  1. Hi
I was wondering if anyone can help me, my boyfriend and I are UK citizens and he got transferred to the US on a L1 visa from his employers at the time of him completing his visa application we didn't include myself and my son on his application as the time was not right for us to get married and move. He then went to stay in the US in October 2018 alone, We have since realised the time is now right for me and my son to move over and we are making our plans to get married. We think we have to apply for a L2 visa for myself and my son to move to the US but we are not sure. He also is under the impression he has to approach his employer for them to change his visa for us to move, my main questions if anyone can help are;, he is in the US now and I am in the UK

Does his employer have to change his visa?
if there is a way to do it ourselves does he have to inform his employers ?
Do we have to get married before we apply?
would we have to get married in the US or the UK (he is over here for holidays some of the time)
    how much does it cost?
    how long does it take?
What documents would we have to submit?

any help would be very much appreciated .

  2. Hi I was wondering if anyone can help me, I was with my boyfriend for 3 years when he transferred with his work from the UK to the US on a L1 visa, at the time I didn't want to move to the US and we split up, we were still very much in contact everyday , he moved in November we have since both realised we can;t be apart and when he was back to the UK at christmas we got engaged and we have decided that me moving to the US is what we both want.  He is now back in the US working and I am here in the Uk,   However we don;t know where to start with the visa process for me and my son to move over.  Can anyone help us? as to what we need to do

  3. Hi yes I can also confirm it is not date of birth or anything similar, I called NVC and they gave me both my mine and my son's numbers. I have been working on this form today, for hours it is a bit of a nightmare as it asks for details of petitioner and his relation to the applicant, the only one I could choose was spouse,(there was no fiancee, only spouse, mother, father, uncle etc) I rang the NVC to confirm this would be the option I choose they said yes but I have no idea what one to choose for my son, looks like its back on the phone to them

  5. thank you for clarifying Nich-Nich, I don't know what we would all do without your help and dedication

, I have changed my medical to this Friday instead of the week after, I am still waiting for packet 3 so hopefully this will be today, as I am having no luck getting access to the new DS260 form, I have tried with my date of birth but no joy, I have all my other forms ready, they have been ready for months but remain undated as yet, just need transcipts and employer letter (is this required) as I have transcripts and I -134?

  6. Hi can anyone advise if I will be required to submit with my documents that I send with packet 3 or take to interview a revised and notorised letter of intent to marry from my american fiancee? we submitted this with the i-129f, I am just trying to be ahead of the game as he is in the states just now but will be leaving the country soon to go to work in africa for the next 8 weeks and I am hoping to have my interview during that time and this is the only chance I will have from him to send me any more required documents ?

  7. thank you, is the payment thing when I have packet 4 or 3, I am still trying to figure out the new form and the reciept number thing as it is not working with my DOB, its all changed so much as my visa journey is taking forever, I came away for about a month as nothing was happening and had all my documents ready and was all prepared and now everything has changed so much

  8. Aww thank you, I called yesterday and booked my medical for 11 October, flights also booked for the day before just have to find a nearby hotel, got all my paperwork ready it been sitting for months as we were delayed with transfer to texas then a ridiculous RFE, I think from what I have read one of the forms have changed, and I have changed address but I am thinking I should inform them when the file hits London. I have my son included on the visa so have all his paperwork also.

  9. We have managed to find out what the Rfe is for, my American fiancée only sent the last page of his divorce papers and they are looking for his final absolute divorce decree!, he is arranged for the 40 page document to be sent here for me to look for the page! Has anyone any idea what they are looking for? Jason suggested we send the whole 40

    Pages to them?

In the uk my one was accepted as it is a one page document which is red stamped from the court

    Any help would be great

  10. thank you all so much for replying, it has been a huge help, in this constant nightmare of a visa process.

I do believe you are right Anna I think it is 30 days we have to respond, we are going to get a realative of Jason's to check and email us a copy if it was there, we are kindof hoping it will be there today, as we were notified by email on monday 5 August and our file is in texas and Jason lives in Houston texas so fingers crossed it left in the mail on Monday and it should be at his house and we can find out what they require from us.

  11. Hi Can anyone help us, after a long 5 1/2 month wait and our file being transferred to Texas (June 21 2013) we recieved our case was updated with the following

    Request for Evidence

On August 5, 2013, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case ..................etc etc

As my American fiancee is working in Europe for the next 3 weeks and has no access to his mail at home, he called USCIS (a 3 hour wait to speak to a tier 2) and was told he has to wait to check his mail when he returns to the US and they could not furnish him with any information over the phone.

My questions if anyone can help are:

    1. Is this an RFE?

    2. if so how long will this delay our case?

    3. We have a senator who may be helping with our case, could he get the information from USCIS over the phone and advise us of what they need?

    4. typically what further information is required in a RFE? We were certain we had been included everything and more that was required

    any help is appreciated

    Anne
