  1. Thank you everyone, I guess I assumed the lease was evidence of cohabitation... but yes, I will include a drivers license. The reason for not including more tax returns is the ones from previous years were already submitted for the AOS, and I did not do my 2017 taxes yet. A lot of stuff was already sent with the AOS, like joint bank statements and such, but I guess I will put more in there. It won't hurt!

  2. Hello all, I have just completed my cover letter. Does it look ok? One thing I am not sure of is if I should include the last item of evidence, the jewelry receipts. Is that unnecessary? Thank you!

Hello, I notice some of the example packet lists for ROC applications list the marriage certificate as evidence of a bona fide relationship, but elsewhere it is advised that there is no need to send evidence that was previously submitted with the AOS application, which would include the marriage certificate. So should I include it or not? I think not, but I wanted to make sure.

  4. The IO can, and may ask to see the original to compare it to the copy you previously submitted. you may get an RFE if no original is available. At our AOS interview, they asked to see the original of my divorce decree (USC), I had submitted a copy with the original I-129F petition. Thankfully, I brought along the original.

    I perfectly understand the steps necessary to obtain a Notarial Certificate (AKA White Books) of any document from the PRC. That is why my wife obtained multiple copies of all of her and the stepson's important documents (White Books) prior to moving to the US.

    The very concept of obtaining multiple copies of all 'White Books' prior to leaving China is a frequent recommendation in the China Regional Forum, for this very reason.

    Does your wife have any friends or relatives in China that she can send a photocopy of the specific White Book (as a sample), and ask them to have the several of the 'White Books' prepared and delivered by courier service to you?

    Thank you, ok I guess the worst that can happen is we'll get an RFE. Luckily her sister can go to the gong zhen chu and get more copies and send them to us.

    We did get 3 copies of each white book before leaving China. Now I have all of the police records and birth certificates, but the divorce decree whitebooks are nowhere to be found. It is really confounding because we have all of this stuff in one place and we wouldn't have taken those out and placed them elsewhere.

    So they asked for yours, maybe they'll ask for ours. We'll see. Either way, tomorrow we are going to ask her sister to get copies and send them to us.

  5. Hello all,

    I am not sure what happened, but I submitted a scanned copy of my wife's divorce decree from her last marriage for her K-1 visa but now I cannot find the original divorce decree for our interview. I printed the high resolution copy out, but the instructions for our interview say bring the original and a copy. How big of a deal could this be? We have been married almost a year, live together, have finances together etc, will they even ask for it and if so what will happen if I don't have the original?

    Getting a new divorce decree isn't a simple matter - this is a notarized translation from China.

    Hello there,

    We sent in the i485 stuff in July (I don't remember the exact date) and our interview date is March 29th, so it took awhile. It was 6 months from it saying "You are ready to be scheduled for an interview" until we actually were scheduled... but I have heard of others only being in this stage for 2-3 months, so I guess there is no way to predict it very well!

    Mine was October but haven't got any notice for interview yet

    Well I didn't get my notice until 6 months after my last contact from USCIS (August 31) and you guys are both after me, so I think you have nothing to worry about. I don't think calling will help. But I was close to the point where I was going to call. My letter came in the mail just a few days after I said I want to call them.

  8. Iam not a troll. I made a mistake and I wanted to correct it this is why I came here to seek some legal advice. This froum is to help eachother out not to make fun of anybody, I knw this process is painful and I pray for everybody. Plz guys don't make fun of anybody jst help eachother out. Visajourney is just like a family where ppl don't see whts ur religion or where u from or wht ur race is. I have been praying for everybody whoever is stuck in ap or their process is taking so long everybody wants to be with their loved onse and anybody can make mistake so this is why this forum is to help those ppl. Visajourney has helped me a lot I red everything here when I started to fill out my paper work. This is was my first topic I did lots of research regarding this simiar mistake which I did but I cudnt find any topic abt this so this is why I decided to ask from expert ppl here. I wish everybody Good luck in their process

    It's ok, that is why we are here. I know it is a tough and stressful process. Don't worry about your height, it is not a big deal. Any little issue becomes a very stressful thing, I went through it myself a few times during this process. You will be fine, do nothing, and don't even think about it again, it is no problem.

