Thanks Gummibear. I was not expecting anything as i have heard waivers due to divorce take a longer time so i was pleasantly surprised! I have also been following a thread on this forum (January filers) and realized i got approved the same time as them. It goes to show it depends on the amount of evidence you have and the situation that lead to the divorce for waivers (i wrote a long letter to USCIS explaining the reasons for my divorce as they were beyond my control).
congratulation and I hope all the people are waiting for approval to be approved.

No it's not about I-751. The reform will facilitate the process for undocumented immigrants to become legalized citizens. Also, companies need to make sure that they verify their employee's legal status. Another point is that there will be more visas for immigrants who are highly skilled. I don't see any specific point about I-751 but I think that the process is getting easier now.
BTW, just received my NOA today so I'm gonna update this! YAYYYY

today the immigration reform bill is passed in the senate by 68-32 vote if the bill is passed by the house is going to help people who are waiting in the line and have I -751 waiver pending ?

Hi all,
I called the USCIS and asked the customer representative to forward the call to the Immigration Officer, She first insisted asking me the question so that she can only be able to reply it and avoid transferring the call to the next level i.e., IO. I insisted and told her that I wanted to know the status of my application which is still pending since almost a year, by the way, I replied to the RFE on April 25th which was sent on 13th of Feb, 2013. It was a 120 minutes wait time on the phone, but at last the IO looked at my status and told me that it's scheduled for the Interview and waiting for the local center to give the dates. You may hear soon from the VSC about the date of interview within 30 days.
1) If anyone have come across the i751 waiver interview @ Newark NJ field office then please share your experiences
2) Also any advices and suggestions will be highly appreciated.

I had a lot of evidence
-tax returns for 2009,2010 and 2011 both filled married but separate.
-4 credit cards ex wife as an authorized user and we were using them.
-joint lease for 2009 and 2010
-2 joint checking accounts used to deposit money in them to pay the credit cards n other bills.
-life insurance ex wife has beneficiary
-joint electric and cable bills
-joint health insurance
-joint renters insurance
-affidavit from ex wife, n her mom
-affidavit from my parents
--joint car insurance and joint car registration
-driver licence showing same address
-sent like 10 pix of us together with friends,her family and my family and on the back of the pix i named everyone eg my ex wifes dad and his name *** etc
I used a lawyer but i could have done it by myself but i didnt wana take a chance.
I got my 2 yr green card in June 2010.Divorce was granted in May 2012. Sent roc divorce waiver on June 15 2012, a few days b4 the expiration of ma 2 year green card.First NOA on June 16. Biometrics July 23 2012. Approval letter for 10 year greencard on May 11 2013.

Filed in July 2012... still nothing... My online status still says "initial review"... I am leaving the country for 3 days tomorrow, which documents should I carry with me? I should have no problems right?
you should take with you the extension letter<the original not a copy> and your expired green card you should not have a problem.

hi, I am hoping someone with experience can give me some advice.
We jointly filed I751 in early Dec 2012,and my case is pending. However, my husband and I are going thru difficult time and I have decided to get a divorce. What should I do now ? We filed jointly last year, but the case is still pending.

if you already filed and you filed jointly I think there is no problem to get divorced. just have to wait for your approval.

I believe you have to file right away after the divorce...so you can have extension letter for you GC...

