  1. I have reached the kitchen sink now... I have about 180 pages printed on both sides with everything and anything I could think of.

I mean we literally have everything in both names neither of us owns anything that doesn't have the others name on it.

Love the picture! It's so true! In my mind that folder they have on us should take up a full drawer in a filing cabinet by itself.

But at the end of the day you do what you have to do....and I know there have been plenty others that have received an RFE similar or the same as ours. It still makes your heart skips beat when you receive a RFE.

  2. I believe you go the RFE because of no proof of financial co-mingling. Bank statements, utility bills since you were married. Send copies of all of these, don't worry about amount or poundage, just send it.

It's true I didn't sent bank statements but I sent credit card statements of our joint cards and mortgage statements of the mortgage we have on our house. How is that not commingling?

The utility companies don't care that I need the bill to be addressed to both of us and simply won't do it, therefore I will now send in the water bill with my husbands name and the electric in my name with the same address.

  3. Wow - I'm rather surprised you got an RFE with your list!

We sent our package in today - 3 pounds 12.7 ounces worth. We did send joint ownership documents for our cat, which we imported from Australia.

Bona fide is Latin for "good faith" - Bona = good, and "fide" (fee-day) is faith or steadfastness. It's the same root used in the English word "fidelity".

We sent in bank statements from the month we married (with my spouse's old surname), and the quarterly statements after that (after my spouse changed her surname to mine). I have read that it is important to send EVERY page of the statement (even though I know I killed several trees in the process).

    We did not send affidavits.

Good luck. Your letter actually made my heart skip a beat or two....

    Sukie in NY

Everybody seems to have a different opinion on either all pages or every three month or so. As I apparently didn't send enough I am going to send every page of everything now. My first package was already super heavy and it'll be even more now...

  4. That is what I will do is just print all the joint statements. He closed all of his accounts and we opened all new checking and savings accounts together.

I just can't believe they really want all that.

And that is what I thought about bona fide and good faith!

The way it reads is that it says I have not established that the marriage was entered in good faith but I have provided evidence for a bona fide marriage...

  5. i got the same request, i thought i had sent sufficient data as well, so i sent on

Bank statements - Several statements over the past 2 years, 1 statement every 3-4months showing activity

Leases signed for the last 3 years

car insurance policy for last 4 years

health insurance and benefits for past 3 years

    mortgage approval letters

bills in my name in some cases and spouse in other cases with same address

    joint phone bills

i honestly have no more info i can send on so if i can another request for evidence i am requesting an interview.

    so, you are not alone!!

That is good to hear! I just feel like there is not much new info I can sent, I can sent more of what I already have but not much different.

Did yours say anything about you showed a bona fide marriage but you now need to show the good faith marriage?

    I do not understand that...

  6. Hey everyone,

I have been anxiously waiting to hear something on my I-751 petition as I am sure many of you. Well today we received an RFE which is my first as we have had a pretty smooth sailing process so far. Anyway I would love some input on what to send and what I should leave out and just some general questions.

    With out petition we sent:

    -Drivers License with same address

-Deed to our house in both names

-Mortgage on our house in both names

    -2014 joint tax returns

    -Joint Credit Card Statements

    -Joint Health Insurance

    -Costco Joint Membership

-2014 Christmas Card of us and our dog

-Pictures over the last two years prior

    -Joint title to our cars

    -Joint Car insurance

    -Joint Homeowners Insurance

Now my first question is that I did sent partials of some of those documents as our homeowner insurance and health insurance policies are like 30 pages each. I included all the pages having both names on it and did write 'partial' on the coversheet. Would it make a difference if I send the whole thing?

This is what we don't have:

-children, therefore no birth certifiactes etc (we adopted a dog who is like our furbaby does that count? ;-) jk )

-life insurance, we simply don't have any and are really not in a position to sign up for one or want one

What I can think of to send:

-I only send 2014 taxes, I can add 2013 and 2015, 2015 was obviously done after we filed does that matter?

