  1. Here's my experience. 5 months after we married and 6 months after I'd moved to the US, I took a job in another state. I commuted each week working a 5/2 schedule. I then took another job for 2 years, each summer working 6 months far, far away in another state, but then returning to my home for 6 months in the winter.

In my application I declared that I was working on a contract basis and living in company or friend provided housing.

I had no problems on my application.

  2. I thought I may add my experience in this situation as it's somewhat similar.

I filed 90 days early in early December 2016. Prior to that time I'd only spent 14 days out of the US on 3 trips. Once I filed thought, I was offered a contract overseas and amazingly, my wife was also offered a job in the same country, however her employer still considered her a local employee on the pay records. Anyway, after biometrics, I left for just under 4 months. When I re-entered the US I was grilled a bit. I explained I had a contract job and that my wife was working there as well. I was asked if we planned to move there. I was then back in the US for 2 weeks, left again for 2 weeks, returned to the US for 4 days and then back overseas for 2 weeks and then returned to the US just yesterday for my ceremony. The last two trips were just holidays accompanying my wife as she continued to work overseas.

I was a bit worried that this amount of travel right at the end might raise some flags. I had prepared house utility bills, mortgage payments, recent tax return and my wife's contract. I never had to show this at my interview, and border officials of the two most recent trips didn't ask me anything aside from where I'd been.

I guess I worried a bit but if you look at the whole 3 years period, I was way under the time allowed to be outside of the US so it didn't really matter.

It might be worth taking extra documents to the interview in case the officer does grill your wife on the longer periods overseas. At least evidence can be provided if needed. But looking at your post and considering my experiences, I don't foresee a problem.

  3. I disagree. I submitted my packet in December 2016 (with no photos) and had my interview 10 days ago. The officer asked for 2 passport sized photos saying that the biometrics pictures were rubbish and not suitable for use. She said the information saying do not submit photos with the application was creating some confusion. My office is Tucson I have read this occurring in other offices as well.

I would either submit the photos with your initial application or take 2 photos to the interview in case.

  4. Just experienced the same thing myself. Mailbox breakins... Got a PO box and updated USCIS specifically. Thing is, I tried filing AR-11 but really that's for a change of physical address, not mailing. So I call the mis-information line and was advised to actually write to my local office and advise them of the update. Well I never heard anything back, never a confirmation in either mailbox or text/call but when I went to my interview today, the officer had my letter there! So they were aware of the change.

  5. That's insane. I just got done from doing 2 police checks for friends here in Phnom Penh. I took their lease agreement, in Khmer, and a completed form, in Khmer, to the sangkat police and got it all stamped and sealed. Took that and the MOJ application form, passport copies, visa copies and the fee to the MOJ and done.

Do you have a contact at the MOJ? Have you seen Kimluch there? Let me know if you need help.

    MAINE

Portland - Sept. 2, 2016 - Successful, early and at a different location. My husband (beneficiary) and I moved to Maine a few weeks after filing for AOS, but our appointment was for the Brooklyn, NY office. We had the biometrics letter overnighted to us, and also brought along copies of our AR-11 to show we had moved and the marriage certificate for change of name (we both changed names). We got to the Portland field office during the lunch hour from 12-1pm. Security guard let us in, was very nice, and friendly. We told him our appointment was scheduled for a week out, in Brooklyn, he said "no problem, we'll take care of you." The woman at the window was happy we brought all the documentation that we did. She joked with my husband that he would have been waiting a lot longer in Brooklyn. There was only one other customer there, we were in and out within minutes once the staff returned from lunch. They stamped and signed the original letter and gave it back to us.

    MARYLAND

Baltimore - April/2013, told guard I will have oral surgery couple days before appointment & will be very swollen/bruised, she asked for supporting documents which I provided. Denied walk in. Wheaton - Dec 27, 2013 - Told guard we had an 01/07/14 appointment in Baltimore but had a dr. appointment the same day. He passed us on through. The gentleman who we talked to gave us a lecture about going to the wrong place, that people would be waiting for us on the appointed day, that it wasn't fair to them, etc, etc. - but then said he would allow it this time but to do all other appointments on the scheduled date at the right office.

    MASSACHUSETTS

Boston - I took my wife for her scheduled biometrics appointment on 1/14/14. In an effort to get some info for this thread I asked the woman at the front desk if they allow early walk-ins, this was her reply: "It depends on what the reason is. If you legitimately need to come at an earlier date they will allow it, but if you just walk in for no apparent reason, they may not."