my marriage is ended too sooner after i get my 2 years green card . i filled to remove the condition of green card i751 i have recieded the extention letter fot one year and i recieded a notice to do the biomertic in 13-20-2013 please let me know what happened to your case . zjakallah kher and may allah hepl you inshallah through this .
I received an rfe for more evidences, didn't replied to it yet as I don't have that many evidences due to the very short marriage. Whatever I had it, I sent them with i751 package. Just got few more documents with me, so planning to send them. I spoke to my attorney yesterday regarding this and he said the same to me that send them whatever I have it and also that we will draft a statement to the USCIS challenging that we have send all the documents and as the marriage was short but entered in a good faith and the documents which we sent clearly indicates that the marriage was entered in a good faith.. but due to the short marriage I could not have enough evidences. Need the advice from the experts over here, Please help me out:
Received an RFE for my I751 divorce waiver case last week and the USCIS is asking for more evidences to prove the marriage is a bonafide. As my marriage was very short due to which I don't have as many evidences and have submitted my I751 application with very few documents.
Here is the list:
1) Affidavit from me (Personal statement)
2) My wedding invitation
3) Bank statement with both of our names and the same address
4) Divorce decree
5) Mobile phone bill statement with both of our names and the address, as I have added her on my account
6) Wedding pics n video dvd
7) Marriage license n certificate
8) affidavit given by my wife about our bona fide marriage
9) motor vehicle insurance documents
10) Both of our driving licenses with the same address.
Now the USCIS is asking for more documents by sending the RFE and this is what they have mentioned in the RFE: (I'm just including the main points)
Please submit evidence to show that you and your former spouse entered the marriage in good faith and continued to share a life together until your legal separation. The evidence should cover the entire period of your marriage and may include, but is not limited to, one or more of the following:
1) Children as a result of your marriage
- ( We didn't had any children)
2) Evidence that you and your former spouse resided together and shared responsibility for a common residence.
- (I have submitted the copies of our driver's licenses, insurances, bank statements as we lived in my wife's parents house during that period)
3) Evidence that you and your former spouse had combined financial resources may include financial records showing joint ownership of assets and joint responsibility for liabilities.
- (I have submitted our joint checking bank account statements)
4) Evidence that you and your former spouse had made estate, health and financial planning arrangements with each other.
- (I have don't have any)
5) Affidavits from third parties who have knowledge of the bonafides of your marital relationship. An affidavit should be supported by documentary evidence and must be sworn to or affirmed by at least two people
- have known you and your former spouse since your conditional residence was granted and have provided information about their relationship to you or your spouse
- have personal knowledge of your marital relationship and have provided a detailed explanation about how this knowledge was acquired:
- may be required to testify before an immigration officer regarding the affidavit's content:
- and have provided their full name, address, date and place of birth.

6) Any other relavant documents not already mentioned. Please do not send copies of documents previously submitted.

Documentary Evidence
If sufficient documentary evidence is submitted to establish your "good faith" marriage, the Service Center Director may waive the interview requirement.
Response required
If you do not respond within the allowable time period, USCIS will deny your petition. A denial of your petition may result in the termination of your conditional resident status and your possible removal from the United States...
Also they have mentioned twice in the document not to send the repeated documents again.
Please give me your input and advices... Really stressed out as I don't have further supporting documents since submitted whatever I have it at first.

Hello everyone!
I came to the US on K-1 at the end of 2010, got married in Feb 2011 and my AOS was approved (without and interview) in June 2011.
I will be filling for ROC later this month and am currently gathering evidence.
My husband and I have a bona fide marriage, however, I am worried that we don't have enough evidence to prove it.
What we have:
- Apartment leases 2011-2013
- Joint tax returns for 2011 and 2012
- Car insurance with both our names on it
- Health insurance (he is the policy holder and I am a beneficiary on it)
Let me explain our financial/bank accounts situation:
He makes three times as much as I do.
He owns a checking and a savings account. We own a joint checking and savings account but I use it as my own bank account (he doesn't use it, even though his name is on it).
His paychecks get deposited into his bank account and my paychecks get deposited into our joint account.
He pays rent and all our bills directly from his bank account and I pay for groceries directly from my (our joint) bank account.
We each own credit cards but no joint credit cards.
I know this might look "suspicious" to USCIS (and maybe to those of you who have all your bank accounts and your money joint with your spouses), but it works PERFECTLY for us and we didn't see the need to join our money and accounts and make it less convenient for us, just to generate proof for USCIS. I can send USCIS statements of our joint account but it only has my transactions on them.
We haven't been able to go on many vacations, only weekend trips here and there so we don't have any flight itineraries to show. When we check into hotels, they only require the name of the person who's paying for the room (that would be him) so we don't have any hotel bills with both our names on it). We do have pictures of us from our trips.
We don't have any children.
We don't own any property.
As previously explained, he pays all the bills so all utility bills are in his name.
He owns both of our cars.
We don't have life insurance, 401k or any other retirement plans.
We are an average happy married couple, with not much proof of our marriage on paper, but it is a true marriage. I am worried that USCIS will not be satisfied with our evidence, though, especially since we don't handle our finances jointly like most couples who file for AOS and ROC.
What are your opinions of our situation? Any input will be much appreciated.
you don t have to worry about anything the most important is to have a joint tax return for 2011 and 2012 and your evidences are good to go . good luck to you.

