If you're applying for citizenship based on 5 year residency, I don't think they will concentrate much on your marriage. since you already divorced I think you need to submit this information. I think it would be a bigger deal if you were applying on 3 year rule (married to US citizen who brought you over the US), but you're not. So you should be fine.

1. You need to show a bona fide marriage. Proof of a life together - bank documents, bills, etc.

2. The baby is not only your child. Under US laws, he is the father whether he wants to be or not. He can sue for custody even if you don't name him on the birth certificate. You can sue him for child support.

Hello! I need some help. All websites and forums are giving me a different info. My question is when can I apply for Citizenship: 5 years after getting White card(4 years after receiving GC) or 5 years after receiving a GC!

It is absolutely strange that you did not bother the USCIS after the first 7-8 month of waiting for approval, but I guess it's not my business to blame you. I am 100% positive that you will get RFE (to prove that you still married) or you will be called for the interview. If you want to do the waiver then you have to prepare documents that will provide information about your good faith marriage. This process has nothing to do with misdemeanor. Does not matter if you wife took your paper or not, you can make them. DL, bank statements, lease agreements, bills, insurance, vacation trips, pay checks, bill everything can be duplicated nowadays. Good luck.

Okay, I highly doubt it will be enough. The baby is proof your wife had sex, the birth cert proves you claim it as your own, it doesn't prove it's yours (and i'm not being offensive when I say this, just telling you how it is). It's a positive factor but not enough. People have children all the time with no commitment so it doesn't prove commitment. You will also need evidence of co-mingling. I suggest you start preparing for your RFE if the birth cert is all you sent. Tax transcripts, bank statements, joint bills, copies of your licenses/ID showing joint address etc.

Otherwise you're right, the cover letter I wrote was simply a contents list as a checklist for myself more than anything. I'm sure it got tossed out. I included superfluous information maybe, who knows really but I was approved without RFE or interview in a reasonable timeframe for the period I filed so it worked for me!

You have to include the 2012 tax transcript. It is the current years transcript regardless of if you filed joint or sep.

You have to include bank account insurance mortgage etc if you are filing the N400 based on 3 years marriage, 3 years LPR. It is listed on the sheets USCIS sends you and in the instructions.

Make sure you read the instructions and the check list provided to you on the USCIS website.

1) You must live every place you have lived while in the US, during the time that you were a Permanent Resident. You say you lived with a friend -- with or without your husband? This may undermine your claim to a bona fide marriage, so make sure you can explain everything.

2) You must list YOUR children, if you have any. Not your husband's.

3a) At the top of every VisaJourney page there is a tab called 'Guides'. Follow this to the Guide for Citizenship. Good information, checklists, step by step instructions. Specifically you must provide tax information for every year in which you were a resident. Copies are acceptable, but they must be IRS-certified copies, not just photocopies. Tax transcripts are easier to get.

3b) I do not believe it is mandatory for your husband to attend the interview, but search the forums for more information. If possible, get confirmation from his employer that his work schedule is set long in advance. You need to prove that you have a real marriage, but you have done this before when you adjusted status and when you removed conditions.

4) Both. You have to prove that you have a valid marriage, and you have to prove that you meet the criteria for citizenship. Again, review the Guides.

For number 2 I just have to ask. Why don't you think your husband's children are not your stepchildren given you are married to their biological father?

3. Yes you got it. Also your husband goes with you to interview as it is based on marriage unless you go through the waiver process for divorce which I THINK forces you into 5 years before eligible.

4. Both good citizen and still a real marriage which is why you are allowed to apply after 3 years and not wait for 5.

Hi everybody!! Im glad we all now it this thread! I've been searching around, but I found only generalized information. Need advice/opinion.

1) N-400: information about addresses - before my marriage I was on lease in few apartments, and then for a few moth I lived with my friend (not on lease) do I need to mention this location?

