    I didn't list the I-130 approval date as we never received the USCIS approval letter. However, I can find it out online.

    Priority date is the NOA1 from USCIS and its showing up on CEAC website.

    (fyi I also had Dec 2008 F3 petition, our approval took around a year as I recall.  So I’d find it strange this one only just got approved.)

    No, 6th Sept 2019 is the date written on the CASE CREATION LETTER sent by the Embassy/NVC. This letter was received in the last week of september. I checked the Visa bulletin F3 case of Jan 2008 became current in Sept 2019. So, yes took 11 years+ for petition to be approved and forwarded to NVC/Embassy for processing.

     

    How do I get the CSPA started ? Just email the NVC ?

    I need help in how to start the CSPA proceedings. My aunt got her Immigrant Visa Approval letter from the embassy recently. Her spouse and one kid is showing up on the CEAC website. However, two of the kids are not showing up on the CEAC website as they have crossed 21 years of age. I think they still qualify as they are unmarried and 11 years of petition approval time can be subtracted.

     

    Should I add their kids to the CEAC website ? Do I have to file another petition using CSPA for the kids who aged out ? Not sure how to start the process.

    I am looking to get expert opinion from the VJ members. My sister's US Citizenship is in process and we are still waiting for the interview date. Also, her green card has been expired since a year. Now we have to travel in July. We went to the Boston USCIS office to get an I-551 stamp on the passport and they told me that they cannot stamp it if the green card expired is more than 6 months. They told us we have to file a green card renewal and then come back for I-551 stamp. We tried to tell him that my citizenship is in process and I will be the US Citizen in 6-7 months.

    I don't understand when the citizenship application is in process, how can you apply for green card renewal ? Also, why the N400 receipt or biometric letter is enough for I-551 stamp ? We don't like to hamper the citizenship process, but we really need to travel outside the country in July.

    Can someone please help ? Should we approach the lawyer for this issue ?

  4. It takes 12 years for a USC to petition for an available visa for a sibling.

    Even if the I-130 was approved in 5-6 months, the approved petition would sit and wait for another 11.5 years. So, what is the priority for USCIS to approve F-4 cases in 5-6 months, when there are other cases in other categories that needs processing? The long wait for an available visa is why the US does not prioritize F-4 cases to have approved I-130s in 5-6 months.

    Furthermore, does your siblings have children who will turn 21 during the wait? If yes, then the long time to approve the I-130 is a good thing since it offers children who will age out more time. The longer the wait for an approved I-130, then the better the protection under CSPA.

    My cousin filed for here sister in April 2010. The I-130 was approved in April 2012. That means two years of additional CSPA protection. We anticipate that visas will be available in 2021 or 2022. Unfortunately, she will have a child that will age out because he will turn 23 by then. If USCIS had taken 5 years to approve the I-130, then he would have 5 years of CSPA protection and would not age out until age 26.

    Believe me. You want the I-130 approval to take as long as possible if your siblings have teenage children. Leave everything alone. Don't contact USCIS to hurry up the process.

    What you think is bad is actually very good under these conditions.

  5. Hi Everyone,

    I am a US citizen and filed I-130 petitions for my sibings in July 2013. Its been 1.5 years with no update on the case. Both the petitions are in VSC as the receipt number starts from EAC.

    I checked the processing time for it and it says tVSC is currently processing petitions from Nov 2011.

    I failed to understand that the national goal for processing I-130 petitions is 5-6 months. How can they take 3 years just to approve the petition ? Then there will be additional visa wait from NVC.which is like 8-10 years.

    Please, advise the best course of action.

    My spouse had the interview The interview went smoothly and the visa was approved.. I am still waiting for the passport for my spouse. Beneficiaries living in ISB should be able to pick up the passport from the embassy the same day. That's what I heard. The case is in AP currently. She didn't get any 221g slip which is a good sign. The CO said that it will take 7 days for the visa stamping. Does any one know how long it takes ? I heard like 2-3 days.

    The only thing they asked for Medical, passport, passport sized photos, interview letter and our pictures... We over did our work with personal relationship evidences, forms, tax returns, etc. We concentrated a lot on the evidences and pictures. The CO didn't see the wedding album as it was huge in size. But we color printed out the highlights of different pictures (including skype and us being together) on a word doc. The CO was really interested in our story like how do we know each other and how the long distance relationship developed. Lol
    My wife was out in 10-15 minutes from the time of the interview with CO. Off-course, she had to wait for her turn. Over all she was done in 1.5 hours. Her interview time was 7:30am and she was out at 9am.

    My interview is coming up this week and I just want to go by an expert VJer to make sure that I am not missing anything. I have attached the documents list.

    So from all that I'm gathering we need to bring the following:

    Medical

    Passport

    Photocopy of the birth certificate

    Interview letter

    Two passport type photos

    Photocopy of marriage certificate

    I submitted the original birth certificate of my spouse, but they still sent the status code of F.

