything is worth it though. Good luck with the rest of your journey :)

    Eva Air is good. I live in New Jersey and have been using them for quite some time (6 years). Plus flights are some what cheap. My husband used Eva Air when he came here in September 2013. We paid $700+ for his one way ticket which included the travel tax so all he had to pay for at the airport was the terminal fee. I would definitely recommend taking Eva Air. :) Plus they always arrive on time and have never been delayed.

    Hank question for you. Hoping you can help. How soon can you file for citizenship when married to a USC? Does tne 2yr conditional count as being here for 3yrs or will the 3yrs only count once my husband gets his 10yr GC?

    JayAnn, I think you have helped her enough with the link and something she could have easily googled herself. That's all she needs to know. In case she ask more questions, tell her to read on the USEM webpage. If they have spare cash, then by all means, why not? Let her experience it upfront.

    i guess she was too lazy to do it herself and she always goes to my husband for help. she thinks that a tourist visa is simalar to a k1 that you will get approved if there is doctors note proving her grandma needs help. funny she is like excited to leave pinas already.

  17. She will not be approved. Don't tell her that, just tell them good luck and stay out of their affairs. Let the consulate do their job.

    I just gave her the link that Hank gave me. She didn't even want to pay the $160 visa fee. LOL

    I told my husband that it will be hard for his second cousin to come here. He tells me that the grandmother is sick & his second cousin will act as a care giver. I am sure the US embassy still won't grant her a visa correct?

  19. And people from the PI want to know why it's so hard for their relatives to "visit" the US.

    Fraud by people similarly situated.

    Don't blame the US government for not giving out tourist visas when people like these are looking to abuse the visitor visa system.

    Agreed! Sucks to have people like that. Jealousy can do stupid things.