Yes, you'll definitely have an interview. And like I said, they might ask if you happen to have any records of your joint bank account, such as bank statement (even if you guys cancelled it already), and maybe if you guys had at least the bill on your names on that couple months of AOSing, and photos, or even as I mentioned, email exchanges of how you guys have been dating for a while before you guys got married, or post-cards, or phone call records. Those are all valuable to show that it was originally a true love there, and you did not get married just to get a green card. So, I hope you did not throw all those away! And really, a fresh current affidavit would definitely help you a lot. If you had two from common friends who have known both of you and have seen how your relationship was real, and was true and could write the affidavits accordingly that would be very strong evidence. Anything you guys basically had together, movie tickets, airplane tickets in case you guys flew to see your parents/relatives to show he went along at the time, or airplane tickets that showed you came here to visit him before you guys got married. Any pictures you guys have of when you guys were dating, your wedding pictures, preferentially with people in it as relatives, friends of his, or yours, or both of yours. Did any of you have a car? Did you guys happen to change the car insurance to have it both of your names? Do you have at least one copy of that? That would also help! If you payed for rent for an apartment, copy of the checks showing both of your names to show both of you paid for it as a married couple, not him, or not "just you". How about health insurance? I know you guys divorced really early, but maybe have one copy of a joint health insurance? But definitely for you tons of photos, affidavits made CURRENTLY would make it the strongest. All the others are smaller in your case, since you had those for AOS, but then after the green card you divorced really fast. Photos definitely show the proof of it in your case, and current affidavits would back you up that everybody saw it was a good marriage, and that everybody is just as you were all surprised, shocked and disappointed that you guys' relationship went South so fast. Well, I am saying what I am saying as USCIS will view it. I believe you that it was a bona fide marriage, but USCIS is waaay more judgmental. I really feel that you will not have much luck, since it is so soon after you got your green card. You just don't have much evidences. No joint bank account, no lease agreements on both of your names, or PG&E bills. It is not my business, but how long you have known him prior to your marriage to him? (maybe you wrote this, but I forgot to flip back to your original post) If it was quiet a while, maybe if you still have phone records/email exchanges that shows the date could make it a bit stronger. Also, if you happen to have any common friends who knew both of you, and see the point clearly that you guys started good, then maybe you could ask them to provide a certified affidavit. But I really do feel that even the lawyer won't help you, just takes away more money that you could be saving to go home and start a new life. I really wish you the best, but you'll have some hard times...But I'll cross my fingers for you and if anything else pops into my mind that might help you, I'll definitely let you know. Also, maybe some others will come up and give you even better advices than I am...who knows? It's a large board after all, you might find someone who was in a similar situation and got approved. All the best!

I think (like I say, I THINK) you have very slim chances for getting approved for your 10 year green card, so plan ahead that you have a year left...the reason I think that is because divorcing a month after you got your conditional green card is just way too odd in USCIS eye...you'll have a very hard time, if not impossible, to prove your marriage was bona fide. my marriage was in good faith is not to get immigration benefit .I sent them all the evidences I get my hand on it to prove that my marriage was exactly in good faith. I know that my chances are very slim because of the short time after getting my gc even my lawyer told me that but now I only have to pray and wait .what do you think may happen to me after all please I need a good advice from you maybe could help.

i dont really have too much .my ex left after 2 month when i recieved my status we conceled all bank account we dont do taxes jointly for 2011 and 2012 so i dont have enought paper work to back up my case.and i dont know exactly what uscis are looking for what kind of thing to prove that i married in good faith

Assalam Alykum,
You will need to file the I751 by yourself. Because you divorced your husband he can not help you on this. On that form there should be a waiver box to check because of divorce. ROC which means removal of conditions. The conditions you are removing is your conditional status and you will get a 10 year greencard if you meet the requirements inshallah.
