First let me tell you, my fiance is 12 years younger than me and this is not my first 129F application. Back to 2008 I filed for a sucker (excuse my french) then he came in March 2009, he took off after getting his 2 years green card. I sent a certified letter to CSC that approved the AOS and one to VSC which is my jurisdiction and one to my local office (Boston). I even went to Boston office twice to let them know that I don't know his whereabouts and the copy of my divorce filing. I met my fiance now, we are so much in love. We went in Dominican Republic for the first time 10/06/11 and went again 05/15/12. That same day I arrived at the hotel, I received a call from my sister in Boston, that my mom passed away with heart condition. I couldn't find a flight back on AxA to Boston right away, I bought another ticket through Jetblue to proceed with mom's funeral arrangements. I filed for my fiance on 07/10/12 which I thought the process will go faster and VSC took forever. I thought of traveling to Haiti but I said what about if NOA2 showed up...all these crazy thinking.

    To get back to the interview process today, those are the questions:

    1. Who's sending for you? My fiancee so and so

    2. How did you guys meet? Social network...

    3. How many times that you saw your fiancee? 2 times in Dominican republic October 06, 2011 and May 05/15/12, we stayed at this hotel..... The CO said I see

    4. She didn't come to see you in Haiti? No, because we chose to go exploring somewhere else(DR)

    5. Have you met her family? Yes, I met her brother (first and last name) who came to Haiti in July 2012

    6. Did you know that your fiancee was married twice before? Yes, and she got divorced

    7. So what happened to the second marriage? The guy took off and she never know his wherabouts then she got divorced

    Then the CO said "Ok Mr X(my fiance), you are not qualified, this not the end of the world. You can still get married.

    I feel that this is very insulting. Does Immigration can tell me how many times to get married? Does Immigration can tell me "Hold a gun on your fiance's head to stay with you? Does Immigration can tell me or my fiance "Marry someone your own age? Does Immigration can tell you to look for someone in the states and make sure that someone has a green card?

    I only filed I-129F once and the relationship went bad. I worked in my job for 23 years, I paid taxes and never been in jail or either been accused for domestic violence. Never, Never, Never so I leave any comments or suggestions from you VJers for me what's the next steps...Thank you and I am very Saddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddddd.

    Should I go to Haiti and get married? but my fiance said to me" Baby, I am afraid if we go the I-130 process, will they look at it the same way. He said again "Baby I swear that I answered everything, all questions" He added "I feel bad that outsiders look at Haiti as a poor country that people might use other people to enter the USA but one thing, the CO deny the real lovers" That breaks my heart and my fiance said to me "What about if you come to leave with me because I know in my mind, there was no such thing and I want to prove them that Denying us can't break our relationship.

    I am so sorry. The CO in Haiti can be very tough I went through the same Consulate as you. I read your story and I myself have some concern. I don't believe it's the age difference. I just had my interview back in February and I am 11 years older than he, and they not once questioned our big age gap. The CO probably looked at the facts that (1) you met on social network and only saw each other twice being 7 months apart, (2) You not once met in Haiti instead in the DR... so there probably thinking you haven't even met his family or friends, like it wasn't legitimate etc... if you look at Barbie_Vasquez timeline one of my friends on my page you will see that they denied her fiance for that same reason, for her not meeting her fiance in Haiti instead in the DR, (3) You were not in attendance with your fiance at the interview. It builds a stronger case especially in Haiti when your accompanying your fiance ... I learned that through another visa journey friend of mine mtcmk1 (please read her review) also one of my friends on my page. Example: the day of our interview when some of the papers were returned to us, we got to the hotel and was looking at the things they returned to us. we found a little sticky paper the said the PT is here. My fiance looked at me and said babe did you write this, I said no, and we asked ourself the next question what is PT? thats when we notice it meant the petitioner is here..They actually warns the CO that the petitioner is here with the fiance, and (4) you stated you were married and got divorce basically to a jerk; however the CO asked your fiance did he know you were married TWICE!!! this could be the biggest flag... Question: were you married twice and how long apart were they? because the CO is probably looking at it as this being your possible third marriage,probably looking at the time frame between all of these commitment (possible thinking fraud),etc. Please do not marry to soon, because in Haiti they will probably deny it again. My opinion wait for more information and go from there. First starting with visiting your fiance more often in Haiti, and build a stronger relationship for the eyes of the CO. I know eventhough you know that your relationship is a bonifide relationship, you have to make it look that way to the CO's because they can't see what you know they are only going on the evidence in front of them, and there probably thinking it wasnt enough connection between the both of you (meaning face to face).