  9. Hello,

    When it says bring the Form I-693 (Medical) and I-864 (Affidavit of Support) unless already submitted, do they mean already submitted as in when I submitted these with the i485 application? If that is the case, then I do not need to bring them?

    Can I just bring a copy of my i485 packet to the interview? That has all of the stuff that is on the letter. And I will also bring the originals of each document.

  10. I am a USC and I am petitioning for my soon to be spouse who I will marry before I file the I-130. Last year I sent her $100 western union but it was sent as her mom as being the receiver. If I was to show this would it help or hurt my case in anyway? I will be applying for the CR-1. I have read that sending money to your spouse or soon to be spouse helps show a bona fide relationship.

    I sent money via WU to my wife a few times, and we did not mention this in our application or anywhere, but obviously if they asked at the interview "did your fiance send you money" she would tell the truth and the reasons why. Visa related expenses, plane ticket, wedding stuff.

    My wife came here and we got married and she changed her name. Her only ID with her new name is her EAD/AP card. No drivers license or state ID yet. We are going to fly domestic, should I buy flight tickets with her passport name or will her EAD/AP card be acceptable identification at the airport? Or should she bring her passport, marriage certificate showing name change, and EAD/AP card?

    I filed the I-485 a few months ago and the status on USCIS says:

    As of August 31, 2015, we are ready to schedule your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number XXXXXXXXXX, for an interview. We will schedule your interview and send you a notice. Please follow any instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address. 

    Now it has been almost 4 months with no word from them. Should I call and ask about the status? Will they be able to give me any useful information?

Ok I'm very confused now...I read the Chinese embassy site and it says I need a letter of invitation and copy of id for my girlfriend but I called visa express an agency that helps get the visa and they told me I do not need a letter because she is not my girlfriend as we have never been together before and I need to make a reservation with a hotel and then cancel after I get the Visa...#######?

    Here is what I did twice. Get a tourist visa, pick a hotel in the city you are visiting, put it as the address. They will not deny it unless you say you are going to tibet or are a reporter or something. Don't mention that you are going to visit someone. btw my second visa was for 10 years, and yours will be since they are all 10 years now.

  14. My visa was approved. I only showed my bank and credit card statements from my Bank account in bahrain, my contract, and salary certificate. I was honest in answering questions and CO ended up being more interested on my nursing field of specialization..

  15. Thank you. I know I'm not guaranteed entry but, it would be stupid for them to deny me and then let my toddler go back home. What kind of officer would do that unless they're cold hearted.

    I plan on bringing my entire folder. Everything from visa process (k1) up to everything I got back from uscis. The last letter I got was the interview waiver and that, I won't hear from them for another 6 mos. And I'll bring my marriage certificate, since my last name changed. And my husband and child will be with me as well.

    Hello, please double check before you leave the country. From what I gather... if you did not file for your AOS more than 180 days from your I-94 expiration date, you will be automatically barred from entering the country for three years. Yes it is stupid. My wife could not even get a drivers license because the DMV could not verify her legal status.... yet, they opened the DMV on a Saturday just for illegal aliens from Mexico to get DRIVERS LICENSES!! Unbelievable!! Why do people in this country who follow the law, who contribute to society with tax dollars, get punished?

    Sorry for my rant. Please check with an immigration attorney to make sure you will be allowed back in.

    The general consensus is that if you've amassed over 180 days of unlawful presence, despite being issued an AP card to travel on, you shouldn't risk it. Cold-hearted doesn't come into it when they have to do their job, which is to abide by the law (even if it seems that sometimes they can be a little lax with the rules). If it were me travelling with my kid, I wouldn't want to risk not being let back into the country.

    Yep! Please consider this carefully before leaving... getting barred from entry for 3 years would be a disaster in many ways.

    I am scared to leave even though my wife only had 3 days between the I-94 expiration and AOS receipt notice.
