My I-130 was approved and we filed the I-824 to request consular processing.
Had my interview in Italy, was put in AP and they sent the case back to USCIS.. after 17 months and after many calls we decided to try INFOPASS.. and that it the letter we received.. I am outside the United States and I can't even enter the US at this point, at least this is what the officer said.
-
The case is at the USCIS because when checking the status online it says "a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you."
So my case was sent back to USCIS... but its strange because why would the USCIS send me such letter if they are reviewing my case?
-
I was in AP for 17 months after my interview in Naples for my green card through my wife.
We scheduled an appointment with INFOPASS to know whats going on, after she went to the appointment they asked her for the "A" # which she didn't have but instead she gave them the EAC number. The officer said we would receive a letter within 2 weeks. this is the letter:
"On May 20, 2014, you appeared at this office and requested the status of your Form I-130. Service records indicate that your Form I-130 was approved on December 21, 2011. As per your request on the Form I-130 the application was sent to the NVC for Consular Processing. Therefore, if you would now like your petition to be forwarded to the district office, so that your spouse may adjust his status in the US, you must file Form I-824."Its very strange because when I check the case status online on USCIS website it says they are reviewing our case and if its reaffirmed or they need something from me they will let me know.
We also already filed an I-824 at the beginning of this very hard journey.
Whats going on?

Been in AP for 1 year and 3 months already. No answer from the USCIS... when my wife call them up they say they are still waiting for the discussion to come up if reaffirm our case or not. What can I do??!!!
-
Just checked CEAC website and instead of AP it shows this:
EXPIRING SOON:Section 203(g) of the Immigration and Nationality Act requires that your registration be canceled and any petition approved on your behalf canceled, if you do not apply for your immigrant visa within one year of being advised to do so.
You were advised of this requirement over 1 year ago, but we have not received a response from you since then. As a result, your application for a visa has been canceled and any petition approved on your behalf has also been canceled.
Your application may be reinstated and any petition revalidated if, within one year, you can establish that your failure to pursue your immigrant visa application was due to circumstances beyond your control. Please provide a written statement to the Embassy or Consulate outlining the circumstances beyond your control and noting that you still wish to pursue this visa petition.
What does that mean??? HELP!

No news for me... just that my father in law is dying and doctors gave him 6 months to live. My wife is trying to do her best... but no news.

AP Finished, visa in hand and airport today (not for me though)
So this friend of mine I've met at the Consulate who was put in Admin Process on February just like me, called me today telling me he was at the airport leaving for the United States. He completed AP last month, received his visa and today he is leaving and is going back home.
I wonder when our time will come...

I wouldn't consider frequent updates on ceac website as negative or good signs... it just means they have opened your personal case. That's it. they can update it 300 times but no status change.. and can update it only once and get the "Ready"! instead of Admin process..! but good luck!

Hi NickUSMC,
I just got am email from my congressman's office telling me that my husband's case has completed background checks at the state department and now the case is fully in the hands of the consulate in Naples.
I am unsure what this means but they have assured me that this is a good sign.
I will keep you updated as I get more information.
Keep me updated it definitely sounds like a great sign to me, but this also tells me that the papers were being checked in the United States from the Department of State and not in Naples.. ! good luck to you! sounds like this hell is coming to an end for ya!

Okay my wife today called the USCIS to find out more about our case, since it's been under review for over a month now after the US Consulate sent it back.
The guy on the phone told my wife they will send a letter soon to explain more about our case.
He was calm and gently she said.
What will I have to expect? is this a good thing or can be a denial???????

Congrats! I'm also praying my case gets reaffirmed too..!!
Next steps are the USCIS sends the package to NVC, nvc to embassy/consulate then they will contact you and schedule a new interview (which is from what I've heard is just you go there, you give them your updates papers (police certificates etc and if necessary re-do the medical) and that's it, they will tell you to pick up your visa probably the next day !

Hello no news at all... my lawyer said to wait 60 days so the Imm can make a decision about my case and either deny it or reaffirm it... been waitig.. no updates on ceac since 29th July....
-
This sucks, I'm also in ap since feb 27th '13. also case back to immigration for further review..
-
Shuss did you try to contact the NVC to see where's your case?
-
Contacted NVC, case back to USCIS at the beginning of the month, called USCIS, can't tell me much because I'm the beneficiary, so called my lawyer, he said it's not a good thing, and he was going to call USCIS immediately...

how did you talk to an operator? i'm trying to call but i always get automatic responses

It's been 5 months in Admin Process, no clue what's going on, I'm about to give up... I want to go home, with my family. What the hell can I do?! give up and enter as illegal?! I miss my family!
-
Uhm.. very complicated.. it's basically like she entered the country without checks, so there's no entry date basically.
I hope she doesn't get banned for life...! Don't do much with the Consulate, let them do their things and wait at least 60-90 days before inquiring about your case.
-
we're almost same case ,I was put in (FPU) Fraud Prevention Unit...the consul told me that I'll be having 2nd interview... she kept my passport and other supporting docs like email, photos, cards. etc......I have had emailed the embassy last friday and they said " THE CASE STILL UNDER REVIEW....WE WILL NOTIFY YOU IF CASE IS COMPLETED:
now we're patiently waiting!
Hoping and Praying to get our visa soon!!!!
How do you know you were put in FPU? Did they tell you that or you supposed it's that way?
-
Ok so I don't know if we can get it as "good news" or doesn't matter... I was checking different case numbers on the ceac website and one was in Admin process since January 2013, updated multiple times, last time was June 14th, now checkin that case # again it says issued on June 18th. So things are moving... but mine still admin process lol

Nope... My lawyer s going to email them also. In the mean time I have applied for the ESTA so I can start visit my wife if they approve it and let me in

My problem is that it is in Admin Process, I personally visited my wife while my visa was in process but not when it was under admin process so I don't know...!
