  1. That sounds like a good idea. I wish you both the best. Like I said I would be devastated if my wife who has been here with me for just 3 months now told me she wanted to move out of state to work. Yes, there are cultural differences here. I know in Philippines it is not so uncommon for spouse to go to Singapore or other countries to work but it is not so common here. God Bless and I hope it all works out for you.

    Hey one more thing. Maybe you could look into taking the necessary courses in California to become a licensed nurse there since you will be there for the next three years> Just a thought.

    Oh and by the way. This applies to husbands as well as wives. I am not a male chauvenist.(sp?) A husband should equally consider what his wife desires. Perhaps your husband can transfer to a post office in Florida? If my wife had just arrived from the Philippines and told me she wanted to move a few thousand miles away from me I know I would be devastated. I understand you because my wife is also from the Philippines. It's just that here in the US it might not be considered reasonable for a spouse, husband or wife, to move all the way across the country shortly after arriving in the US to get a job. I never said that you would be denied ROC, just that there might be some suspicion on the part of the person reviewing your papers. I wish you both the best of luck. GOD Bless

    Thank you Dave, my husband is willing to transfer but I don't want him to give up his life here. His seniority will start from scratch if he transfers. I just want to use my license for about a year so It won't turn out into nothing. Like I said, I will be looking for work here in Cali, and see what happens after 3 years.

  3. Families have to make this choice all too often when both adults have careers. I normally would say you live your life and as long as you can explain it to the USCIS do what you think is best, however; given that there is a child involved, I would say to break up the family for a job would be seen as visa fraud and your ROC will be very hard unless this seperation is for a very short--6 months max--time period while you get the new job in FL and your husband looks for a new position within the USPS.

    It would appear to me that the two of you need to sit down and have a long discussion as to what to do in regards to your career and his career and what is in the best interest for the both of you. This includes how such decisions will impact the next phase of your immigration process.

    My husband doesn't want this idea. I posted this question to seek for an advice. He is open to this option of letting me work in Florida, but he is asking to wait for 3 years before deciding into it. If I still want to pursue being a nurse after 3 years, he will let me go and work for about a year. He is willing to transfer but I don't want to give up his life here. I just want to use my license for about a year, so it won't turn out into nothing,

    For now, I will be looking for work here in California.. and we'll see what happens after 3 years.

  4. Huge gigantic red flags for sure! You just got here and want to move to the farthest state from California? I am not saying that you came here and are committing visa fraud but what do you think the ROC people are going to suspect? I mean seriosuly. If I were the official looking over your ROC I would be highly suspicious...just saying. I mean there have to be nursing jobs available closer to home? Does your new husband want you to go all the way across the country to "help him pay the bills". I know this is kind of common in the Philippines but net here in the US so much. I know I would not want my wife to leave, that's for sure. I wish you the best.

    Thank you David and Zoila for the reply. This is the reason why I posted a question here to ask for an opinion. If you have a good job offer you will think about it and definitely ask for some opinions to others who might have ideas about it. As a wife you would want to help your husband, think of things that could help. Nobody wants to be far away with their loved ones, but if this will help you, one must make a sacrifice even for a short time. Like I said, California is now strict with foreign nurses, they require a foreign nurse to study again to become a RN here. If I go back to school here, it would be another expenses that we will think. I would rather use the money for the needs of my daughter and also our needs. I'm already a licensed RN in Florida, no need for me to study again. My husband doesn't want the idea but this is an open option to him because he totally understands that it is my dream to work as a nurse.

  5. A red flag does not mean 'automatic denial'. It just means it's a red flag. When the USCIS looks at your petition for ROC, they care about two things only:

    1. Is the marriage bona fide? and,

    2. Are you otherwise eligible (filed taxes, not committed felonies etc.)

    If those two are true, ROC will be approved and your 10 year green card production ordered.