  2. Hello everyone I'm new here and I'm about to go crazy lol. seriously!!!

    I would like for my hubby to permanently move to the U.S. I file the I-130 Petition then the K-3 then request to expedite it because his life is in danger in Haiti. I received an email request for evidence for the expedite process, its been 33 days since I sent all evidence no response from USCIS. To make mater worse interim my husband has been hospitalize 2X both in Haiti as well as in DR. I had thought a K-3 would be a good path for us and then apply for an adjustment once he's in the U.S., but not so sure about it after reading posts on here about it being either a bad idea or not available anymore. so my question is... should I now request to expedite the I-130 as well due to this new medical development? Any help would be greatly appreciated. God Bless

    I have read many post were miracles can and do happen. Everything in life is a chance. I do know you stand a 50/50 chance, rather it is granted or denied, but you will never know if you don't try. You will find some people to very judge mental and discouraging. It's all about taking a chance, and we don't know your story, maybe you do have a good reason and fact to back it up, so my thoughts to you we here at visa journey are not the Consulates that are reviewing your case, and if in your heart you have a excellent cause to why your husband life is in danger as well as being sick, just maybe you will come across that consulate that would agree with your reasoning. You just never know

  3. I am getting ready to send in my IV package and I have a bit of an issue and was wondering if anyone else had that problem. My husband's birth certificate got burnt in a fire(We do have a copy of it). We tried to get something "l'extrait des archives" per the consulate from the national archive of Haiti but we are being told that after research was done, they couldn't find where the birth certificate was registered so basically they have nothing. We were able to get a certificate from them stating they didn't have it. A new birth certificate was also issued (late registered birth certificate)On the new birth certificate they mentioned that his mom and dad I guess came to have it registered late. The thing is that his dad died a few weeks before he was born. Not sure why they put that down. We have his baptismal certificate. Would that be sufficient with the certification from the national archive stating that the birth certficate wasn't registered?

    We had the same problem before we turned in our package4 for Christ (k2 we had to get a Civa Card and when we called the consulate a very nice man told us that we needed the extrait des archives from the national archive in Haiti which the consulate will want to see and they do verify. what we had was a letter stating that they did received the child birth certificate but it wasn't registered yet at Haiti national, but the man told us we stand the risk of being place on administrative processing if the extrait des archives was not sent in. We hired someone that dealt with birth certificate, etc and she was able to get it registered and we was given a copy to include with our package 4

    I notice your at the I129F stage, and you sent western union receipts, phone records, etc. Please please keep a copy of these items, because usually these items are evidence that you will need for your K1 package you will be sending your fiance in Haiti once your I12f is approve, and your file has been sent to Haiti. Every Country criteria is diffent and these items are very important once your ready for your K1 process. Every piece of evidence you send in your K1 package will be paid close attention to by the Haiti Consulate Officer. So welcome aboard, and you will notice that everyone here at Visa Journey are so helpful. Being that your going thru Haiti, you have a good support of members that also went thru Haiti and has already been approve and are very helpful on assisting you thru your journey. Good Luck again

  5. Can you get married without the social sercurity card? Get your liscence? Please let me know

    We live in Miami, and a friend of mines that went through the same process before I did said you do not need a social security number. He was able to marry his fiancee without it, and for the id he was able to use her passport, because they are aware of the k1 process and not having everything upfront in the beginning

  6. I sent my I-129F package to the USCIS facility in Lewisville, TX 2-DAY UPS last Friday, March 22nd.

    It was delivered by UPS on Monday, March 25th and I just checked my bank account this morning (March 28th)and the check was cashed.

    Does this mean that they accepted my application? (which was 187 pages long by the way)

    My fiance and I have been together for 3 years and I sent everything I had, western union receipts, phone records, cell phone top up receipts, borading passes, etc. lol ;o)

    He is in Port-au-prince, Haiti. I'm sooooo anxious, I thought I would use some of this love energy to post and share my experience with all of you and learn about your experiences.

  8. We brought copies of everything we submitted. We just didn't want to take a chance because I read where sometimes things can get misplace by the CO's. Also tell him to be prepared to answer the questions "What do you love about you fiance" that's one question I notice they basically asked everyone when I was there, and they pay real attention to that response, also about where you work? How did you meet? do you have any kids if so there names?, me and my fiance was basically asked over 10 - 12 questions, but every case is different if there looking for something.

  9. Hello my friends!! I'm packing and getting ready to head to Haiti. I don't know if I'm going to make the flight since I'm using my benefits with AA to get there :lol: :lol: . What are the chances of him getting approved without me just in case I don't make it before Monday? And What are the last minute preparations we need.     You guys will be ok don't worry just answer everything that they ask you, and if your not able to make it just make sure he is well prepared and knows everything about you. God is with you guys. Good luck!!!

    Honestly my opinion I would let him go... You just never know.. He probably would be approve, you never know with these CO... Worst case scenerio they probably ask to speak to you and set up another interview... and best case scenerio they approve him... Just tell him to stay calm answer all the questions just as you guys practice it... Please eye to eye contact, and he will be find

    I was asked to post this on VJ by my friend in hopes of getting a response:

