Hi, I think I am now on the second stage of my application, I have finally received an acceptance confirmation email. It says there that I will be receiving a standard mail 7-10 days With the official Receipt Notice (Form I-797).
Now my question is, is it normal to receive numbers of emails from them with I think 5 or 6 different MSC number? How many receipts shall I get from the mail? It's 2 of us applying for I-485, me and my daughter.
Please enlighten me about this matter. Your helpful response will be truly appreciated. Thanks in advance.
That's normal, you'll receive a separate receipt and case number for each I-485, I-765 and I-131 form you filed.

Don't freak out. I was fine with the information the immigration officer provided about the year wait because my wife has AP. We use it every weekend. Sometimes CBP does give her a hard time and I mentioned this to the IO and she said if your wife has done nothing illegal or is not bringing anything illegal back to the US there is no need to worry, CBP is only doing their job and she said to continue using AP as many times as needed while she waits for GC. So what if it's a few more months of waiting, we're more than halfway there. Patience is a virtue.
While I agree that patience is a virtue and it's often not worth getting too deep in frustration over individual cases, I think the more people that push back against USCIS and escalate their issues, the better. Their processing goal for I-485s is 4 months, and this is nowhere near being met in many cases. USCIS has a commitment to process cases in a timely fashion and, again, this is something that is just not happening for large numbers of people.
Along with a lack of capacity, the arbitrary manner in which cases are adjudicated results in vastly different service levels for different filers, all of whom have invested a lot of money and energy. Through no fault of my own, other people who filed on the same date as me, and paid the exact same sum of money as me, may be granted permanent residence months or even a year or more ahead of me. That's not an isolated incident, it's routine, and the implications are very real. These people can apply for citizenship much earlier, access federal student aid, hold federal government jobs, buy property with much fewer restrictions, the list goes on. No matter how much you can do without a green card, not having one is a hindrance.
There's always going to be cases that require extra processing or that get held up at certain points, and that's fine. But instead, what we have now is wide-ranging delays across the board, without any guidance on realistic processing times, without any ability to access accurate information and without any promise that the situation will be resolved.
I personally am not all that fussed about a longer wait, but I absolutely understand anyone that is and I applaud them for their efforts in trying to get answers or resolutions that could benefit all of us.

am I qualified to get an I-551 stamp on my passport?
No, you're not a permanent resident.
-
Does that mean that we have to re-apply for his work permit or they extend it? Not sure what steps to take if this process took longer than the date given on the permit...
This is all I get! Fingerprint Fee Was Received
On April 12, 2014, we accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number . Our National Benefits Center location is working on your case. We mailed you a notice describing how we will process your case. Please follow the instructions in the notice. If you move, go to; to give us your new mailing address.
I'm in exactly the same situation as you except my fingerprint fee was accepted on April 16. I also received the 7/29 waiver letter.
No movement yet, but receivers of the early July waiver on here letter have just started to be approved in recent days.
-
My first service request was replyed by email but the second one was by mail. You will receive a letter by mail in few days.
Good to know, thanks!
-
I think it depends on your field office. Mine is NYC. I submitted a service request last month and it was answered an hour later by email.
-
Looks like someone with July 10 NPIW got approved. No information on medical though. I'm not worried about medical, only because they are well aware that these delays are not our fault. Watch us get an RFE for medical for being so optimistic, HA!
I filed a service request last night, noting that the 6 month delay as stated on the 7/29 NPIW letter is up in 2 weeks, and that I was concerned about my medical expiring next month. I received an email confirmation saying I'd get a reply by 2/4.
This morning, these 3 updates are displayed on my case status, but unfortunately I didn't receive a response by email so it looks like they may have mailed it. The previous service request in December was answered by email, and I never received anything in the post, so I assumed this would be the same.

okay, this brings up a good question in my mind............... If it takes so long (up to a year) to get the first AOS 2 yr green card, then why not wait until
you've been married for 2 years and apply and get the 10 yr? Saving all that grief and money!! Does anyone have a good explanation why we shouldn't wait?
I'm sure there may be a good reason to apply immediately, but I'm not aware of it If so, please enlighten me.
Well you'd be out of status with no ability to work or travel, and at risk of deportation. Sounds like way more grief to me!

If I'm reading that right, if you want to renew electronically you have to pay the fee? I know theres no fee to renew your EAD as we're still processing I-485 but from what I can see there we have to renew by mail, since we have to include our NOA1 anyway to waive the fee?
"
- You pay the Form I-765 filing fee; and,"
Oh, you're totally right!
Ignore the above then. Instead you'd file another I-765 by mail and select "renewal" at the top.
-
Oh! Wow! Can't believe this taking longer than what we are expected. Geezz. Btw, what are the requirements to renew our EAD card? And what address should we use to send them off?
You can renew your EAD up to 120 days before expiry, but not before this. See instructions for electronic filing here.

Hi guys,
So I had my biometrics on the 17th of december and my case status has not changed off of fee for finger prints received. Should there of been an update after I had my finger prints taken or will it not update until I hear about my potential interview.
Thanks in advance
Don't worry, I had my biometrics in early May and my status still reads the same as yours.

We got our notice of potential interview waiver Dec 11 2014. My husband used his advance parole to go home for the holidays so he no longer has that. However, we were planning on having our wedding ceremony in his country this May (we are already married on K1 of course), and now I'm worried that he won't have his green card in time?? Does anyone know if he can get another advance parole or if there is anything we can do so that he is allowed to leave and reenter the US?
Advanced Parole is multiple use. You can use it for repeated entry for as long as it's valid, or until permanent residency is granted.

