  1. My husband and I have to make the move back to my home country due to my father's health. I've been a LPR for four years. We've discussed me getting my US citizenship before we leave. The US is truly my home now, so to throw away four years of living here seems difficult, and we may desire to move back in the upcoming years. Meanwhile, my husband has to file for his visa/permanent residency to my home country. Could we do this at the same time? (Filing for my US Citizenship, and filing for his Australian visa). Or will that be a red flag for the USCIS and my citizenship? Thanks.

  2. With the proper documentation you shouldn't have any issues traveling. I don't understand how you could not travel alone with your own daughter???

    Documents you should consider bringing for yourself: Your valid Australian passport, your conditional Green Card (if it has expired, also bring your I-797c ROC petition receipt/extension letter), a copy of your marriage certificate.

    Documents you should consider bringing for your daughter: Her valid US passport, evidence of your parental relationship (i.e., US or foreign birth certificate, adoption decree, divorce/custody decree, CRBA document [FS-240]).

    Right. I have read a few times on this forum, "You (LPR) can't travel alone with your USC child." I'm glad that's bollocks. Many thanks for your help.

    We are getting things prepared for my USC daughter's dual citizenship (USC + Australia). The uncertainties we've faced is that I have not registered my "change of name" with Australia (with the RBDM NSW). My passport is still in my maiden name. So, effectively, I'm known as Snag Smith in Australia, but Snag Jones in the US. Will this complicate the process of obtaining her Australian citizenship? Should I go ahead and try to register my married name in Australia, then change my passport beforehand? Many thanks in advance.

    We ended up just loading up four suitcases to the brim with my books and clothes, and checking them in when we traveled back to the US. Of course, we had a trip planned to come back to Australia, but we figured if it were going to cost $5,000 to ship a small array of items of mine, we might as well come out and do it ourselves. I had no furniture, or bulky items. Just a ton of books. The suitcases were just under. Just a thought!

    My USC husband and I (2yr LPR - applied for ROC) traveled to Australia (home country) a week ago with our USC 14 month old daughter. My husband is heading back to the US in a week, and I'll be here for another two weeks with our daughter (she is on an ETA). I'm traveling on my Australian passport which is in my maiden name. Will I have difficulties entering the US with my daughter considering I'm doing so without my husband? I think I read here once or whatever that I could not travel alone with our daughter without my husband's presence or approval. This site has a wealth of info, but like anything, there's always that one guy who throws misinformation out there, so I thought I would clarify. Thank you!

  6. Wahoo. Almost two years after my original post on this thread, and I still haven't changed my name/passport. But here I am in Australia to register my change of name. I plan on obtaining the certificate, then changing my passport in the US. My return ticket is in my passport name (maiden name). Because I'm changing my name here, will my passport still be valid? I believe you can choose to amend the birth certificate OR just obtain a change of name certificate without altering the BC. Basically, I'm a little bit fearful of registering my name here, and my passport becoming void because I'm no longer known as "Snag Smith" here. (Probably irrational, but does anyone have any input?)

If we book our vacation back to my homeland in December in the next few days, I'll tack that onto the end also.     • Completed I-751 form (5 pages).
    • Front and back copies of conditional green card of non US citizen (2 pages).
    • Evidence of a true and bona fide marriage including copies of the following:
    • Tax transcripts and W2s for the years of 2014 and 2013.
    • A joint signed lease for the apartment occupied from March, 2014, to June, 2015.
    • A signed notification of move out form (1 page).
    • A joint signed lease for the apartment in occupancy from June, 2015, until June 2016 (37 pages).
    • Half yearly bills for car insurance proving joint financial responsibilities (2 pages).
    • A copy of both credit cards proving a joint account (1 page).
    • A copy of life insurance policy showing conditional alien as beneficiary.
    • Joint car insurance policy.
    • Joint renters’ insurance policy (4 pages).
    • Letter from the Healthcare share in which we are both members of, proving family membership (2 pages).
    • Credit Union #1* statements of joint account.
    • Bank statements of joint account (24 pages, July 2014 – June 2015).
    • Credit Union #2 agreement of joint account (1 page).
    • Credit Union #2 statements of joint account (8 pages).
    • A birth certificate of our daughter (1 page).
    • Evidence of Costco dual membership.
    • Boarding passes of vacation to Australia in December, 2013 (1 page).
    • Train tickets to further evidence of vacation
    • Five family photos taken at various points of this year and last year (1 page).
    • Cards addressed to us from family and friends (2 pages)

    Copies of documents submitted are exact photocopies of unaltered documents and I understand that I may be required to submit original documents to an Immigration or Consular officer at a later date.

  11. Hoping to file ASAP, as the 90 days started on the 17th of July. But there's a few questions I have about my packet.

    1. We're planning a trip to my home country for about a month in December so my folks can meet their granddaughter/niece. From my understanding, I'll be granted an extension on my conditional greencard for a year. What happens, then, if I'm approved whilst traveling (for ROC), thus my 10yr greencard is printed? Can I enter the US still with my one year extension temporary GC?
    2. Would this trip be something to include with my ROC evidence to further prove a bona fide marriage?