    "I have been married to my husband for 6 years 2 months today (January 15, 2007). We have known each other for 15 years (12 of which we were in a relationship with each other.) In April 2008, he filed for me to join him in the US. After many years, things were still at the NVC level. We waited and waited, and prayed until this January 2013, we received the NVC letter with an interview date for March 15,2013 at the Embassy in Haiti. The Embassy received every proof from the NVC and we brought more pictures and Western Union transfer transcripts, etc. We had a separate interview and the CO asked us many questions, but focused more on why we had a small wedding. We both answered that it was because we didn't have the means and while my husband, then my fiancé, came to Haiti for his mother's re-marriage we decided to do something small the following day (since he was leaving on the 16th of January.) The CO also asked us why we didn't have any kids. We explained that we tried but wasn't blessed with one. She didn't seem impressed. I know there are some red flags to our story... Like I am 6 years older than him; we haven't seen each other since 2010... In 2009, during his last visit, he was kidnapped and threatened to be killed (for no apparent reason, other than a cousin we believe is behind everything.) So, because he was kidnapped for 2 weeks and almost died, we got scared and we decided that it would be best for him not to travel outside of the US for a while. But in 2010, we wanted to see each other and we met in the Dominican Republic for a week (due to our jobs we could not take a longer vacation.) He became gravely ill after he got into the US and had to quit his job for a year. Then, he got another job and was not yet able to get vacation's time or the means to travel. But last week, he braced his fears and came to support me at the interview; only for us to get a refusal. We are both greatly saddened about this. We are ready to be together and it's realy hard that our life is still on hold because the CO doesn't believe we have a bona-fide marriage. They gave us a WHITE paper with Article 221 (g) checked. Every marriage is different. Ours may be long distance most of the time, but we did find ways to make it work. I am not very computer savvy, so I didn't even have an email address until last year. We talked via phone only. I am not sure what to do now. My husband wants to hire a lawyer but I don't know what they'll do differently than what we've tried to do... Please, any help and advice would be appreciated. Thank you"

    From my research, they are supposed to be able to appeal this or should have been on AP in order to bring more evidence; however, the CO told them that their case would be returned to NVC/USCIS and they should contact them once they receive the letter from them. I am clueless at what to do. So, Thanks for all your responses.:)

    I've read this twice, am sorry you got denied, but the doubts are there.... because of the circumstances him being kidnapped in 2009 he was afraid to come see you in Haiti right!; but in 2010 you guys found your way to see each other in the Dominican Republic. Honestly if I was the CO I would be thinking ok if you found your way in 2010 to see each other in the DR, what was stopping you from seeing each other again from 2010 to present even if it meant going back to the Dominican Republic to do so. Another thing they might be thinking is that he was so afraid to come to Haiti to see you all this time, but wasn't afraid to come just for the interview, Which was probably the biggest red flag I think. In the CO's mind they might think "ok he made no means to see his wife since 2010, but he made an attempt to come just for the interview Hmmmmmm"! He wasn't too afraid...Can you see my point? Another red flag is that the lack of communication. You may say oh we communicated by phone etc. but where is that proof? The CO doesn't see this. Put yourself in the mentality of the CO, if there are no proof (chat messages, emails, etc.)that there was some kind of communication going on especially with the big gaps of not seeing each other believe me the CO will not believe that this marriage is bonifide. Am so sorry to say that,and I don't want to be negative, but there is cause for doubts.

  12. My fiance received 221g. I email them and this is what they told me.

    Our records indicate the consular officer was unable to confirm the beneficiary’s relationship with you. Therefore, he was refused the fiancé visa and his application will be soon returned to the USCIS district office for further consideration. If you wish to provide additional proof of the relationship, you are welcome to do so with the USCIS office as soon as the case is returned. This case is considered closed in our office.

    So now what should I do wait until the paper work go back USCIS to send in more prove...

    OR should I just marry him....

    Please give me ideas....

    Hope all is well with everyones journey... I do have a question... my fiance received packet 3.5 from Haiti messenger back in December as we are gathering all documents I want to make sure I DO NOT have to register online for an interview appointment with the US Embassy in Haiti?? I have seen that in a few places on VJ and the USCIS website. If I need to register for an interview date how do I do that? please help!!!

    No you do not have to register online. When you are ready to submit all of your paperwork to Haiti Messenger they will tell you when to come back and pickup your interview date.

  14. How bout the ds 156 form i typed it but after i print it its like 3 pages and it dont look like pdf file.

    My fiance filled out all his forms from travelstate.gov because his package3 with all the forms was never received. I personally never looked at the form to see how it printed, When we called the embassy in Haiti about not receiving the forms from package 3 this was the website they advise us to go on to fill out all the forms and print. So all the forms for package 3 he filled out and printed and submitted it with the K1 package I sent him. mtcmk1 would you be able to assist mrs prince with this?

  15. Suggestion for future filings and followup, both of you read what is required and Double/Triple check each other, good luck with your RFE.

    Well am happy to inform you that both of us also went thru Haiti embassy and both of us has been approved our k1 visa, so we are talking from experience and would not like anyone to get a RFE.

  16. Yes if you go to travelstate.gov and in search just type form you will find all of those form. Remember when he receive instructions on package#3 it will ask for form DS-156 to be printed in Duplicate. That simply just mean they want you to print this form twice

    Great!!! now you can start preparing for your K1 package so that when they send you the NOA2 you will be prepared for when your paperwork is sent to the Embassy in Port-au-Prince.
