cuz as OP stated they did not have the usual red flags.

If the top part of the 221 is checked it is indicated the general reason of the person's application did not comply to the provisions of INA act or regulations blah blah blah

So I am assuming the reason is the Non Bona Fide Relationship but they wont answer why specifically. She can go the FOIA but that take so long...

thanks ladies I went one time and spent 3 months with my daughters 2011 , he told me everything she almost did not believe or accept that I was a revert Muslim without his influence that was the only thing out of the ordinary, she was abrupt and rude and he said she often breathed deeply as if being irritated from the beginning , I have called the consulate 4 times and are not disclosing any info seems like it's our right to know riiight???

Has anyone ever found out the reasons for their petition being sent back after a K1 visa interview vise refusal?? Like everyone keeps saying ppl should find out and i know it good and correct info but its clearly something no one has any straight forward working advice on exactly how to do that.... The only thing u can do is wait to see if uscis sends u something in the mail requesting for more proof of your relationship. But if they dont and it just expires u'll probably never find out... some ppl have found out im sure but it not likely. I just don't see how. DOS wont tell u. USCIS wont tell u. And if u have your Senator try, they may not be able to find out cuz the files are usually gonna be confidential or they'll just tell u that they are. If someone has actually found out about why the CO didnt want to issue the visa after a K1 interview please tell us all cuz as far as i know, its damn near impossible.

Word!!!!!! as you would think it is our right to know and the "process" in which they take is really backwards and not very humane!

Have you seen the 221g notice? You need to verify if it is a Notice Of Intent to Deny or Revoke (NOID or NOIR). If the 221g says deny then by the time it gets back to USCIS it has expired already and they just ask you to re-apply. If it Notice of Intent to Revoke then the implications are completely different, with a revocation it means the CO did not believed the relationship was bona-fide or that there was an intent to commit fraud to obtain a visa. If such is the case they normally will give you an opportunity to submit a rebuttal and any supporting documents to prove it is a bona-fide relationship. Failure to reply to their inquiry can result in a revocation this implies that your better half can no longer apply for a visa again. The normal response time from the time it is sent back to USCIS is about 6 months, they ask that you don't inquire before then. I have seen many couples still pursue assistance from their Senators it is up to you what you do at this time. You always have to option of calling USCIS to see the status of the visa application.

Hi I have a question my fiance was given a form with the check box at the bottom stating for further review and they will contact him they did contact him very quickly in fact had him to come back one week after the interview and that is when he was handed the document with box checked at the top section 221g which prohibits the issuance of visa blah blah blah blah do you know what I mean ? I don't have the original document and just a jpeg and tried to upload but is too big to post here let me know if you understand I believe I am waiting something direct from the uscis correct?

With the cases of members on here it is not unusual for K1s to be sent back then one receives a notice (maybe) since nothing has happened they are closing the case.

I too shot out many emails to the consulate, called USCIS with no avail. WE chose to marry, file for a spousal visa and spend our waiting time as positive as possible.

Stay on VJ and READ.

There are many many stories like yours and it is helpful to find out what they did to finally be together.

What ever route you chose...your present K1 or IR1 / CR1 ......u will still have to figure out what were your red flags with your case that made the CO decide to not approve your case.

What questions did your fiance not answer correctly?

is there a Large AGE gap?

and what was checked on your 221 (g)?

BTW your timeline indicates your SO had 2 interviews??

thank you for your kind words I too am confused as he had one interview on sept 26th and then called back for a so called interview,on Oct 3 that consisted of them handing him the 221g form this is another reason I was confused, if that was the second interview who knows?? all part of the mystery we have been involved since oct 2008 not a short courtship, he was confused about the engagment as we did not have a formal engagement we have been engaged since 2009 and serious about one another in that sense, also he is 30 I am 35 nothing major in age and nothing but the 221g was checked nothing else that would give clues as to what the reasoning hence the maddening confusion our love and our commitment is undeniable thanks for the reassurance it means alot !!!

From what I read from many topics people say get congressman involved and the uscis website says wait 60 days after denial but there is never a denial other than we were told that our petition was sent back to USCIS I am trying to be proactive but so much conflicting and limited information!! and the strange part is during the interview she told him apply for k3 she suggested to get married, of course she did not tell him why she denied and he asked believe me any info would help she seemed awful concerned that I was a revert Muslim by my own accord and not swayed by my relationship that blossomed a year after my reversion that seemed to seriously concern her and her questions disturbed my fiance any insight would help ease my nerves and my fiances thank you!!!

K-1 "further investigation" at the consulate level is often times a de facto visa denial. They know the visa will expire before the investigation is complete.

If your visa is still valid it seems harsh that they'd deny you based on the visa being expired!? Have you tried emailing the consulate?

Yes thank you I have blasted emails to the chief and the officer consulate as well as my senator and congressmen! and yes feels like a denial to us she suggested to get married and do a k3 visa but what a slap in the face of someone that just paid fees for a visa upfront as well as other costs incurred and seems wrong to do so honestly they should take the visa fee after the approval.

I have been watching topics online here, and I thank you all for your candid support in many issues, now seems it is my turn as my fiance went for a interveiw on the 26th of Sept was given the we are going to further investigate later we will call you and then day after recived a call for another interview on Oct 3 2012 and he said he was not interveiwed but handed the 221g where they say they will send it back to uscis and her reason to him was the k1 had expired as it has not and is valid till 11/18/12 I am lookin for the chief of immigrant visa our approval letter states his case is in rabat as his interveiws were in casa I just want to stop them from sending it back if the reason they are sending it back has to do with the expiration, I kind of doubt that as I sent him with that approval letter stating the experation date super werid and strange and we need some answers anyone know where to start I will fill in my info insha Allah thank you ahead of time for anyone that takes time out to advice us .
