  1. Hallo ihr alle! Ich war schon ewig nicht mehr hier im Forum aber bekomme immer noch Emails wenn hier jemand schreibt und lese so öfters was geposted wird. Ich bin mittlerweile seit gut 3.5 Jahren hier und wollte nur schnell die Frage wegen Krankenversicherung beantworten. Wenn du über 30 Stunden arbeitest pro Woche und dein Arbeitgeber dir deshalb benefits anbieten muss, dann musst du deine eigene krankversicherung benutzen und darfst nicht mehr auf der deines Ehepartners sein. 

    Ich wünsche euch allen dass ihr schnell eure Greencards bekommt und ihr durchstarten könnt :-)

    Edit: Du musst nicht deine eigene Krankenversicherung benutzen, aber soweit ich mich erinnere hätten wir eine Art Strafe bezahlen müssen, so dass es unattraktiv wird die Versicherung des Ehepartners weiter zu benutzen, das müsste dir aber im Einzelfall das HR Department des Arbeitgebers sagen und genauer erklären können!

Sorry,ich habe mich wohl etwas bloed ausgedrueckt ;) Ich bin schon in Texas und inzwischen verheiratet.Wir sind gerade dabei alles zusammenzustellen fuer AOS.Den weissen Umschlag habe ich hier und ich weiss auch das er fuer das AOS bestimmt ist und es sich um Unterlagen meiner medizinischen Untersuchung handelt.

    Die Frage ist ob wir diesen dann zusammen mit anderen Dokumenten zum USCIS schicken !? Ist vielleicht ne bloede Frage aber wir sind gerade etwas durcheinander... :unsure:

    Es gibt so einiges was wir nicht richtig beantwortet kriegen oder staendig andere Auskuenfte...

    Ja, den schickst du mit deinem AOS Zeug weg :)

    Mein I-129F/K1 ist grad beim NVC. Da ich nicht wirklich Lust habe ewig in der NVC Telefonschlange zu hängen, folgende Frage. Irgendwann in den nächsten Wochen werde ich ja post aus FRA bekommen (Paket 3 Brief) - da sollte doch dann die NVC Nummer auch drauf stehen, oder?

    Du hast es ja bald geschafft :) Alles was du brauchst steht auf dem Brief von Frankfurt. Kannst dem NVC aber auch ne E-mail schreiben, so hab ich damals meine Nummer bekommen fürs medical.

  4. Hey ihr's. Hab mal ne kurze Frage. Haben ende Februar einen Brief bekommen, dass wir als "potential interview waiver" fuer die Greencard gewaehlt wurden. Sie haben in dem Brief gesagt dass es noch ungefaehr 6 Monate dauern wuerde. Ich meine hier gibt es noch ein paar mehr die diesen Brief bekommen haben, irgend welche news bei euch? Liebe Gruesse :)

    Also wir haben ja das selbe NOA1 Datum und ich hab Mitte März den Brief bekommen und Ende Juni die Greencard. Ich hoff es dauert bei dir nicht mehr allzu lange, vll hat dein RFE es ein bisschen verzögert. Ich drück dir die Daumen, dass du bald was hörst :)

  5. Got a call from Memphis office yesterday asking for another copy of our Marriage Certificate. Instead of the usual RFE letter, they just called and asked us to fax it to them. Faxed it this morning around 10 and got AOS approved this afternoon! December 2013 filers, got interview waiver letter in March and got approved today. Woohoo!!!

    Yay, so happy for y'all :) can't believe they called lol

  6. Hi guys I have a question for you

    When you got your letters, did your case status move to testing and interview? Or did it get stuck on acceptance still? Any touches?

    A few friends around me's case have move to testing and interview and mine has not, however they are adjusting from different visas while I am adjusting from K1. I know K1s sometimes get the interview waiver, I just wondered if anyone else saw cases around them seem to move quicker and then ended up getting the letter

    I have a feeling I will get it -_-

    Mine was stuck in acceptance until my green card was approved without an interview. so yes, you might get the waiver letter. From what I've heard from friends' experiences, your status moves to testing and interview if you require an interview and whenever your local office is ready, they will schedule your interview. So it might be stuck in testing & interview for a few months or weeks.

  7. We got a letter last month from the national benefit center saying that our case has been identified as a potential interview waiver case. Maybe we won't have to go through an interview. It also says that due to workload factors not related, they expect a delay of about 6 months from the date of the letter in processing the case.