-Add W2's and 1099 as I was simply not aware I should send them

-Bank Statements from savings account and checking account ( As I send the credit card and statements before)

-pre-approval letter for a joint loan as we are planning on putting out house on the market next week and buying a new and bigger one that will fit a family

    -affidavits from family members

What throws me off the most is that the RFE says we have sent documents to show a bona fide marriage but need to send more of a good faith marriage? I am just a little confused of what the difference is.

And does it make sense to open/start anything in both names now or do only things count that were already in place when we filed in Sept 2015?

What else can I send? I really thought with mortgage, deed, cars, insurance etc we had a strong case but obviously not. I tried to get the utility bills put in both of our names but they simply won't do it. The eletric is in my name and the water in my husbands, should I send both showing its the same address? We don't have any individual accounts we really do have everything in both names and reading that a lot of couples on here are not quite as intermingled with finances I thought we'd be fine.

Another random question, that tiny envelope they included is a joke right? I mean I can glue it on a big enevlope but there is no way it will hold all the evidence I will send.

I truly appreciate any and all input!

  7. Usually on national flights they will ask for your state ID and not the GC. you could have travelled on national flights prior to receiving the GC as you wouldn't be leaving the country. If it was me I would probably book everything in my maiden name, but that said I don't think you'll have an issue if the GC and local ID are in the married name to book with the married name.

  8. Just take your marriage certificate with you. I still have my maiden name in my German passport and GC is in my married name. ive travelled like this multiple times and never had an issue. Most of the time they never even look at the marriage certificate but you should definitely have it.

Since y'all are traveling together that's even easier just go to the counter together.

I've always been told to book in the name that's in my passport which I've done and never had an issue. That was mainly airline requirement to have it in the passport name.

  9. I was fortunate that I worked for an airline so I moved a lot of stuff on visits before moving (I know you shouldn't do that in case it doesn't go through but I took the risk knowing I'd be able to fly it back again if worse came to worst).

As others have said I also would look into possibly crossing into Germany as shipping is nowhere near as expensive as what you've states in Denmark. Maybe check into containers in Hamburg as well?

And as a former airliner just a heads up: I don't know how SAS handles it but on a lot of airlines it's cheaper to check an extra bag than to pay one bag being overweight. I know it's crazy but they're trying to eliminate the crazy backbreaking bags.

  10. Where in NC are you thinking of moving? We live on the coast of SC and just a heads up the rental situation here is a little rough as there is not much out there. It really depends on the region but educate yourself before so you know about how long it will take to find something.

My two scents on your situation is that it really comes down to you handling the stress of moving, finding a job, making friends and build a home by yourself or with him.

If you live with your parents it may be nice to have your own space when he gets here. I am the foreign spouse so I am the one that moved here and from my perspective it was nice knowing where exactly I would be moving. It was such a journey to sell all my stuff, move out of my apartment etc that I was happy to know I wouldn't have to house hunt when I get here. But I also was fortunate to be here a lot before I moved so we created this home together beforehand.

Best of luck and the most exciting times are ahead so enjoy every minute!

  11. Wow what a long thread when the questions really have been answered already.

File for AOS, wait until it is through if you want to avoid the ban and dealing with waivers.

The comment by jabl2rom about "the racism is coming out, but not wonder considering where you're from"?!

Really?! That is so inappropriate I can't even.... Is wish someone from admin would delete that. If you need to go down to that level you should not be on here.

To the OP, I admire your persistence in answering everyone attacking you, I surely would have ignored a lot. I do think some are going overboard but you do have to understand that a lot of us can use ESTA but we did not misuse ESTA like you did. I know my spouse for a decade as well, have friends in many states, a college degree, job and apartment..... But I came to visit on ESTA like I am suppose to. Then I went back home and filed the right paperwork to come over and got married.

The reason a lot of people are attacking you is because we did use ESTA to come and visit or come and get married but go back home and file for K1 or CR1.

I'm not sure why you keep thinking people are saying your "illegal" action is to file months later, they are talking about misusing ESTA to get married and stay. Yes AOS is to adjust status, I did it that way too but I came into the US on a K1 like I'm suppose to.

