  1. I would never give up, we just had decide I may need to travel back and forth until the end of the ban. Today I got an email, they are correcting the paper work where it will say we can apply for the waiver!! By a waste of time and money I only ment I want to know the odds of getting a waiver, if they are bad I will spend the time and money to make her life better in mexico and to travel to see her more.

    I live in western NC, but I travel for my job so I would talk to any good lawyer any where. just need referral, I like to see a track record!

We finaly got an answer as to why Alejandra was banned for missreprentaion, ill copy and post the email, I hope someone can explain to me if I can really apply for a waiver now, at her interview she was give a blue paper saying she was inelagable due to overstaying a tourist visa, and due to misrepresentation. the interviewer did not tell her what she misrepresented, only said to get a lawyer. we knew about the over stay and were prepareing for a waiver, but the paper said we were not eligable for one. and was banned 10 years from the time she reentered mexico. after appling very littel pressure, and waiting about 2 weeks we get this email

    Ms. Andrade can file form I-601 Waiver of Grounds of Inadmissibility with the U.S. Citizenship and Immigration Services (USCIS) for her ineligibilities under INA 212(a)(9)(B)(i)(II) and INA 212(a)(6)©(i). Her ineligibility under INA 212(a)(6)©(i) stems from the fact that she misrepresented her purpose of travel to the United States when she applied for admission to the U.S. by presenting her valid tourist visa when her true intention was to continue to reside in the country in violation of the terms of her visa.

    I emailed them back asking for them to re issue the form, removing the line saying we could not get a waiver and reflecting the 501 waiver eligablity, I am still waiting for a responce.

    has any one else ever heard of this? can I apply for the waiver even thought the only thing I have is an email saying I can? any suggestions from anyone who has been through this? before I pay the lawyer fees and the waiver fees I want an idea if it possible or if it is a waste of time and money, thanks

  3. had our interview yesterday in mexico. we were expect to be told to get a waiver for her over stay that ended in 2009 giving her a ten year ban. we were denied ubder INA §212(a)(6)©(i). and also for the over stay. the box for no waiver is also checked, the papers says a to 10 year ban starting jan 2009. After reading about INA §212(a)(6)©(i). it reads like there should be a waiver.

    I have no idea what they think was misresprented, and if it for something on the ds-260 or other forms we filled in would the ban not have started yesterday?

    she was honest on the forms about the overstay, I filled out most of them with her and nothing was hide or untrue.

    I'm going to an attory as soon as im back in the states, but for now I am hoping for some education and some hope.

    can anyone tell me what may have happened, and if there is hope we can get this over turned, waived, correct, anything!

    She has no criminal record in the US or Mexico, she over stayed a tourist visa for years leaving 2009 on her own (not deported, no interaction with Immagration, just left). She has two small girls that were born here i the US, they live with her in mexico.

    she asked then to explain the misrep. but the interviewer told to just get a lawyer and didnt say any more.

    They reviewed our packed and kept her birth cert, look at my pay roll and financial things, and took the DS-156 and 156k and kept them also.

    I understand this will take a good attorney, I'm just wanted advice and information, the more I can learn the more I can help the attorny, and the better understanding I'll have when we talk. plus I need anything to give me some hope.

  4. Don't make such a life changing decision when you are so emotional. I know ..easier said than done. Men suck sometimes. Do what is good for you. If you keep the baby and he never shows his face.... His loss. Don't give up your dreams because of some dumb A$$ man who can get his emotions in check and offer something to you,

    Sometimes you have to do YOU. In the end, you are the only one who will take care of YOU....

    Take a deep breath and wait a little before you jump. You don't want any regrets ( or at least any more than you already have)

  5. I am very sorry to hear all you are going through, I can only tell you what someone else already said, dont listen to anyone trying to push their beliefs on you. They will not be there in the days weeks and years to come. You only know what is best for you. I believe that no one should have the right to tell you what to do with your body, there are many good reasons to decide either way. If you need open honest ears to listen you can find them here hidden among the overbareing better than tho zeloits. As for him, it sounds like he would have been bad for you in the long run, hard to see him being a loving supportive husband.