Boston - Tried to do early walk in for my appointment in Lawrence, told them I worked in Boston and would have to take time off to go to Lawrence. They asked me if I couldn't make it on the original date, I said I could, just didn't want to take time off from work. They told me I'd have to come back on the day of my appointment, but I could do it in Boston. Still waiting to go back. - Not successful.

Boston - I missed my 01/08/2016 appointment due to the info getting to me too late (got it on 01/11). Called USCIS helpline, was told to either try a late walk-in or send paper in to Virginia to get a new appointment (wait time about a month *ahhh*). Showed up at Center today (01/12/2016) with letter and ID, manager came over to sign off on late slip and let me in no problem. There at 8:45am, back out at 9:30am, not bad at all and ALL DONE.

Boston - 08/01/2016. Success! Stopped by at 2:30pm - 30 mins before closing, there were just few people waiting, security didn't even asked for a reason why I'm there 11 days earlier, let me in. While seating and filling the paper - the supervisor approached me and politely asked for a reason why I came in early - I explained my situation that my spouse has a court hearing the same day and time like my original appointment and I have to be there (it's true). He just smiled back and I was done in 10 mins. Very nice and kind people working there!

Lawrence - did an early walk in 3 weeks before my appointment. Just asked politely if it was ok as I was in the area that day anyway. They couldn't have been nicer. Done and on my way home in less than 25mins! Was quite anxious beforehand as I'd heard bad things about Lawrence. But they were all friendly and really nice and accommodating.

Lawrence - 05/08/14 - Went one day early, they commented that it was supposed to be the next day, no questions. Successful. Should've tried there first instead of Boston - MUCH better office.

-We arrived about 245pm security only asked for identification and where we were going. The clerk in ASC was more difficult initially when she looked at our appointment she said why are you here so early (appt scheduled for 08/14/14) I explained my wife is pregnant and due any day she said well we had a power outage yesterday I don't know if we will be able to get you in ( only 2 people were waiting for someone) so she went to ask her supervisor when she returned handed me the clipboard and stamped our I -797 and said I can't guarantee it but fill out this form so as soon as I finished filling the forms they called my wife and son back about 15 minutes in total.

  7. 16 hours ago, cryshiabelen said:

What to select in new Form N-400 Part 12 " Additional information About you" for questions 4B, 7B, 17A and 17B, 18A and 18B, 27B and 38B and 38C since my previous answers were "NO"?  Should I leave the answers blank since I do not have the option to select "N/A" to this questions?

These questions are in two parts. The first part reads, "Have you EVER done (whatever it asks)?" If your answer is No, then the "B" part of the question is redundant because it says, "If you answered YES, blah blah bah". You leave that part blank.

If you answered Yes in the first part however, well, you'll need to answer the second part...

  8. Good morning all,

My US citizen spouse has accepted a contact overseas, working for an American public university in the field of student recruitment and study abroad.

Unfortunately her university isn't one of those recognised by the AG in the list.

However, I wonder if her job would be covered under an "American firm or corporation engaged in whole or in part in the development of foreign trade and commerce of the United States, or a subsidiary thereof;"

    I found the following definition of trade as follows;

"the exchange, purchase, or sale of goods and/or services. Goods are tangible commodities or merchandise having intrinsic value. Services are economic activities whose outputs are other than tangible goods. Such service activities include, but are not limited to, banking, insurance, transportation, communications and data processing, advertising, accounting, design and engineering, management consulting, tourism, and technology transfer" - Memo, Grover J. Rees III, INS General Counsel, Interpretation of “Foreign Trade and Commerce” for Purposes of Section 319(b) of the Act, HQ 319-C (Feb. 23, 1993).

    What are your thoughts?

    Thanks :-)

  9. I'm planning to file in December and then travel afterwards as well.

Here's what I plan to do.

File and then travel. I have someone reliable checking mail and can notify me if/when something does arrive while I'm away.

I've been reviewing timelines and personally, am confident that my travel plans won't interfere with the FP appointment or anything else.

If it did, then I would go the re-schedule option.

When you have your interview then you can update your travel info when the interviewer is going through your application.

Just make sure that this travel does not interfere with your residency requirements and time out of the USA.

    Good luck.

  10. I'm in a similar situation myself.

It was suggested to me to make an addendum and list the places you lived/worked with the dates along with a few sentences of how this is a temporary contract job w temporary accommodation and that you've still maintained NJ residency. For my situation, I have five houses and one hotel in two different states. I feel by listing all, especially the hotel, shows the temporary nature of this accommodation.

Remember living and residence have two different meanings with USCIS.

At your interview you could produce your NJ lease, bills, driving license and evidence of visits back to NJ in order to further reinforce the point.
