  1. Hi,

    So I'm preparing my documentation for the Adjustment of status and came across the medical/above form, and I just have a couple questions about the vaccinations.

    I've read that the DS-2053 has to be 'perfect', otherwise I have to go to a civil surgeon with the above form. At my medical for the K1 visa all but three vaccines were ticked as 'not age appropriate'. The other three were MMR, tetanus and varicella. I received the MMR and tetanus vaccines from my GP before I left for the US and have proof of this (signed and stamped Immunisation report).

    1. Do I need to get the varicella vaccination if my DS-2053 says "VH"?

    2.Do I need to go to a Civil Surgeon to get the above form signed off, or can I just submit my DS-2053 with my immunisation report?

  2. Apololgies if this is the wrong forum..

    I'm trying to find out when i can apply for both of the above. Will I be able to start learning to drive in the US before I apply for EAD/AOS? Or will I have to wait till then? I've read the following here

    "Any document based upon decisions by the Department of State, Department of Justice, or the Department of Homeland Security that's specific to your situation"

    Will they accept a EAD/AOS 'application is processing' letter?

    Also,

    I would like to open a US bank account as soon as I can. Will I be able to do this with just a social security number, or will I again have to wait till EAD/AOS?

  3. I think you mean the stand alone EAD with a fee that he is eligible for as a K1. You have read the concept that by the time he gets it, it will soon expire or be expired. Reason: his eligibility is only for the 90 days he is given on the I-94 at entry. (His K1 is already expired because he used it). So let's say he entered this week, his authorized stay in the US ends around mid February. If he got the EAD card, it would expire mid-Feb. He can't extend it because he got it based on his I-94 which expires. A K1- isn't eligible to ask for an extension of their 90 day I-94. There is no renewal of that kind of EAD authorization. It's 90 days and it's over.

    When he applies with the AOS, he gets a card for 1 year based on applying for his adjustment of status. If he got denied AOS, it would be over for that EAD too because it is only allowed because the greencard is pending a decision.

    If he needs to work sooner, then get married next week and get AOS/EAD filed.

    Thank you, that clears things up. WOuld you know current processing times for EAD? Will we get the EAD before the AOS?

    My fiance has finally arrived in the US (yay!) and we are getting married in January. I've read that he shouldn't bother paying for/applying for an EAD because it will likely be expired (when his K1 expires) by the time it's processed. However, can't he just renew the EAD (at no cost) and have it to apply for work for when we begin the AOS process? Does he really have to wait all these months? He wants to work asap..any solutions or advice?

    I'm flying out tomorrow, and I've been reading about the above form and the new changes to it. Is this something I have to fill out online before I leave, or is it something I have to do on the plane? Don't want to miss any forms that could potentially stop me entering!

  6. Notorizing means it was witnessed and signed/stamped by a notary: http://en.wikipedia.org/wiki/Notary_public

    They're just people with a special piece of paper that says they can do that. smile.png Google "notary public" in your area.

    Most shippers in the US have someone who can be a notary. It's like a totally normal thing that happens there all the time (I'm just about to go get a credit card application notaried today, actually).

    UPS have a notary public at most of their locations, for example: http://www.theupsstore.com/small-business-solutions/Pages/general-business-services.aspx

  7. My fiance's interview is Sept 20th and we are past our 4 month NOA2 date. I have to write another letter of intent for his interview but a letter he received stated i have to provide a notarized statement of our intent to marry. What do they mean by notarized? Just that it requires my signature? Or do I have to actually go somewhere and have it "notarized?" Where would I do that? Please help! Getting mixed answers when I look this up online.

My fiance saw something on the pricing information that says "Non Immigrant visa, 280 pounds." Does he have to pay that as well? The website says that he needs to bring an appointment letter from the US embassy to the medical but you can't make an appt for the interview until you've had the medical? Do they mean the approved petition letter?

    You will get an apt from embassy when ever they get your approve petition from NVC.

    I should have mentioned this is in London. They've received that. My fiance says he has to call up to make an appt.

    My mom is sponsoring my fiance for the I-134. She makes enough income to support him. I was wondering if I would then have to also fill out "deposit on savings, personal property, stocks" etc on the form. I am not providing an evidence on what she has in the bank as she doesn't exaactly have loads. Like I said though, she makes enough to be above the federal poverty line..so I'm assuming it's okay to just prove her income and that's it? If so, on the form do I just leave all the lines about how much savings etc blank or type N/A?

  11. Send anything you like, but I don't think 2009-2011 tax will be accepted more readily than a current employer letter. She could have lost her job in 2011 and not worked since. Right?

    If the transcripts have not been ordered, they can also be used for AOS and they don't expire so do order.

    Tax returns were due April 15 as were any taxes due. An extension for an individual return is 6 months. Some people file years late, but penalties and interest accrue since April 15 if you owed anything.

    Notarization for London--

    If a British child is being taken from the UK, they like a notarized permission from the other parent or something witnessed by a solicitor.

    If the British beneficiary does not complete their visa process before the I-129F Petition expires (four months after NOA2) then the embassy states in the K1 instruction letter that a new notarized letter of intent from the US petitioner is required to extend the petition.

They probably won't really get looked at but I think I may just send them anyways, perhaps with a note from my parents or any documentation on why 2012 is missing. She has an employer letter dated the 18th of June 2012 and pay stubs, so that can also serve as proof that she's been employed.

    So that, an employer letter and pay stubs should be enough evidence..do you think?

  12. London will approve you without any tax records if you bring other convincing proof. An employer letter is good. Recent paystubs are good. They need to know CURRENT income and a 2011 tax return is a bit dated for that.

    When it is time to file for Adjustment Of Status, their 2012 tax return is a non-negotiable requirement with the I-864. How long is it going to take them to do their taxes?

    So should I just not bother with the tax return transcripts at all? or should i just send them anyway? My mom has her employer letter and pay stubs as well btw. I'll have to ask when their deadline is to file those taxes...soon hopefully...

    My parent's are co-sponsoring and haven't filed their taxes for this year yet. (They paid to have the deadline extended.) I'm having my Mom request a tax return transcript online. However, the most recent tax transcript on file would be for the year 2011. Just wondering if this is okay or would pose any problems?

  14. The law (Foreign Affairs Manual) doesn't really say anything but that the officer doing the interview has to be convinced the immigrant won't become a public charge. It's subjective, but the poverty guidelines are a good source for you to gauge it by. So I don't know the precise answer because it depends on what your interviewer thinks is enough. DOS mentions 100% of the poverty guidelines for fiance's sponsoring so I think it is generally accepted that the poverty guidelines and how many are being supported is certainly taken note of. But what does a partially supported count as?? I guess what I'm saying is for the I-134 it is not a mathematical science. London is not generally overly picky and most people interviewing have little comment about their I-134 except what they turned in for evidence. That makes me think there is generally no huge discussion over finances at every interview. It wasn't even brought up at ours. The form was turned and never mentioned by the interviewer. That's about all I have to go on...how people describe their interviews.

    That makes sense and is probably why it's so confusing to me! Thank you for all your help :)

  15. I think if Dad earns enough where he could manage on his own without Mom's income to support him then he is not dependent on her. If he was unemployed or something, then yes he would be. if it takes some of her income to cover the normal household bills, then perhaps partially dependent. This form is more Informal and isn't doing a household member count like the I-864 will. If they file a joint return, then be sure you bring something that shows her separate income like a W2 or employer letter.

    If it's not doing a household member count do I still go by the poverty guidelines to see if my mom earns enough to sponsor? (which i'm almost 100% sure she does, if i look at those guidelines and do include my dad anyways)