2) N-400: information about kids: my hubby and I don't have kids yet, but he has 2 kids from previous relationships(not married) they are not my step-kids, we see them once or twice a month. Question is do i need to write their information?? Addresses and Birthdays??? Their mom are not happy about me, cause Tom had married me not them, will they be asked questions from IO? or information about kids is just general

3) Interview: how is the process goes? first we send package, then BIO appointment, then the actual BIO, then interview?? Am I going by myself or with my husband (USC)? What documents do I need to have with me besides 2 photos and passport, Tax transcripts?

4) Those who are applied based on 3 years residency(married) the purpose of the interview is to prove we still married or to prove I'll be a good citizen??

So Slow!!! I know I can not complain cause i have got an approval,but waiting for the actual GC is killing me. Why all the time CSC were ahead and now they are way behind? Is that difficult to print the card???

I am in shock!!! How come Wein's parents told you that it is your own problems!! I do not believe in this! R u looking for an outside sponsor?? you think someone will take responsibilities for your finance status? are you sure your marriage is real? Sorry for the questions, but my husband's parents are my second parents, they will never say "no" to us. Moreover, sponsor need just sign few papers that is it.

I agree with "bigdog" - just explain your situation, on the other hand send your separate bank accounts showing one address! add other documents - like Joint tax 2012 etc

Any phone bills? Any membership? You have a car, what about insurance? What about tax return for 2010+ you can send 2012 now

Basically from strong documents you have send only bank statements, one year TAX, and title! Good luck, send them as many papers as u have!

I have a question. I'm from Germany and I'm married to an U.S. citizen since July 2011 and I have my conditional Greencard since June 2012. We met each other in Germany and we were totally in love. He was the love of my life and I was sure he is the one I want to spend the rest of my life and have kids with. We moved to the United States in July 2012 and since then things started to go downhill He changed so much... He doesn't really care about the things I want to do and we always have to do things the way he wants to... He wants to have kids right away but I started to go to college last fall and told him I don't wanna have kids before I'm done with my education. Besides that I'm not ready to be a mom yet. He is not very happy about that because he says his wife and mother of his kids shouldn't work and stay home to take care of his kids... The last thing I want to be is a stay at home mom that depends on her husband... We are fighting a lot lately and he also told me that I should be careful about what I'm doing because he can send me back to Germany faster than I can think... He apologized for that later and said he wasn't serious but I'm not so sure what to think now. I don't really see any future for our marriage to continue or getting better so yes, I'm thinking about a divorce... I know I can do a removal of conditions by myself after we got divorced but I'm not sure what would be the safer way... To get divorced and do the removal of conditions alone or stay married and get divorced after USCIS approved my removal of conditions?

I would prefer to get divorced right away and do the removal of condition by myself but I don't wanna leave the United States and I'm really scared that they will turn down my application... Do you know about a case where that happened? For what reason could the USCIS do that? I know that I have to proof that I entered the marriage in good faith but besides that, is there another reason why USCIS could turn down my removal of conditions? Does it make a difference if my husband filed for the divorce, we both agreed to file for a divorce or only I filed for the divorce? Would the last case reduce my chance to get the 10 year Greencard? And what's about the interview, do I have to go to one for sure or can it also happen that USCIS accepts all my evidence I submit and approves my removal of conditions? Hello! I have two girlfriends that have got divorce waver prior to ROC, they both received a GC after an interview. One process went really smoothly, another much harder cause ex-husband and his parents dined to help my friend getting her GC (they did not want to write sublease letter), but still she proved her marriage used to be buona.

1) after divorce your husband can not do anything to you (like send you back) Immigration understand that he can avenge you, so they not gonna interview him or ask his opinion

2) Keep as many "split" joint documents as you can NOW! everything is good, even if the papers have only yours or his name, but showing one address.Make copy of his ID. Big advice - make correspondence with him through facebook or mail.

3) You better file the divorce - then you can claim that your marriage did not work because of him, and you did everything.

4) After divorce you will have interview for 10000%

5) Get a lawyer if you dont feel confident. Yes, lawyer will be sitting next to you on the interview.

Dont get stressed this is life - and you entered your marriage in good faith then none in this world cant prove opposite. Good luck and dont be scared!