    In determining a bona fide marriage, they do look at whether you've been living together or not. However, they also know that some coupled may have to live apart for certain amounts of time. If you do end up going to Florida, it might make ROC more difficult, but a bona fide marriage can still be shown if you have 1. a reasonable reason for moving, 2. can show that it's temporary physical separation, 3. that you keep in touch on a regular basis, and 4. can show that you are contributing to the household (still splitting bills etc). You're not dooming yourselves, you just raise the burden of proof.

Honestly, my husband doesn't want the idea of me going there to work, it's okay for him if I couldn't work as a nurse here in California, But he totally understands that it is my dream to work as nurse, so going to Florida is an open option to him.   6. It is a red flag, as in the nursing profession there are shortages all over the US. They will question why you left the state for a RN position versus working in a different city in the same state. Why not obtain a position in various entities other than a hospital. Nursing home, schools, correctional facility, home health/private duty, weekend options, among others....

    California is now very strict with foreign nurses.. I have a RN license in Florida, unfortunately, California will let us study again to be a RN here...

  7. It's great that you want to give your husband that consideration.

    But remember, you turn your world upside down by permanently moving to the US. You moved to the US for him. He can move to Florida for you. He is not even giving up his country. He can even move back. Moving to the PI is probably out.

    Do what is best for your family. But remember, you have already made a sacrifice for him by moving.

  8. And USPS is cutting people. Just because it is all over the US does not mean there are any positions available - much less equivalent positions.

    Yes, that's why I don't want him to give it up, although He is willing. It will be selfish of me if he will do that. If there is someone who will sacrifice that would be. His life is here.. He has a stable job with good benefits..

  9. As long as you have shared evidence of a bona fide marriage, you will be able to ROC.

    It's just unusual to Americans that you gave up your life in your home country to be with the person you love in the US and then leave to live on your own in another state. Sometimes a couple have to separate for work.

    I am not telling you that taking the job means you cannot ROC. You probably can take the job in Florida and do the ROC. Living apart just makes it harder.

    Really think about what is best for your family before you proceed. It might be worth it to take the job even if it makes the ROC harder.

    I have no advice on whether you should take the job or not. I am just telling you that it looks unusual and will probably be a red flag for the ROC. A red flag does not mean that you cannot ROC. A red flag means your case would receive extra examination.

    I just have to look for another job here in california... thank you for your advice. it helps a lot..

  10. You can work anywhere you want.

    For the ROC, you will need to show a bona fide marriage. It is much harder but not impossible to show this even if you are living apart due to work. However, not living together will not make it easy for you to show a bona fide marriage because people who recently marry do not tend to move and live in different households. By moving to Florida, you will make it harder when it comes to the ROC.

    thank u for you reply.. its an offer that is hard to refuse.. I want to help him pay our bills, mortgage, and the needs of our baby.. I pity him thinking about those bills.. but I guess I have to reject the offer for now...

I want to accept the offer but what worries me is that I have a conditional green card (permanent resident) for 2 years and I acquired it thru marriage. What worries me if this will give me a red flag when I remove my conditional status and apply for 10 years green card. I will be away to my husband, and work there about a year and come back afterwards. Is this possible? Anyone who tried this? Thank u for your replies.

  14. they are asking you to pay the IV bill does not say anything as your AOS then you dont have mistakes, and congratulations!!! your AOS has been completed, but you must call to confirm it.
    The same thing happened to me.

    really? So our AOS is ok already? thank you America-del-sur. if there will be a checklist for AOS they will send an email saying "AOS checklist" or just "Checklist"?

  15. IRaH you can post what say ur cheeklist? Because I received too and the mine said that they needs my ds260 and civil documents, this cheecklist is for remember the next steep

    but if ur cheeck list say something ur AOS u need reply soon because they count again 20 working days for aproved the AOS

    this is the checklist that they sent to us today (CHECKLIST COVER LETTER). No other instructions just the fee payment. Is this different from the AOS checklist?
