  1. I have a good friend who came to the US on a k-3 visa. She married her husband in the Philippines. She is a Filipino and he us a US citizen. She has been here now for 1year 5months. She has a 10 year green card. She lives in New York state.

    Her husband after her arrival has become not a very

    Nice man. He has cheated repeatedly and has been verbally abusive. He has two teenage kids who will not except her and treat he terribly and he will do nothing about it. He has never hit her or physically abused her. Only infidelity and verbal abuse from him and his kids.

    Can she in her current situation divorce him without being kicked out of the US? Not sure if having her 10 year GC helps in this situation or not. Thanks in advance for any advice you can give.

  2. I started a K-1 awhile back before the new fees went into effect. Unfortunately things didn't work out at that time. We will be filing again though. The new fees and there whole revamping of the system was just about to go in effect when I was going through all this.

    I was just wondering if anyone can tell me if the anything has changed since then besides the increase in fees. Is the wait time shorter? is there less paperwork? is filing easier? are there more agents working at processing apps? stuff like that. thanks for anyone who offers any insight into this. or any other info that you can add to this. thanks.

    Wait time is longer, especially this year, as my attorney said, she has been doing K-1/K-3 for 8 years, and she has never seen such long wait periods such as the ones this year. The paperwork is about the same, you can check the guides here on this website. Supposedly, there are more agents working at the processing applications: VSC and CSC are the only two that do I-129F application/ fiance petition/K-3/Spouse petition processing. Basically, if you are planning on filing again, anytime is a good time to file, as long as you fulfill all the requirements for your case, their is no accurate indicator of which month is the best to apply, etc. as every case is different, pple get RFE's, some nationalities are from high-fraud countries, so that may take longer, basically, look at the guides for K-1 here and ask any questions as you move along in the process.

    yeah its to bad. I was always a big supporter of the new fees as long as the things they proposed would actually take affect. It is to bad that something like this is not treated like any other paid service. If the services promised are not provided then you should get a rebate to old prices or some kind of compensation. I honestly think that if they cannot make good and what they promised they should not be allowed to continue charging these fees. Seems very misleading to me.

    But there is no way to police that. And after all its only a few hundred bucks to be with our loved ones so we will wait and we will pay. It is not like we are after something we can just put on hold to prove a point. hehe oh well. thanks fofr the info. That is what I was after so I have an idea what to expect.

    NO CHEATING haha just kidding. she answered both. she wil study to be a nurse then work as a nurse.

    as far as the correct answer. its whatever is acurate for you. there is no wrong answer. excetpt if you where to answer "Pluto" hahaha. BTW how are you doing. I've been afk for awhile. so ive been out of touch.

  6. My So will have her interview on OCt 5th this Friday. Where she is from it normally takes about a month for the visa to be delivered, so she should most likely have it by November 5th.

    However she would like to stay in the Philippines until December 28th so she can have one more Christmas with her family before the move here. We will of course visit them a lot after all the conditions and that hoopla is over with. But I can totally understand her wishes.

    I am pretty sure this wont cause any problems with the time frame of the visa process waiting almost two months after receiving the visa. 3 months since the interview. But I don't like to leave anything unchecked in this shady process hehe.

    So my question is. will staying 2-3 months in the Philippines beyond the issuing of your K-1 visa before entering the US cause any problems with the process?

    It's my understanding that the visa has a 6 month validity and thats just for you to use it right? then once she enters the US the 3 months cycle to be married then starts? Or am I wrong and will her sticking around to be with family not be advised?

  7. Hello everyone. I have been hiding for a few hehe. Things have been so busy for me here and I just moved so finally got my internet back.

    My SO's medical went well. She did here just a few days early. she showed up a bit late so she had to wait there all day long. Word of advice to everyone. get to medical at like 4-5 hehe.

    I think she is doing her CFO today.

    Interview is Friday so wish us luck. And I wish you luck today for all who have there interview on the 3rd.

  8. My SO made an error on her ds 156. it is electronically filed right? is it possible to do it over again now? her interview is Thursday.

    should she redo it or explain her error at the interview?

    she has her copy she made of the ds 156 that she corrected with white out. and retyped it.

    When you fill out a DS 156 online you can re do it online as many times as you want. The info you type doesn't go anywhere. Just into the barcode. Just have her do a new one online.

    It's important to have everything spelled correctly.

  10. My So was born in Samburon, Linamon. Mindanao.

    On her G325a she put Iligan city which Linamon is technically part of iligan, but on her DS 156 and 156k she put samburon. linamon.

    on her birth certificate it says samburon linamon.

    is this the fact she has iligan city on her g-325a going to cause a conflict that we should be concerned about?

  11. My fiance is still waiting for her certified NSO divorce decree. Her medical is scheduled for the 27th of sept and her interview date is Oct 5th. Will st lukes medical ask about SECPA papers? What if the NSO still doesn't have her divorce decree ready by the interview? As far as I know she can't do her seminar without NSO verified Divorce decree. Any advice?

    I hate to have to reschedule the interview. no it's crunch time and I hate to have all our good luck so far be taken down by the NSO.

    I don't quite understand why you are using the term Divorce Decree.

    No such thing recognized by the Philippine Government.

    Hopefully you mean Annulment!.

    No such thing as A NSO verified Divorce Decree!

    Yeah that is what i mean. The NSO certified proof of her annulment. :)
