You should ask at your interview, because I know in my country, which is Mexico, you have 6 months to leave after your interview! Good Luck!

I have a case number from NVC, does anyone know what's next? I'm I suppose to get a Package(mail) cause I I've read that we normally don't get it. ( I'm from Mexico).

Cheer up, I'm also a January filer and got transfered to Texas on May and we just got our NOA2 July 2nd....Good luck to all of us!

We filed our petition January 9th and were transfered to Texas May 21. Today (July 2)we finally got our NOA2.....Woohoo!! GOD is so Awesome, WIsh you all the best luck also!! Blessings and Prayers to all of us!

I have been reading about this and I also spoke to our lawyer about it ( my case is a little different) anyway she said that they will let us know in the K1 interview but I also read that you can apply for the waiver before the interview, so I guess and I hope she can be in the USA before 2014 ( prayers and blessings to both of you).
This is my case:
I overstayed in 2008, (for a month) I don't know if this is different but they gave me a "punishment" or banner , not sure how you say that, anyway my "punishment" was over this past March, I asked our lawyer and she said it's not a problem and that I didn't need a waiver cause the 5 yrs had already passed, she said that if my I had my interview before March ( which it didn't happen, since we applied in January) that then I did had to apply for a waiver, so I guess a waiver will do for your fiancee, GOOD LUCK!!! We're waiting for our NOA2, I hope everything goes well good luck to all of us!

I'm also a January filer...We got our NOA1 on January 16, we were in Vermont and got transfered to Texas Center I hope this changes don't take longer!

You can get a waiver, but right after your interview. If you over stayed 10 years ago that shouldn't be a problem. They will let you know at the K1 interview if you need a waiver. I over stayed, like around a month and they took my visa and gave me a 5 yr ban but they also told me that I could apply for a waiver in order to re apply for my turist visa if I wanted it right away or wait for the 5 yr ban and get a visa without the waiver. Did they give you any document at that time?? They should of, anyway, I will have my interview pretty soon, our lawyer said I didn't need a waiver since I already completed the 5 years. PS. by the way I'm in Mexico, my ban was over around 5 months ago. Good Luck!!