I was looking at your timeline in your signature and I was just wondering if your medical had expired and if USCIS requested a new one?
I've heard nothing since the waiver letter, but I'll post here as soon as I do!
-
I submitted AOS april 11,2014 and got interview waived letter July 29. Status is still fingerprintfee acceptance. It will be 6 months this january 29,2015. And ive been reading possible new medical record requests after all. Instead of being excited i feel worried. Are you with me?
I have pretty much the exact same timeline as you
-
I didn't see a forum for april filers. So I figured I would post my frustration here.
-
And you can just contact him? Or does it work?
You can contact his or her office. They should have a staffer that deals with immigration issues.
-
Thanks for all the information.
I am still under the 75 days period so I will wait a little bit more. My wife has a full-time position, so extreme financial hardship doesn't apply neccessarily. One salary is just tedious for both of us sometimes.
I don't have a congressman or at least, never used anything like that.
Everyone does. You can find the representative for your congressional district here: http://www.house.gov/representatives/find/

Next Steps

If we accept your case, you will receive a receipt notice. If we reject your case, we will send you an explanation with instructions.

As of January 6, 2015, your inquiry about why your case is taking longer than our processing time, referral number T1B3641400948BOS, is currently not assigned for processing.
Thanks Natonstan for the help....I was wondering if anyone knows what this means? I'm referring particularly to the most top part? Has anyone ever encountered this before?
Generic message, appears on all cases under "next steps"

Hi,
I sent my application on the 31th of October. i also filed for EAD and AP.
I had my biometrics on the 23th of November.
When checking my status on the USCIS website, it says that I am waiting to get my AOS interview since 1st of December.
I called USCIS to know about the processing time, as they were advising me to call if I didn't get my interview notice by the 31st of December. I got told that
it could be over 4 months to wait as my area was really busy with applications (Southern California).
I understand that completely but I am now wondering about my EAD.
My case is still in 'Case was received' situation since November, it never changed.
I received a job offer that I cannot accept for now, and the company is willing to wait a little, but I would lose a nice opportunity if
it takes too long to get my EAD. I have heard of expedite processing for EAD but don't know if I can really apply to it.
I am also worried about getting an actual RFE as I have seen people receiving RFE after 75 days of filing their applications.
Anybody applied for expedite processing of their EAD or the fact I am still in the 60-90 days period of filing will get me denied?
Thanks
Talk to your congressperson. I expedited my EAD successfully based on a job offer. Mine was approved within hours after I spoke to my congressman's office.
You need to demonstrate some sort of financial hardship, but all I said in this regard was that my husband had been unable to secure a full time position and was working a contract role that could be terminated at any time (this was true). There's no guarantee, but there's also no harm in trying.
-
so...should i apply for I765 like 3 months earlier before it expires which is on May 29 and do i still have to pay for it or whatever??
It's free to renew as long as your AOS is still pending. Just include a copy of your I-797.
-
And I saw someone else say that we will have to wait longer to apply for citizenship, but from what I saw on the USCIS page you can apply three years after the date of marriage. Is that correct? Can anyone please confirm?
No, it's 3 years from the date you were granted permanent residency (or 5 years if you are no longer married to a US citizen).
-
The other are other issues that come up as well:
1) Medical expires
2) Limited term drivers license issued ( State of Texas )
3) Unable to get loans that extend past the limited term drivers license. i.e. car loan
We went to the bank to finanace a car; we were told due to the limted term drivers license that they could not make a loan past the validity date of the drivers license.
Also every day we wait now is another day at the other end until we can apply for citizenship. Those who have had interviews and been approved are eligible to become citizens much sooner than those waiting 9-12 months with no decision.
That I can currently work and travel is a sidebar to the problem, that problem being that it shouldn't take a year to process an application that doesn't require an interview. It's especially unfair that some of us will be facing the unnecessary costs of redoing our medicals, through no fault of our own, on top of the $1075 we've already paid.

I just put a service request into the USCIS site for the hell of it, not expecting much help but thought I might as well, I noticed it's been assigned to an officer and that the referal number ends with DAL? Does this mean my file has likely been moved to Dallas without me even knowing? I've seen people mentioning this on here that they're sending them out to service centers due to being overloaded
My response came from the New York City field office who, as far as I can tell, don't actually have my file. I think it's assigned by address.

Hello.. Nancy.. Thz for the advice . Nope I dun hav the work permit . Coz I am not working now & has to study for my licensing exam ????? So apart from my passport ( visa stay expired at Nov ).. I hav no IDs. Do u think I can travel with the receipt & marriage certificate ??? Thz u
You don't need your receipt or marriage certificate for a domestic flight. All you need for domestic travel is a valid ID, like your passport.
It doesn't matter about your visa, they won't look at that. It's a good idea to have some sort of proof of status available to you, should something out of the ordinary take place. But unless you're traveling to cities near the Mexican border, you're not going to be asked about your immigration status.

Hello!
You should have your EAD/AP within 90 days. Current processing time seems to be pretty close to that mark.
Green card, on the other hand, who knows? Since you arrived on a K1, it's a possibility that you will have your requirement for an interview waived. Currently, interview waiver cases are taking 9-12 months to approve. I filed in mid-April, received the waiver notice in early August, and have had no movement on my case since.
