Do you change name? I wonder why the didn't put you on October 16 Thursday oath

No, I did not change my name. The officer said that they are scheduling using the next available date. So I guess Oct 16th is full.

So my interview was yesterday 10/09/2014 @12:15 pm at the Charlotte office. When the officer called my ticket number, my husband walked with me and asked him if he could join me. The officer said no but ask for my husband's ID. Then he walked me to his office. He asked about my current address and who I live with. So I said just me and my husband. The officer then asked for my ID, GC, and passport.

I passed!!! For some reason, I only remember these 4 questions:

1) Which group of people that were sold as slaves?

2) How many amendments?

3) Name of the Vice President?

4) Why did the colonies fight the British?

5)

6)

Reading: Who can vote? Writting: Citizens can vote.

Then the officer went over the Yes/No questions on the application. We did have some small talk about what I studied and what I do. The officer did not ask for any documents. At the end, he congratulated me and told me to wait in the waiting area for my Oath letter.

My Oath ceremony is Tuesday, 10/21/2014, same as 10 other people that went for an interview yesterday.

To be honest, I was hoping for same day ceremony, but I am very happy nonetheless.

Congrl. How you check the oath day? Why it takes that long for oath,do you Chang your name?

It seems to me that Charlotte office has the Judicial Ceremony once a month, on the last Thursday, which will be October 30th.

I don't know about the Administrative Ceremony.

Today, Sept 2nd, I received a text stating that my interview was scheduled!!! I cannot wait for the Interview letter to come in the mail!!!

It said to bring Driver's license and all passports and travel documents (include expired and current). There is also a note to bring this letter with the documents.

Based on your in-line, I am guessing that you will receive the letter around 08/24. Just my own observation!

I just received the FAMOUS yellow letter!!! So we can be sure that Charlotte office do send them!!! Note that I did not receive a text for this, it just arrived in the mail.

jenny2014wu: since you are with the Charlotte office, I'd say you will receive the letter around 08/24 and your interview would be around 09/24. This is just my observation.

It seems like they are kinda slow now .I was checking April or May filers i don't really remember and i notice that 2 days after that person was inline for interview they updated his case with interview schedule.He had his interview almost a month after being inline for interview .He had his oath 2 days later after the interview ! I have been inline for over than a month now and still nothing ! Good luck guys i hope that we will hear something soon from the slow Charlotte office lol

Yep, I'm sure he never stayed out of the country for more than 6 months. I remember him complaining once that he had to come back at Christmas time when tickets were really expensive because he couldn't wait until January. Here's what USCIS says:

The officer told him that returning to the US every 5 months simply shifted the burden of proof from him to USCIS, so USCIS would have to prove that he abandoned his residence. The officer felt that the fact that he had been living and working abroad for 1.5 years was sufficient proof and that his trips to the US were just vacations.

When he appealed, he presented all the other information about taxes and bills and mortgage payments (which he hadn't taken with him to his first interview) and the interviewer approved him on the spot. If I remember correctly, his second interview was about two months after the first.

So I think if someone's going to follow the "I'll come back every 6 months" plan, they really need to make sure they have something to show that they still reside in the US.

Yes, your friend did have good evidence and it looks like he satisfied this from the same link above

"An applicant may overcome the presumption of loss of his or her continuity of residence by providing evidence to establish that the applicant did not disrupt his or her residence. The evidence may include, but is not limited to, documentation that during the absence:^[11]

touyats, do you have anything from the list? I think we can agree that there will be questions regarding your residency when you apply for Citizenship. So, the question is do you think you can convince the interviewer.

Let's say you accept the job in London and come back every 5 months or so for 2 weeks. Here is my personal opinion:

1) Then it would not be a problem to keep your GC. When you enter the US, an officer may want to know why you have been outside the US for that long. You may want to have the job offer letter from the company in hand.

2) How long is the job? Let's say the job is done and you come back to the US in October 2015. Then I think you can apply for Citizenship in October 2020. In other words, I think the 5-year requirement starts over once you are back in the US permanently.

Again, this is only my own opinion.

I think being in-line is to help you compare your timeline within your local office and not other office(as in Tampa vs Tampa and not Tampa vs Chicago)

What I have noticed(as a rule of thumb):

1. If you applied early then, doing your Bio early does not help.
2. If you applied early then, you'll be placed IN-LINE about 30 days before your anniversary date.
3. If you did not apply early then, you'll be placed IN-LINE within few days after your Bio.
4. If you applied early then, you will receive interview notification within 30 days after your anniversary date(GC date)

Again, don't ask me to quote - just observation based on other threads...

This is true in my case. My GC dated 01/27/2011, and I applied on 06/16/2014.

From what I read, it seems to be "In-Line" notice + 30 days --> "Interview Scheduled" notice + 30 days --> Actual Interview date.

My In-Line date is 07/09/2014, so I am hoping to get Interview Scheduled notice by 08/09/2014 (waiting anxiously for the famous yellow letter ). For Charlotte office, it seems like they have the Oath Ceremony on the last Thursday of every month. So if luck is on my side, I am hoping for the actual Interview on or before 08/28/2014.

On a personal side note, even though I do have some plans in mind after being US Citizen, I am not going to push my luck with USCIS. Charlotte office processes N-400 in 5 months, so I just let them do their "things" . I feel like there is no need to call and ask if my case can move faster. They have been good to me and my paperwork!