    Same case for PETITIONER MARRIAGE CERTIFICATE which I sent original to them.

    Any thing else that I need to bring ? Also, I am confused about the PCC. The local police station made the PCC valid for only three months. I have the issue date of Oct 25th, 2013. According to local Police station laws, the PCC has been expired. But the interview letter says the following

    "A new police certificate from your current country of residence, if you obtained the police certificate more than one year ago."
    Does that mean that they will accept the PCC; as it's not been more than a year old.

  9. You will remain at NVC until you get n interview. Unless you requested an interview and it was approved. Your case doesn't go to embassy until an interview is assigned so the status is correct.

    You called January 21 and was told you had case complete. The letter always comes a week later that was the email you got on the 29th the case complete email.

    now you wait. Is your priority date current?

    i got an interview date on Jan 29th but my case on CEAC website still says its at NVC, Now I am wondering if the package has been mailed to ISB Embassy or not. How long does it take to update the website?

  10. I would advise you to submit the NADRA Marriage Certificate along with Original Nikah Nama in Urdu and it's original translation. Make sure you have the Foreign office stamps on it.

    NADRA marriage certificate is an optional document, it provides further proof of marriage. I recently got a false checklist just because of missing the NADRA marriage certificate. You might not. Depends on the person whose reviewing your package. If i knew if they gonna issue the checklist, I would have submitted the NADRA marriage certificate in the start.

    Ok guys I am about to send in IV packat..quick run down:

    Original Documents:

    Marriage certificate (From Union Counsel, Nikah Nama (both English and Urdu).

    Birth Certificate Beneficiary only

    Police Certificate (I know its not required but since I had the documents coming anyway, thought/suggested by VJ'er member that it wouldn't hurt)

    Copy of Passport Bio page- Beneficiary only

    2 Passport size pictures of beneficiary (with name and DOB of beneficiary written on back)

    Am I missing anything else?

    Also for CR1 Visa, is there any type of fee my wife needs to pay at the Embassy?

    We have a daughter (she is USC through CRBA process), can she bring her to the Embassy? Or leave her with her grandparents.

  11. Quick question for all Pakistanis who are going through NVC process or their case completed already in NVC

    I would like to know if someone has submitted original Urdu Nikkah Nama (my nikkah nama has local registrar and Foreign office stamps) and original English translation (mine has foreign office stamp on it) without NADRA marriage certificate and they didn't receive any RFE? I received a RFE that they didn't find the marriage certificate. I am thinking they are referring to NADRA marriage certificate.

    As per NVC website, NADRA marriage certificate is not a requirement but can provide further proof. In my circle, no one has submitted the NADRA marriage certificate and their case got completed in NVC without any issues. But that was few years ago. I don't know what the latest trend is.

    The NADRA marriage certificate can provide further proof of registration. For immigration purposes, the Nikah must be registered.

    The original Nikah Nama is usually in Urdu and is required for consular processing of immigrant visas. The NADRA marriage certificate is not an acceptable substitute for the Nikah Nama. Attested translations of the Nikah Nama should be provided. In some larger jurisdictions, such as Karachi and Lahore, an original English Nikah Nama may be given upon request.

  12. NVC is giving me trouble in every step. They are claiming that they have not received my marriage certificate in the Civil Document package or it didn't have the right seal/stamp. Funny right! I wonder how incompetent their contractors/employees are. I have the proof that I sent the marriage certificate in the Civil Document package. They received everything just not see the original marriage certificate in the package? They just misplaced it somewhere or the person who opened my package was blind. They gave me a similar issue with my AOS form saying that I didn't use the correct I-864 form. After reviewing they corrected it.

    Does any one know the contact info for the higher managements (Director or Manager) in NVC ? I am looking to send a fax to them. I have already contacted my senator but there has been no update from them either.

    Help will be appreciated.

  13. Happy for you ! They have the right to putt even a note on your case if somthing is wrong. This was the only way we resolve everything and now we are waiting for the interview date.

    The supervisor reviewed the AOS package and he corrected the checklist. I did use a correct I-864 form. So, AOS is all set.

    I sent all the civil documents (including the marriage certificate) in a separate package and the operator told me that I didn't send the marriage certificate and I need to send that.

    How can they lose the marriage certificate ;(

    I have asked the Tier 1 to have supervisor review the package again. Hopefully, they will find it in the package. NVC is awful. I cannot stop worrying about my original marriage certificate;(

  14. Yes, exactly, you used the latest form, which is correct. So what they' re saying makes no sense. What is called a Tier 2 at USCIS is called a supervisor at NVC. When you call, just request to be transferred to a supervisor.

    The supervisor reviewed the AOS package and he corrected the checklist. I did use a correct I-864 form. So, AOS is all set.