I'm seriously not trying to attack. I'm sure you had your reasons for spontaneously getting married or not filing right away, all I am saying is that the fact is you misused ESTA. If this is the legal/right way or whatever you want to call it, everyone would do it and there would be no K1.

  12. I would also suggest the to try the info pass route. They can issue you an AP on the spot.

From my personal experience: I filed for the EAD/AP and GC at the same time. At my biometrics appointment I laid down my situation which is not life or death but very very important to me personally and my family. The gentleman said that I should come back a week before I need to travel in case I haven't received my AP by then and actually explain the situation to the officer (or what the decision makers are called).

I did not receive the AP, went back and received a number. They asked me to write down the reasons why and for how long I would be gone and then I waited. I got called and talked to someone for about 5 minutes and ended up walking out of there with my AP! (Of course while I'm in my home country the EAD/AP arrives)

It's dfinietly worth a shot before abondening AOS. It would safe you a lot of money and time.

  13. First of I wanna say that I do believe in love at first sight and therefore the fact that it's been less than a year that y'all have been together I don't think is an issue.

That said....I think it's great your friends we're open and honest with you. And even though they don't know him, they do know you and if that is the vibe they're getting, I'd be taking that very serious. The fact that you are contemplating about stopping the process and posted in this forum tells me you are having your doubts as well. There is nothing wrong with wanting to get to know each other better before moving forward. Spend some more time together and be confident in your relationship. He is not coming to the US for a trial run of a relationship, he will be coming to marry you. Maybe you could consider applying for a tourist visa first and he could actually come and meet your kids and friends first?

And lastly...I'm sorry but to me it's a major red flag that you have already send him money three times this year. I mean how was he getting by before? That to me is a big no no....

Did you also pay for all the processing fees of the K1?

  14. Being from Thailand, she needs a visa to be in Germany. The schengen visa will allow her to travel. Europe has open borders so you can literally just drive over the border once you've entered the European Union at some point, in this case Germany.

FYI if England is on your list of countries to visit, she needs a separate visa for that as they are not included in schengen.

The only exemption the green card would give her is flying on a military plane, onto a us base and never leaving it, since Germany has no jurisdiction there...

    Enjoy Germany!

  15. I received the same one.

It just tells you they're being super slow and that it will be appr another 6 months for your to receive a further notice from them. Which could either be an interview or just a notice of "you've been approved and the green card is in production".

Mine says the same thing about it being protentially an interview waiver case and I know there were quite a few who receive the same letter so I don't know if they really waive that many but I'm taking it as a positive that it says that. Plus I was just glad to hear something cause there's plenty of people waiting a long time without hearing anything.

  16. Wow...February?

I know patience is the key...but the EAD is only for a year and my drivers license as well as long as I don't have my green card. So I just hope I'll get if before they expire.

I do agree however its a good sign they touched my application. I just don't get why they review it, decide it might be good for a Interview Waiver, take the time to send the letter and then put it back in the pile....waste of time in my opinion.

  17. Hello everyone,

My husband and I filed my AOS in April and I had my biometrics app May 17th, I have already received my EAD/AP but we're waiting on an interview app or approval.

Well today there was a letter from USCIS and I was all excited it would finally move forward. But the letter just states "Notice of Potential Interview Waiver Case" and that we might qualify for that but that they still might determine later we need an interview. BUT now the bummer is, it states they're so busy that they anticipate a delay and that they estimate we will get a notice in 6 MONTHS! Not that I desparetly need the Green Card since I have my EAD however I was ready for a break from USCIS and I feel like if they have time to review my papers, send the EAD and then send this note...why not just work the case...

Has anyone else gotten this and did it really take 6 months?

    Thanks!

  18. That won't work. If she doesn't use the first/ outbound flight, the rest will be cancelled. You CAN buy a return flight starting in Equador, and not use the return portion.

Yes she's right. You have to fly your tickets in order, doesn't matter if you leave a last routing untouched but if you don't take the first one, for the airline you didn't attend and therefore your return will be canceled.