    So I'm confused, where's my case at? I don't see the I-485 AOS from family even listed in the list of processing times at the NBC. How do I find out where they're at in processing?

    You don't, you just wait. It sucks, I know,

    I got my letter in March and was approved last week. But it's different for every case. Good luck!

  8. Hi,

    I recently received my K1 visa and will be travelling to the States mid-August. We will marry on the 31 August and immediately file for AOS. Given that the EAD could take up to 3 months to arrive, however, my fiancée and I have been concerned about having to live off her limited funds until I am permitted to work (she is a PhD student, working as a teaching assistant alongside this).

    My fiancée came up with an idea today and I have been trying to find out whether it is feasible or not. Her suggestion was that I apply for an MA at her university to begin this fall. The idea being that I would usually be offered a paid teaching assistantship alongside this. Her thinking was that other international students (presumably on a student rather than a work visa) have carried out that job, so why couldn't I (even before receiving my EAD).

    Now, from what I can gather, I am allowed to study whenever I like (no permit required). However, I cannot work until I receive my EAD (presumably this will be around early December). The question is, in which camp does this TA position fall? Would I be right in thinking that a teaching assistantship at the university I am enrolled at would still count as paid work, and therefore not permitted until I receive my EAD, or would this be counted as part of my student activities?

    I hope I have made myself clear, but please let me know if I need to clarify this. Whilst not an active poster, this forum has been a godsend throughout our application process, and any extra help people are able to offer right now would be enormously appreciated!

    I think it would be ok for you to work without having your EAD since it would be part of your studies but keep in mind that you will be paying international student tuition so it won't do no good, unless you make enough money to compensate for it (which I doubt).

  9. Hey folks I'm in the same boat as well, AOS is stuck in the Memphis office. Mailed it in Dec, 2013 and got my interview waiver letter on March 25th. I Haven't heard anything since then.

    Two weeks ago I called USCIS to request an expidite sighting the reason of me wanting to purchase a house and apply for an FHA mortgage. I received a refusal letter in the mail 4 days after making the request... the wife and I had to laugh because the only thing USCIS has done faster was to cash our checks.

    Ugh, I hate how everything is dependent on uscis and their pace & decisions :( Their system makes no sense, I've never seen anything like it.

I know that timing is everything with USCIS, but I just have to say that it's a little irritating to see that someone who applied in early March of this year to my local office has already had their interview and been approved, while the rest of us who filed 6 months ago or more are still sitting here with nothing more than a letter saying we'll have to wait even longer. I know that it really is all about timing, backlog, etc., but it doesn't make it any less annoying.

    For the most part, I think we all go into this process knowing it's going to take some time, so I'm not trying to be really negative. Just needed a place to say how I feel. :rolleyes:

    haha so glad you said it. I feel the exact same way, it's been irritating me for the last few months because it's obviously not fair, so I stopped looking at any posts on here except for this one. It drives me INSANE. my local office is processing November filers but I guess our file isn't even in that pile. I hope all of us who are still waiting will hear something SOON. very soon ;) keep your head up! :)

  11. Thought about it too, but seems like the only thing is: If the GC still isn't approved by the time the EAD/AP expires (though I think most cases get approved before then), you'd have to pay to renew the EAD/AP. I could be wrong. Any takers?

    As long as your I485 is pending you do not need to pay a fee to renew your EAD.

    Another thing is if you get your drivers license while on EAD/AP it will only be valid as long as your EAD is valid.

    For me not having a green card also means not being able to go to college because I would have to pay international student tuition, which we can't afford, obviously. I hate that there is nothing like EAD for people who need to go back to school that would allow schools to charge you as "in-state".

  12. We're getting ready to file for AOS as soon as possible and I'm a K1 visa holder. We're hoping it won't be a problem if we send it a little over the 90 days (took some time to get the SSN and marriage license but the wedding was WITHIN the 90 days given for the visa).

    Anyway, do we need to send proof of a bona fide marriage with our AOS? So far we have pictures from the wedding and our marriage license -marriage certificate will be hopefully mailed to us soon.

    Our problem is that with live with his parents, so no bills or rent/ mortgage with our names on it, and all we can do is get a joint bank account. Will that suffice? Should we include a letter stating we don't have anything else to send, or just simply send what we have?

    We only have one copy of his tax returns for 2013, this is his first job and he never worked before so I guess we can't check this:2ywwson.png

    Do you think we're likely to get an RFE for more evidence? Does it look like we need more proof?

    You don't need to send any evidence with your AOS. you will need it for your interview (if you get one). Good luck!