I posted ealier about my fiance's over stay on a previous tourist visa, the reply's I recieved point my to a 601A waiver, but that seems to be for someone who is in the US now and needs to leave for the interview. Can someone explain to me what waiver I need for her, she is in Mexico and her interview if scheduled for her K-1 visa, I think we will get a form from at the interview about her in eligablity and be told to file a waiver. I wanted to be preparing it in advance just to speed up the process.

  7. How does sound like for the waiver? The best hardship I can find on my part is that shortly after we got serious, I was able to stop the treatment for depression I had been on for years, I have friends who can right letters saying I stopped drinking cold turkey when I met her. and also I can not move to mexico because strong family ties here, my son is just starting acadamy, I have a 13 year old daughter, her mom has custady and would never let her go to mexico, My ex did not work the 18 years we were married and is having trouble findind working now, so I must support the kids 100% (and her to a point.) there is not by court order, I do this our of moral belief and personal responabilty. My training as a CDL drive would not earn enough in mexico to support myself much less everyone else. The last one I an not sure about using because it look like i can not support my fiance once she is here, but I can, but only by working in the US.

  8. Her passport would have given it away if she didn't state the truth on the forms. And the background check would have uncovered it too. Then you would have alot of explaining to do. Its better to file the waiver. I have mine all ready. its about 2 inches thick. We just need to get through the USCIS and interview. The good thing is the waivers are now processed in the US. The processing time is stated at 4 months ( but we all know that is just an estimate) I would suggest getting an immigration attorney if you aren't sure what to do about the waiver.

  9. She over stayed for years, she is your fiancée but you did not know?

    That would be of more concern.

    The waiver is just time and money.

    i was unaware until now, me and her going to try to work through that before I do anything else, but I want to find options and know my chances of getting a waiver as i decide what to do about the entire problem. Time is a problem but I can not change that, money is just money, I can afford the cost of a waiver if it means being with the one i love.

    You say it just time and money, does mean you feel a waiver is likely if its worded right?

  10. Ok, now that the dust is settleing, I can start thinking and planning,

    How likely is it that she can can a waiver, I think the hardship she can claimis her to young girls are american born and they can not be here with our her, their dads are not around and are not USC's. we would like them to have the benifit of school in the US and the safety of leaving here as compared to mexico city. can someone point me in the direction of past post or guides where waivers were appoved so I can learn what works and what does not. can i get opinons about the likely hood of get approved and how long it will take.

  11. The annoying thing is you have to wait for the denial before you can apply for the waiver, as far as I understand it, so you'll have to carry on for the moment and just be prepared for what they're going to ask for. I believe you'll be looking for the I-601 waiver.

    How long did your fiancé overstay and how long has it been since she left the USA?

    I have not talked tro her yet, on the forms she states she overstayed years, I know she left in 2009 i think in august

NVC received my file and gave me my case number yesterday, I asked if it had been sent to mexico yet, and she tellings no, it has additional processing?!!! should I be worried or does it just mean they are putting it into the system and have not sent it yet? I hope they are not going to pick it apart now!!!

    Antone else been told they are waiting for addiotional processing at NVC?

  13. We got our case number today finally...We were transferred to Texas from vermont on June 21st and then got our NOA2 on July 10th. Then we got a message that our file was sent to NVC on July 25th and this morning we just got our case number...Very happy about this !

    con grads, your dates are exactly the same as mine, I will have to wait until minday to call and check, as of 11pm thursday NVC had our file but no case number, wish us luck. Someone else has said to call later in the evening because of a shorter wait, i would also like to add they are a lot politer and more pleasant to deal with at night. One gentelman even asked me to to read him the letter I recieved after he told me they had not recieved my file. He said that he understood the NOA2 was confussing because it says the papperwork is being forwarded to the embassy. He said it was diffently going through NVC first, and even though they are telling everyone weeks, it is not taking that long and once they recieved my file things should happen fast. In the end he didnt do much more then everyone else, but at least he was willing to help me and wanted to make sure we understood everything.

  14. I would go ahead and pay fee now. We paid a few weeks after we got NOA2, but before we got MNL#. Visa fee is good for one year.

    I scheduled the interview 15 minutes after we got MNL#. It's really up to you. You can wait and see what happens at NVC, but you can always reschedule the interview if NVC doesn't send your case in time. I think you can reschedule twice.

    can anyone tell me if this is true for Mexico also? I would feel better if i could schedule the interview ASAP
