  2. Wow this is a lot to digest. I can say the marriage was indeed valid from the get-go. We haven't signed any separation agreement or anything, at this point just living apart... So is this truly a separation in the eyes of the law?

    I really appreciate everyone's reply this is all very enlightening.

    Don't you still have to file the forms stating where you both live and if you move or have you not been doing that? If she's not living with you, they should know.

  3. My wife just got her SSN. She came over on a K1 visa but the card is noted as "Valid for work only with DHS authorization" which I believe to be a mistake.

    She was issued the correct card. She can apply for an unrestricted card once she has an I-551 stamp or card.

    How does she obtain that? I've never heard of a I-551.

Been hanging out at the K1 forums until now. ;) Luckily for me I now have the woman formerly known as my fiance (read: now wife) with me and we are now starting our journey through keep her here in the states. Anyways, whats the next step? We filed all the legal paperwork for the marriage and were legally married before a judge on Tuesday.

    Anyways, I believe I need to file an I-485 for adjustment of status as well as an I-765 so she can work. Is this correct or am I missing something? Is there anything else that will need to be sent? I have certified copies of our marriage license.

  6. So the fact that she's no longer my fiance but my wife isn't a problem but she won't be able to work?

    Any suggestions to help her pass the time? lol Guess I better hurry up and get cable!

  7. My fiance entered the United States in April under a K1 Visa. We were legally married today (well today is when all the paperwork was turned in). We were planning on applying for her SSN today to get her married name on it... and so she could work but apparently because we're now married her K1 status is gone and now we have to apply and wait for her EAD which could take 4-6 months? I guess I misunderstood all of this when I was reading about it.

    Please tell me I'm wrong and she'll be able to work and get a SSN prior to the EAD. She's dying of boredom sitting at home all day now while I'm at work.

  8. My fiance got here Wednesday. We were hoping to get married next week or so in the courthouse. Are you saying that in order to avoid the delay in getting the SSN we will have to wait 3 weeks to get married or could we just get married then apply for her SSN using her maiden name, then later apply for an updated card? We want to get married as soon as possible and we want to get her SSN as soon as possible.

    I thought the process of changing your name occured when you made the change on your SSN not simply because you were married.

  9. Well she's here and she's adjusting slowly. Her sister honestly isn't helping tho...

    We plan to go get married next week, then file for the SSN under her new name. I've been warned about doing this as opposed to filing with her maiden name then requesting a changed SSN card after the marriage license is filed but I can't understand why. Anyone know?

    The envelope I was talking about before was taken at the POE (Detroit) and there was some confusion because her i-129 had expired and we were sent to a different room. A few minutes later a really nice officer informed us there were no problems and sent us on our way! Unfortunately I've had to go to work every day since getting back so I haven't had a lot of time with her other than after work and bed time. 30 minutes left in the week and I can't wait tho!!! Woohoo!! It's so different having her there and not waiting for her on msn to chat.

    One quick question... At what point will her entry to and from the states not require an advanced parole application?

  10. Well I called and in my state they have the parent's names, maiden name, and the date of birth on the marriage license.

    I was planning on going to go get the marriage license next week, then becoming legally married in front of a judge, then if it has the info required I'll just have her apply for her SSN with her married name using the marriage license as ID.

    I also read that it's a bad idea to apply for an SSN number until a few weeks after arrival in the states.

    The post you gave mdyoung looks very imformative but I'm having a difficult time understanding why it would be a bad idea to just apply with the marriage license name for the first card. I blame this on the fact that it's Friday afternoon and I'm at work!

    Sounds just fine. There is nothing that has to be done legally other than getting married for her to use your name,then she can get her ssn in her married name and file for AOS.

    So once we're married she can take my last name and use her last name as her middle name since Turkish people don't have middle names?

  12. At which point in the process is the change of name easiest? My fiance arrived here on Wednesday under a K1 and we're going to the courthouse next week to get officially married. How exactly does one change their name and does it create problems with the immigration process?

    Right now I'm just trying to avoid using my lawyer since he likes to charge for everything... I plan to let him go next week. Last month he called me to ask me about how things are going... The conversation lasted about 2 minutes. Then I received a bill for $25 which ticked me off.

  13. Well the visa just arrived via UPS and just in time! We leave her parent's place tomorrow evening and head to Istanbul then we head back to the states the following morning.

    Just a quick question but what is this packet that came with her visa? It says we can't open it and so I'm curious. :)

    Also, whats the next step once we get back into the states? Get married, then what? :D

  14. We went to the interview on Monday and the Visa was "approved" but my fiance was missing a her birth certificate. I thought she had everything but the paper she had was not her birth certificate and since I didn't know the Turkish format I couldn't check to see if it was correct. The woman who interviewed her was very nice and told her if she mailed her the correct document the visa would be mailed to her within 5 days so we went to the records office in Ankara and had the appropriate papers printed, took them to a translator, and then UPSed them to the Embassy. This was all done on Tuesday so they probably got the proper paperwork Wednesday and now hopefully we'll have the Visa in hand by Tuesday when our flights are scheduled to leave. I really hope she's able to get on the plane with me. If not I'll just end up paying extra money to change her ticket and have her come over later alone which I'd like to avoid.