1. You may start to curious that why I have to provide the school stuff to USCIS. In fact, My wife and I are college students. I am a full-time one and she is a part time and a full-time housewife. Both of us are 22 years old. Our living are sponsored by oversea family. (Non of them are US citizen or live in US and they don't know we got married.(As my family did not like my wife and my wife family did not like me before we come to US, now is better, be still not a good time to tell them.) They just know we lived together. That's why we did not file tax. and i do not expect they are going to write me a letter for our marriage or my ROC.

2. My wife is not a driver, that's why I did not put her name on my car and car insurance in these 2 years. However, in July 2014, because she try to learn driving, although she is not a driver yet, we started to finance our first new car (with both of our names). Is it a good information to provide?

3. We ain't got life insurance because we did not expect die as we are just 20 years old 2 year ago. And health insurance is too expensive for students.

4. Our financial situation is very simple, my wife have only one checking and saving account in BOA with no credit card and I have 2 checking and one saving and 2-3 credit card for daily usage. As we are students, we do not have common asset. I believe it is one of the most obvious problem in this case.

5. About the cover letter, what should I tell them?

I think you prepare a great ROC package!

1. No problem being students, also your living are sponsored by oversea family is not a problem either. However, if you did not file taxes, I'd suggest you write an explanation. Maybe because you two do not make enough and are not required to file taxes with the IRS? If you do not tell USCIS, then how would they know about your situation(s) or your reason(s).

2. Yes, both your names on the car is a great information to include.

3. No problem. We did not have either life insurance of health insurance.

4. No problem. We did not have any common asset, no mortgage, and I did not include the lease either. I'd suggest that you print every page of every statement you can get from BoA checking and saving accounts. Same for credit cards. You might have read that you only need to send in one statement every 3-4 months. But hey, if USCIS wants to see joint financial records, why not giving it to them?

5. I did not write any cover letter. I did, however, write a simple letter about our life together as a happy married couple. That also took care of the affidavit(s).

Or, you could make an Infopass, explain the situation, and have a stamp in your passport.

Personally, I would not recommend it, but again, I don't know your situation. If you absolutely have to travel, then be extra careful and take all the document with you.

Really need your advice about my current situation, I've been having a hard time of thinking what the best thing to do. PLEASE HELP!!!!

I am currently on Conditional Permanent Resident which will be expired on Oct 2, 2014. On Aug 5, 2013 me and my USC hubby must went back to my home country (Indonesia) because of financial situation. I was only working for 20 hours a week, first pregnancy and my USC hubby already lost his job for a year as of Aug 2013. Due to our financial situation back then, we didn't have any budget to file for I-131 (Travel Doc) and I also thought that i would be able to file it from Indonesia. However when we called USCIS/US Embassy in Jakarta last week, they told me that I-131 should be filled when I was physically in US. Then they asked us to call CBP to see what would be the best solution for me to maintain my PR. The CBP lady told me that I need to go back to US before a year of leaving US and should filling I-751 as soon as I get to US.

1. Will CBP give me a hard time of entering US because I leave US for almost a year?

2. Will my explanation about our financial situation back then could help me passing the POE?

3. SInce I will travel with an infant (My baby will be 7 months and holding US passport), should I wait on CBP line for PR or should I wait on CBP line for US Citizenship?

4. My USC hubby is having a year contract with an after hour English course in here and he is making less than $ 800 per month so he hasn't filling for IRS tax return. Will that be a problem for me to filling our join I-751 without IRS Tax Evidence?

1 & 2. Maybe. But with your 7-month old baby, you could say that you went back home because of first pregnancy and would like for your baby to be well enough to travel.

Many Asian women want to be with their family for the birth of their first child. It's normal.

3. Will your husband travel with you? If so, I'd say let him hold the baby and wait in line for US Citizens. If he is not, then I'd say you and the baby wait in line for PR. Not really sure if US Citizen (the baby) takes priority over PR (you)

4. Your husband need to write a letter explaining the situation why he did not fill taxes. Did he notify the IRS?

Questions & Concerns:

- Our friend's name name showing up on the lease. Does that look bad for us? --->I do not know, but you should send in the lease.

- Do I need EVERY bank statement available? I can go back 36 months. ---> At this stage, print every page of every single statements that you can find.

- Is the amount of pay stubs I have enough? I just used them to establish that I was contributing to our shared account. ---> I think so. Send them in.

- No utilities in both names. ---> No problem. We did not have this either, and it was fine.

- No car loan or anything in both names, I don’t have a car or state of CA license yet.

No car loan is ok, not everyone has it. Because of credit scores, It is not easy to have both names on car loans anyway.

But you should get a CA license that matches your spouse's address.

- Should I include our marriage certificate just for a refresher on when we got married?. ---> Yes!

- No pictures, no cards from family. No affidavits. Should I try to scrimp together some photos?

Many people think these carry little to no weight. As for affidavits, I wrote a simple letter about our life together and that our marriage is going strong.

- My life is insured through the military. DH would receive that if I pass away, but I don’t have anything that shows that (to my knowledge.)

I'd say send in any statement that you have. If it is a joint credit card account, both your names should be on the statement.