  12. Slowly putting together our i-751 packet. We've managed to put me on some of our short term credit cards (so making them joint cards) to further our evidence. I feel like this is a noob question, but will this look a bit peculiar that all of a sudden I've been put on the accounts on the same date, and so close to our case being reopened? If it weren't for immigration, there wasn't really any need or desire to put me on the accounts, other than to maybe build credit, or something. Or, if I submit other evidence that proves that our marriage was entered in good faith (and we're still very happily married), will they just assume this is the natural order of things?     Has anyone here researched the Australian immigration process? Besides the cost, how different is it to US immigration? I admit we never looked into it much because it made much more sense for me to come to the US than my fiance moving Down Under. (He had a stable job, a car, church, a closer knit family etc). But, we're thinking much later down the track, and doing a bit of reading up on it all. Also, are there forums people know of for Australian immigration that people can suggest? Ta.

    I'm wanting to make sure what I have listed below will be sufficient for ROC which will open in about two weeks. We don't have much evidence regarding joint bills, utilities, or credit cards, so anything anyone can recommend would be appreciated. Also, if anyone can see anything that's just wasted paper, that would be appreciated, too.

    1. A joint signed copy of our previous lease (Mar, 2014 - Jun, 2015)
    2. A joint signed copy of our present lease (Jun, 2015 - Jun, 2016)
    3. Evidence of a shared bank account with a credit union
    4. Evidence of a shared bank account with a bank (would it be beneficial to print off statements to prove we use said account?)
    5. Car insurance in both our names
    6. Renter's insurance in both our names
    7. Health share plan (alternative to insurance) in both our names.
    8. W-2s
    9. Birth certificate of our eight month old daughter
    10. Boarding tickets/photos of Australian vacation, 2013
    11. Photos and birth announcement of daughter, us together as a family etc
    12. Cards addressed to us (though not to our new apartment).

    Anything else? Would this be sufficient? Thanks in advance.

  15. She is involved with the so called person who is giving her a ride to work. I think there is someone shes interested in. I think you should look in to that and find out what is going on there if you want to try to save this marriage.

    That's a big statement to make on such a little information base. My husband works in a prodominantly female industry, and has caught rides to work. If I had a penny for every time I thought he was having an affair with the woman who drove him, I'd be in the same financial spot as I already am at this moment.

    OP, I would try to work things out with her. If you entered the marriage in genuinely good faith, then it's worth working on and working out. If it were me, and all was completely hopeless, I'd return to my native land, back to my friends and family, and try to rebuild life from a country I knew. Sure, it sucks that you've left everything for this woman, but I'm going to assume that you might have more support in your home land.

    Im finding a hard time trusting people now,my fiancé is cheating on me as well I don't know what to do. He said that she is a business partner .

  17. For those who are asking, "Why are you still with him?!" Abuse can be very, very complicated. I'm not justifying and even suggesting that she stay with him, but abuse is more than, "Oh, he just hit me. Guess I'll leave. See ya!" It's usually coiled up with emotional manipulation, too, such as groveling, bargaining etc the next day or what have it.

  18. I am heart broken and devastated, but the more I thought about it, the more I thought that I was being used. She has been shallow and cold with me since she came back from a trip in Europe and talked about how she wanted to move there and teach. She is currently studying so she is really focused on school and always was her main priority.

    Sorry for your devastation. Perhaps I'm missing something, but if she's seriously mentioning moving to Europe to teach, then I'm not sure she "used" you for residency. Perhaps her words are but smoke and mirrors, but going by that alone, I don't think she necessarily was after the green plastic.

I do reckon it's pretty darn hard as strangers (who have no idea who you are, haven't observed the relationship, don't know you two mutually) to give you real solid advice that can be thoroughly digested. (With a name like TBoneSteak, there was no hope for me not to use foodie words). From the sound of what you've painted (that totally works, right? Paint and sound), I would say get your runners on and run as fast as you can. You don't want that sort of drag in a marriage - constantly criticial, stepping on eggshells, and a forced player in the blame game. Marriage doesn't much have to be about compatibility as much as it has to be about respect, and sorry, TBoneSteak-Burrito, it sounds like you're getting zip at this stage in the game. Better to run now than in five years of hopeless agony, with a possible baby on your hip.

    Apart from that, I'd encourage you to talk to people who know you both, and have observed the relationship in real life. All the best.

Fiance is SUPER controlling… Demands to see my bank statements to track my spending, Tells me when i move to the USA i have to make a good effort to fit in to his life and he doesn't want to hear me complaining, numerous times i have had to wire him across money, refuses to make a trip to australia because its "to expensive" so i have to take the trips to the USA and cover the expenses. Tells me it would be "pointless" for me to finish my studies…. and the list goes on!

    Yeah, you don't want that sort of loser in your life. There are so many persnickety and peculiar adjustments to get used to over here (who knew? Two English speaking countries to be ever so different), that a support network - with husband in the centre - is pretty vital. All the best, mate.
