    When you put in an answer for 61a and 61b, you were saying the beneficiary was in the U.S. and will adjust status in the U.S. 

     

    For your mother, the ISO reading the petition saw that you meant to answer:

     

     

    The beneficiary will not apply for adjustment of status in the United States, but he or she will apply for an immigrant visa abroad at the U.S. Embassy or U.S. Consulate in:
    62.a. City or Town 

    62.b. Province
    62.c. Country

     

    For your father, the ISO did not give you that concession. That ISO held you to your error.

     

    Hire an immigration attorney to handle these cases moving forward.

     

     

     

    After looking at my mother-in-law's application, we filled out section 62 for her; not section 61; as both her and my father-in-law are abroad and will be applying for the immigrant visas abroad at a U.S. Embassy. So I think what this is saying we didn't fill out either section 61 or 62 for my father-in-law. I wonder if there's a way to download the application that we filled out since we didn't save my father-in-law's application

    Unfortunately, we didn't save my father-in-law's application. Only saved my mother-in-law's and for 61a and b it says Dhaka, Bangladesh. We essentially replicated the same application for my father-in-law by changing his personal information, but didn't save the file

  3. My wife filled out I-130 applications for my mother-in-law and father-in-law back in March and June of 2022. Both of their cases got approved yesterday. For my mother-in-law's case, USCIS is forwarding the petition to NVC in NH, but for my father-in-law's case they've asked him to fill out Form I-824 (please see attached image). Both of them are overseas and both applications were filled out the same exact way. So we're trying to figure out why my mother-in-law's case was sent to NVC, but for father-in-law's case USCIS asking to fill out Form I-824 for which we would have to pay another filing fee. Anyone had any similar experience?

  4. My wife, who is a USC, has recently filed form I-130 to immigrate her mother to the US and USCIS has confirmed that they received the petition. We've also found out that my wife is pregnant and having her mother as a caregiver would be very helpful for us. I know USCIS has a process to expedite petitions based on humanitarian reasons. Would like to know if anyone has gone through this type of process and what kind of evidence needs to be provided. Will doctor's notes and ultrasound images be sufficient? What would be the process to file this type of request? 

  5. So my wife applied for her i-751 in Oct'18 and her N400 interview was scheduled for Mar'20, at which point her i-751 still showed fingerprint was taken. She was only requested to show up for her N400 which was cancelled due to the lock down. However, few months later her i-751 was approved along with N400 (without an interview). Similar thing happened with one of my friends.

    My wife has her biometrics appointment tomorrow and her letter was sent out on the 2nd of November. If your biometrics appointment letter was really sent out on October 25th, you maybe past your biometrics appointment. Let's hope that's not the case as USCIS considers failure to appear for biometrics appointment as an abandonment to your petition. I strongly suggest you call USCIS as early as you can tomorrow and try to talk to a higher tier (Tier 2 or 3) officer to hammer out the details.

    Yeah. I was surprised to see that show up this early. Since I got my NOA on the 22nd (dated 19th), I was expecting the biometrics show up about a month later. Hopefully they keep up the pace. Looking around on various forums so far VSC seems to be pretty fast.

    You need all 3. 

    I think you're confusing the N400 part with ROC. All of what you said is valid for Naturalization for Spouses of U.S. Citizens. However, to get to that the spouse of U.S. citizen has to go through the i-751. There is no way around it or no shortcut to it. It's applying for I-751 and then Naturalization. A lot of folks just apply for ROC and then before 10yrs G.C is issued apply for N400 and become citizen before ROC. Maybe that's what you're referring to.

  10. Doesn't matter how long a person is in the US. Per USCIS law, for naturalization, the spouse becomes eligible to become a citizen once he/she has been a permanent resident (green card holder) for at least 3 years. Since, his green card is only for 2yrs, the law requires he files for ROC for a green card extension and then citizenship. There's no shortcut to it. A law is a law.

    If you have beneficiary forms from your or your spouse's 401K or IRA accounts you can add those as well as part of financial comingling. 

  12. Just call USCIS and get the receipt number. Then create a DHS account (https://myaccount.uscis.dhs.gov/) You should be able to track your application that way and if you have biometric you should be able to see that on the account. My check was cashed around 10/12 and I didn't receive any text or email even though I submitted an e-notification form. So i decided to call. The agent gave me the receipt number and told me that my letter was mailed out yesterday; about 7 business days after the cash was checked and application was received.

So we filled out the current version of i-751 and sent it back to the Dallas office. It was received on Oct 3rd, but check wasn't cashed til Oct 15th. I attached a copy of Form G-1145 and even though checks were cashed I didn't received any text or email notification. After waiting for a while I decided to log into the USCIS account and saw the following message with October 4, 2018 date.

    Mine was rejected too for using outdated i-751 form. Dallas sent it back with on the 21st and I got it back around Sep 28/29. I'm surprised that yours took this long to come back. I guess it depends on when in September you filed.  I filed around 1st week of September and was received on the 12th.

  17. Just got my I-797 rejection notice due to a stupid mistake I made and I think this can be a very good lesson for other VJ members as well. Somehow I filled out an outdated I-751 form. The form that I filled out expired on December 2017. I had an old copy, but I didn't realize I inadvertently submitted that one instead of the new copy that I downloaded from USCIS website and filled out. Just FYI for all -  I-751 has an expiration date on top right corner, it says EXPIRES MM/DD/YY. Painful lesson, but the good thing is it doesn't seem like it's a complete rejection. There's a green letter with I-797 Reject Notice that invited me to resubmit my application. There are receipt number (EACXXXXXXXXXX) and original application acceptance date and time on all of the evidences that I originally sent out. Just finished up the correct I-751 and will be sending that out first thing tomorrow morning.
